placed on the agenda for public hearing at the discretion of the staff. Based on the size of the
agenda, your application may be scheduled to a later date.

Any changes to a site plan (no matter how minor or major) approved with a conditional use or a

Any application for a change in zoning or for an amendment to the zoning ordinance shall have,
from the date of submittal, a period of four months to request and be scheduled on an agenda
before the Planning and Zoning Commission and City Council. If after said period of four months an
application has not been scheduled before the Commission and Council said application shall be
considered withdrawn, with forfeiture of all filing fees. The application, along with the required
filing fee may be resubmitted any time thereafter for reconsideration. Delays in scheduling
applications before the Planning and Zoning Commission and City Council created by city staff
shall not be considered a part of the four month period.

1. Please add case number CU14-24, the case name and location to the
signature block of each sheet.
2. Please provide a contrasting existing approved floor plan/proposed floor
plan. Please cloud the areas of the proposed changes label the
contrasted floor plans as sheet four of six.
3. Please provide the perimeter dimensions of the seating/floor plan.
4. The quantity of counter seats on the floor plan does not match the quantity
of counter seats within the seat count chart. Please revise accordingly.
5. Please show the outdoor seating, label the point-of-sale, alcohol storage
and dining/consumption areas on the floor plan.
6. Please add the following notes to the site plan stating the purpose of the
conditional use request:
a) Conditional use request CU14-24 is a request to amend the
previously approved site plan of CU13-17 (Ord.13-35) to allow the
possession, storage, retail sale and on -premise consumption of
alcoholic beverages (beer, wine and mixed beverages) in
conjunction with a restaurant, specifically to allow outdoor speakers
and outside dining in conjunction with a restaurant.
b) The entire site is the premises.
7. Please provide a landscape plan.
8. Please label the adjacent R7.5 zoning as "R-7.5" Single Family District.
9. The speaker plan specification and outdoor string light specifications may
not be legible at the 11" x17' reduction. Please verify that the
specifications are legible on the reduction.
10. Please label on the speaker plan the purpose of the speakers and when
(time of day/night) they will be used.
11. Please provide a blackline drawing of the elevation sheet including
existing building height, height of metal fence, height of posts for the roller
shades and cloud the pass-through window. The poles and shades
must be composed of non-combustible material.
12. Please revise the parking analysis chart to include an occupant/parking
schedule (existing tenants and unoccupied space) for the site showing
adequate parking exists to accommodate the proposed use.
13.
The above comments must be reflected in a revised submittal for the
June 17th joint public hearing. Please submit the revised documents to
the Department of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) Mylar (uncolored) of each sheet (minimum size 22" x 34")
thirty (30) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).
one (1) colored version of the landscape plan (without text) on 11" x 17"
sheet or a digital version of the same.
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City -approved tax rolls, you received this notice. If you cannot or
do not wish to attend the hearing, the attached form is provided for your

Purpose of Request:
The public hearing is to consider an application submitted by So -Cal Tacos #1 LLC for

Plaza Addition. The applicant is requesting a conditional use permit to amend the
previously approved site plan to allow the possession, storage, retail sales and on -premise

To Whom it May Concern,
It has been brought to my attention that support is needed by patrons of So -Cal tacos to represent our
support for a patio being allowed at their restaurant. I don't understand why this is so difficult to get
approved as seeing that the weather in Texas lends itself to have good evenings outdoors it seems only
fitting for a restaurant to have the right to offer its services outside as long as it is on the property they are
paying for. I want to represent that I fully support the idea of outdoor eating as it brings conversation to
meals which we could all use a little more of.
Their food is fantastic and their story is even better. Allowing them to have an outdoor space would allow
a thriving business in a bad economy to do even better which would also add jobs seeing they would
have more space and tables that would need service.
Please allow the adding of a patio to this establishment.

