Home My WebLink AboutORD 1991-084 ,� _r � ORDINANCE NO. 91-84 ' �:� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES BY AMENDING CHAPTER 7 BUILDINGS AND CONSTRUCTION, ARTICLE I, BY THE ADDITION OF SECTION 7-8 RELATIVE TO GENERAL CONTRACTORS REGISTRATION; BY AMENDING ARTICLE VI SECTION 7-152 RELATIVE TO REGISTRATION OF MECHANICAL CONTRACTORS; BY AMENDING ARTICLE VIII SECTION 7-172 RELATIVE TO REGISTRATION OF PLUMBING CONTRACTORS; AND BY THE ADDITION OF ARTICLE XI SECTION 7-215 RELATIVE TO REGISTRATION AND LICENSING OF IRRIGATING CONTRACTORS; REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY IN A SUM NOT TO EXCEED TWO THOUSAND DOLLARS ($2, 000. 00) FOR EACH SEPARATE OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE . . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, � TEXAS: Section l. That Chapter 7, Article I is hereby amended by the addition of a new subsection 7-8 to read as shown in the attached Exhibit "A" . Section 2 . That Chapter 7, Article VI, Mechanical Code Sections 7-152 . (c) and (d) are hereby amended to read as follows: " (c) Registration required for mechanical contractors. To register with the City of Grapevine as a mechanical contractor, application shall be filed on forms furnished by the Building Inspection Division. The application shall show the mechanical contractor's name, local address and telephone number, and such other information as may reasonably be required to properly identify the mechanical contractor. (d) Fees for registration. Annual registration fees shall be required for all mechanical contractors. The annual registration fee shall be seventy-five dollars ($75. 00) and shall be payable at the Department of Community Development. '��' The fiscal year for the payment of registration begins on January f irst and ends at midnight on December thirty-f irst of the same year. " � , Section 3 . That Chapter 7, Article VIII, Plumbing Code �', � m Section 7-172 . (c) is hereby amended to read as follows: , " (c) Method of registration for plumbing contractors. That all ordinances of the City or any parts �;,„A„ thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine, Texas shall be deemed repealed only when all such cases filed and pending under such ordinance or ordinances have been disposed of by a final conviction or a finding of not guilty, nolo contendere, or dismissal. Section 7 . Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2 , 000. 00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining �� portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. � 2 Section 9. The fact that the present ordinances and �' ' regulations of the City of Grapevine, Texas are inadequate to i properly safeguard the health, safety, morals, peace and general ' welfare of the public creates an emergency which requires that this �� ordinance become effective from and after the date of its passage, and it is accordingly so ordained. Each contractor shall be reQUired to maintain a registration with the City before performing an_y tv�e of construction work regulated bv the Grapevine Buildinq Cocie . f Each contractor sha1l furnish - the Buildin Inspection Division with the following information: 1 . Contractor classification. ' - 2 . Company name. , 3 . Company mailing address . ; 4 . Company telephone number. 5 . Principal owner' s r_ame and mailinq address . , - 6 . Principal owner' s drivers license number. I (b) Registration Fee. Annual registration fees shall be reauired for all contractors. The annual recristration fee shall be �° ' seventy-five dollars (�75 . 00) and sha11 be payable at the Department � of Communitv Development. The fiscal veaY for the payment of registration beQins on January first and ends at midnight on �"�'�' December thirty-first of the same vear. (c) Registration Renewal. The reqistration mav be renewed for the ensuing calendar vear by filina a new recristration and pavment as set forth in (a) and (b) . No refund shall be made in the event of the revocation or surrender of anv such reaistration certificate . {d) Registration Denial. The reQistration of a contractor ' may be denied bv the Buildinc� Of=icial, or the rec�istration may be revoked by the Building E�oard of Appeals if the registrata.on is issued on the basis of incorrect information supplied bv the contractor. (e) Revocatipr_, Suspensien and Notice. 1 . In the e�Tent of knowincrly committinct outstanding violations of Citv recruirements , the Building Official mav revoke or suspend a centractor' s recristration up to one (1) vear. In the event that a contractor wishes to ap�eal the dec?sion of the Building Of_ficial for revocation or suspension, the contractor shall . file a written notice of appeal in the office of the Luildincr Official within ten (10) days of receipt of the notice for revocation or suspension. 2 . A hearing shall be held before the Building Board of Appeals after the contractor has been gi�Jen notice of the hearincr by personal service or certified mail, return receipt requested, at least ten (10) days prior to the hearing date. 3 . After the hearing, the contractor shall be notified in writir_cr of the determination of � the Building Board of Appeals bv personal service or certified mai1, return receipt recruested. (g. ) Exemption for N.omeowner. No such registratior_ �. Drocedure shall be required for alteration or repair work to be Derformed on a residential structure when the. person per=ormir_a the alteration or repair work is the cwner of the structure , has his ` � � legal residence there , and is r_ot assisted bv any other Aerson for remuneration. The homeowner shzll be automaticallv termed a ReQistrant for the �u oses of such a project without registration. CHAPTER 7 � �� ARTICLE XI SECTION 7-215 IRRIGATION CODE Sec. 7-215 Registration and licensing of irrigating contractors (a) Securing permits by unregistered irriqatincr contractors declared unlawful. It shall be unlawful for any person, firm or corporati�n who is not registered by the city as an irrigating contractor to secure permits as provided herein. Each irrigatinq contractor shall register annuallv with the citv at the beqinnincr of each year prior to doina irriqation work within the city in any current year. The irrigating contractor shall furnish the name or names of persor_s who are authorized to sign permit applications. (b) Certificate of Occupancy. Each applicant for reqistration as an irrigating contractor shall have an established place of business or shop for which a certificate o= occupanc_y has been secured from ,� , the Citv of Grapevine if such business is located in the City of Grapevine.
