HomeMy WebLinkAboutORD 1991-055 . � r . � � � �1 �.J ORDINANCE NO. g1-55 v � AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING TWO (2) TEN-FOOT WIDE SANITARY SEWER LINE EASEMENTS LOCATED IN WESTERN OAKS ESTATES, SECTION II, IN THE CITY OF GRAPEVINE, TEXAS, AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the owner of a tract of land located in Western Oaks Estates, Section II, in the City of Grapevine, Tarrant County, Texas as more particularly described in Exhibit "A", requested the sanitary sewer line easements, as hereinafter described, be abandoned and vacated; and WHEREAS, the sanitary sewer line easements, as hereinafter described, are not needed for public use and will not be needed in the future for public use; and �,,, WHEREAS, abandoning and vacating the sanitary sewer line ` easements will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property and facilities. � NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City of Grapevine sanitary sewer line easements as recorded in Volume 81-62, Page 1281, and Volume 82-72 , Page 5�2, of the Tarrant County Deed Records, and as shown in Exhibit "A", attached hereto and made a part hereof, are heieby abandoned and vacated for public use and the same are hereby abandoned and vacated insofar as all public right, title, duty and interest in and to said described portion of said sanitary sewer line easements are concerned. The City shall have no responsibility for maintaining said easements. Section 2 . If any section, article paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the ,a ,, City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. � ,, - , Section 3 . The fact that said sanitary sewer line easements °"'� are no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such easements creates an urgency and an emergency for �r the immediate preservation of the public health, safety, and general welfare, which requires that this ordinance shall take effect immediately from and after its passage, and it is accordingly so ordained.