I just want to tell you that there is no one more deserving than Scott Wooley and the team at So -Cal.
What's great about calling Scott my acquaintance - gone - friend is that anything he does -whether
personal or professional is always about what's good for others. In other words, the patio is probably
more about bringing his customers joy to be able to sit outside and enjoy a beautiful day than just about
the bottom line.
I hope that you consider this when you make the decision to grant them a patio. You will be making a
choice that is far more important than just allowing a restaurant to open a patio. Scott will embrace it and
appreciate it. And he will do what he does best ... he brings smiles to others which in the world we live in is
a rarity.
If I can do anything at all to help make this happen, please call me at any hour of the day. Scott has my

I'm writing on behalf of Scott Wooley, owner of So -Cal Tacos located in Grapevine.
It has come to my attention that So -Cal will possibly be building a patio on the property where they are
located? I want give my recommendation for this patio approval to go through not because I have any
authority but because Scott is the epitome of the type of owner you want in Grapevine. He is an incredible
father, a loving husband and cancer survivor! He came to me for prayer and we believe as a result of
prayer, he was completely remised a clean bill of health a month later. After being cleared of what he
thought was a death sentence, Scott decided to live his dream and work in the food service industry,
owning a food truck then on to a brick and mortar operation. What a feat of courage and a leap of faith!
Scott is the type of owner you would want to expand a business in your city. He has the kind of character
and success story that would only make the city of Grapevine an even better city than it already is.

I am writing to voice my opinion as a local business owner and resident in
support of So Cal's request for a Patio permit.
I can only see a positive result in granting permission to the owners of So
Cal to build the patio. So Cal has brought a new variety of Mexican food and
atmosphere to a previously vacant location. There are no people who will be
negatively affected by moving forward with the permit. The City of Grapevine
will only see an increase in tax revenue if So Cal continues to grow and
prosper. The only way they can continue to grow is to add additional "real
estate" to accommodate more customers. There closing hours are, from my
understanding 10:OOpm. Therefore, I can't see any noise or other issues that
would stand in the way for your approval.
I hope you view this as a positive move and help a small business grow and
prosper.

The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU13-17 (Ord. 13-35) to allow the possession, storage, retail sale and on -premise
consumption of alcoholic beverages (beer, wine, and mixed beverages) in conjunction with
a restaurant, specifically to allow outside dining and outdoor speakers.
The applicant proposes to relocate 14 seats for the existing SoCal Tacos restaurant—ten
outdoor seats and four indoor seats to a proposed 542 -square foot outdoor patio located
adjacent to the west side of the restaurant, along with two outdoor speakers to provide light
background music for those sitting outside. The total seating for the restaurant is proposed
to be reduced by two seats from 76 to 74; 60 seats inside and 14 seats outdoors requiring
25 parking spaces; 134 are provided.

