�� ORDINANCE NO. 92-28 •
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY �
`�' OF GRAPEVINE, TEXAS ABANDONING AND VACATING A
TEN FOOT (10' ) SANITARY SEWER EASEMENT LOCATED
IN LOT 3 , BLOCK 2 OF THE LEWIS T. BAKER
ADDITION, IN THE CITY OF GRAPEVINE, TEXAS, AS
HEREINAFTER DESCRIBED; PROVIDING A
SEVERABILITY CLAUSE; DECLARING AN EMERGENCY
AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the owner of a tract of land located in the Lewis T.
Baker Addition, in the City of Grapevine, Tarrant County, Texas as
more particularly described in Exhibit "A", requested the sani*ary
sewer line easement, as hereinafter described, be abandoned and
vacated; and
WHEREAS, the sanitary sewer line easements, as hereinafter
described, are not needed for public use and will not be needed in
the future for public use; and
WHEREAS, abandoning and vacating the sanitary sewer line
easements will relieve the City of Grapevine, Texas from the cost
,� and expense of maintaining said property and facilities.
�' NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That a ten foot (10' ) sanitary sewer easement
located across Lot 3, Block 2, Lewis T. Baker Addition in the City
of Grapevine, Texas as recorded in Volume 388-192, Page 75, Plat
Records of Tarrant County Deed Records, and as shown in
Exhibit "A", attached hereto and made a part hereof, is hereby
abandoned and vacated for public use and the same is hereby

abandoned and vacated insofar as all public right, ti 1 , �
interest in and to said described portion of said sanitary sewer
line easement are concerned. The City shall have no responsibility
for maintaining said easement.
Section 2 . If any section, article, paragraph, sentence,
clause, phrase or word in this ordinance, or application thereto
any person or circumstance is held invalid or unconstitutional by
a Court of competent jurisdiction, such holding shall not affect
the validity of the remaining portions of this ordinance; and the
City Council hereby declares it would have passed such remaining
,� portions of the ordinance despite such invalidity, which remaining
' portions shall remain in full force and effect.
y�; Section 3. The fact that said sanitary sewer line easement is
no longer needed by the public for public usage and would create a

hardship or burden upon the City of Grapevine to keep open and �
�'"� maintain such easement creates an urgency and an emergency for the
immediate preservation of the public health, safety and general
,
welfare, which requires that this ordinance shall take effect
++� immediately from and after its passage, and it is accordingly so
ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 16th day of June , 1992 .