PRESENT ZONING AND USE:
The property is currently zoned "CC", Community Commercial District and is developed
with a neighborhood shopping center. The existing use is SoCal Tacos restaurant.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was rezoned in the 1984 City Rezoning from "R-1" Single Family
District to "CC", Community Commercial District. A site plan for a small commercial center
was administratively approved in June 2000 (SP00-06). The site is currently developed
with a neighborhood shopping center. CU00-74, approved in January 2001, approved a
conditional use permit for the possession, storage, retail sale and on -premise consumption
of alcoholic beverages (beer, wine, and mixed drinks) in conjunction with Zuroma's
restaurant. Conditional Use Permit CU01-44 (Ord. 2001-71) was approved at the
September 18, 2001 meeting which allowed for the possession, storage, retail sale and off -
premise consumption of alcoholic beverages (beer and wine only) in conjunction with a
gourmet and fine wine retail store (The Connoisseur). The Site Plan Review Committee on
May 16, 2001 approved (CU01-24) which revised the floor plan for Zuroma's restaurant.
Conditional Use Permit CU 11-15 (Ord. 2011-30) approved at the July 19, 2011 meeting
which allowed a revised floor plan for The Flats restaurant. Conditional Use Permit CU 13-
17 (Ord. 2013-35) was approved at the July 16, 2013 meeting to allow for outdoor dining
and a floor plan revision in conjunction with a restaurant.
The property located to the east of the subject site was rezoned in the 1984 City Rezoning
from "C-2", Community Business District to "CC", Community Commercial District.
Conditional Use Permit 96-23 allowing the possession, storage, retail sale and on -premise
consumption of alcoholic beverages possession, storage, retail sale and off -premise
consumption of alcoholic beverages (beer and wine), was approved by Council on
September 17, 1996 (Ord. No. 96-76). Randy's Chevron Station was subsequently
developed on the site. Conditional use Request CU02-20 approved at the May 29, 2002
Site Plan Review Committee meeting allowed for enclosing of a drive-thru canopy and
conversion to a storage area.
The land located to the northwest of the site was rezoned in the 1984 City Rezoning from
"R-1" Single Family District to "R-7.5", Single -Family District and was subsequently
developed as Belfort Estates. Parker Cemetery is located directly north of the site.
Zoning Case Z83-29, approved in August 1983, rezoned the property located to the south
from "R-1" Single Family District to "R -MF -2", Multifamily Residential District (Ord. No. 83-
47), however the site was not developed. In January 1986, Council approved Z86-01 (Ord.
No. 86-09), rezoning a 16.3 -acre piece of this site to "CC", Community Commercial District
for a mixed use retail concept that never developed. Case No. Z94-01 (Ord. No. 94-17)
revised the stipulations set forth in Ordinance 86-09 by eliminating a 30 -foot right-of-way
dedication for a proposed street that was to connect Heritage Avenue to the southbound
service road of William D. Tate Avenue/State Highway 121. Zoning Case Z97-18 (Ord.
OlZMCU14-23.4 2 June 9, 2014 (11:57AM)
No.97-134) and CU97-47 (Ord. No. 97-135) were approved by Council on December 2,
1997, changing the zoning of the entire site to "CC", Community Commercial District and
approving a conditional use permit for a Planned Commercial Center with the Possession,
storage, retail sale, and off -premise consumption of alcoholic beverages (beer and wine
only) in conjunction with a grocery store. Since that time, CU98-23 (Ord. No. 98-75)
allowing for the realignment of an interior drive aisle and subsequent reallocation of parking
spaces on Lot 1 was approved in June, 1998 and CU98-44 (Ord. No. 98-114) was
approved in September 1998 approving the addition of a monument sign to the site.
CU98-27 (Ord. No. 98-76) for a Wendy's Restaurant with a drive-through window was
approved in September 1998. Special Use Permit SU14-02 (Ord. No. 2014-23) approved
at the April 15, 2014 meeting allowed for massage therapy in suite #100 of the Tom Thumb
Center.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "GU", Governmental Use District and "R-7.5", 'Single Family
District— Parker Cemetery and the Belfort Addition.
SOUTH: "CC", Community Commercial District—Tom Thumb Neighborhood
Shopping Center
EAST: "CC", Community Commercial District — Exxon Food Mart
WEST: "CC", Community Commercial District — Dry Clean Super Center
The subject tract is not located within any of the noise zones as defined on the "Aircraft
Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as Commercial. This request is in
conformance with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates Hall -Johnson Road as a Type B Major Arterial with a
minimum of 80 feet of right-of-way developed as four lanes with a turn lane.

This letter is to verify that your request for a conditional use permit located at 2140 Hall Johnson

City Council on June 17, 2014 with the condition that the outdoor speakers are eliminated. A copy

On June 17, 2014, the Planning and Zoning Commission recommended the City Council approve

are approved provided the following items are complied with:
1. If a State "TDLR" Owner/Agent form needs to be filled out for your project, please submit the filled out form
to my attention at bolds firstalliedcorp.com.
2. The use of Anchor Diamond Pro Beveled Stone and Cap are permitted.
3. The metal railings must comply with the attached specification sheet.
4. String lights are permitted at this time but Owner reserves the right in the future upon notice to Tenant to
direct Tenant to install different lighting, at Owner's sole discretion.
5. Tenant agrees not to install a lockbox on the doors or surrounding areas of the leased premises during
construction.
6. Tenant's use of the exterior speakers shall not disturb other occupants of the shopping center or complex and
Owner reserves the right upon notice to Tenant to direct Tenant to discontinue the use of speakers thereof, at
Owner's sole discretion.
7. Tenant agrees to keep all areas of the common area in a neat, clean manner and ensure there is no debris
placed outside the leased premises (unless in the construction waste receptacle).
8. Tenant agrees not to use the common area waste receptacles for Tenant's construction debris.
9. Any cost associated with the fire sprinkler system including but not limited to; piping, monitoring, false
alarms, etc... shall be the responsibility of the Tenant.
10. Tenant shall supply and pay for all costs and material for any work involved in this renovation. Owner shall
not be responsible for any materials, work or cost relating to this remodel regardless of anything contained in
the plans and/or specifications to the contrary. There shall be absolutely no cost of any sort or nature to the
Owner as a result of this project, except as specifically provided for in the lease, including but not limited to

I l . The Tenant shall indemnify, defend and hold the Owner harmless for any claims of any sort or nature relating
to this project.
12. All work shall be performed with the least amount of disturbances to the other tenants of the shopping center
as well as the surrounding community. Tenant agrees to minimize demo work, jack hammering, steel
cutting, etc while other tenants of the shopping center are open for business.
13. Tenant shall be responsible to ensure that traffic flow is not impeded as a result of this project, which shall
include the installation of temporary traffic control devices if necessary.
14. Tenant agrees to immediately repair, at Tenant's expense, all damages to any portion of the shopping center,
including damage to other tenant's spaces, to a condition acceptable to Owner, caused by this project.
15. Tenant guarantees that all work performed, structural or otherwise, shall not damage the structural integrity of
the building, parking area or other property and improvements in any way. In the event of such damage,
Tenant agrees to be fully responsible for said deficiencies and will immediately repair said deficiencies at
Tenant's expense.
16. All work shall conform to all codes from any and all governmental or other controlling agencies and comply
with all requirements of the terms of the lease pertaining to Tenant's improvements.
17. Tenant agrees that Tenant's square footage is as outlined in the Lease Agreement and any reference in the
plans to a lesser square footage is incorrect.
18. Prior to the installation and placement of any construction waste receptacles, Tenant shall obtain Owner's
additional approval for the locations thereof. Any construction waste receptacles shall be installed using
wood blocking to avoid damage to the paved parking or other areas.
19. Prior to the commencement of any work by Tenant's contractor, Tenant's contractor shall procure and
maintain for the duration of the Tenant's alterations a Workmen's Compensation Insurance (if required by
State law) and Comprehensive General Liability policies to the extent required by law or not less than
$2,000,000 per occurrence combined single limit, personal injury (including bodily injury) and property
damage. Tenant or Tenant's contractor shall deliver certificates thereof to Owner naming Heritage Crossin-g
Dallas, Tx. L.P. as additional insured. If Tenant or Tenant's Contractor shall fail to deliver such certificates,
Owner reserves the right to revoke this conditional approval and/or obtain such insurance and charge the cost
thereof to Tenant.
20. Tenant agrees that any reference in the architectural plans to the word "Owner" or "Landlord" is a reference
to the Tenant, and not a reference to Heritage Crossing Dallas, Tx. L.P.

Utilizing the success of its predecessor, the Anchor Diamond, Anchor Diamond Pro® takes retaining wall construction to a higher level. With the patented
rear lip design and a larger facial profile, construction, alignment and setback are facilitated. Anchor Diamond Pro" stones are available in straight,
beveled or striated face styles with a wide variety of colors and blends.
COMPOSITION AND MANUFACTURE
Anchor Diamond Pro® is made from a "no slump' concrete mix. Made under extreme
pressure and high frequency vibrations.
I.Laryout
Stake out the wall's placement according to lines and grades on approved plans. Excavate for
the leveling pad to the lines and grades shown. Excavate soil to a dimension behind the wall for
placement of grid and reinforced soils. The trench for the leveling pad should be a minimum six
(6) inches in front and back of the placed wall stone.
2. Leveling Pad
The leveling pad consists of a crushed aggregate compactable base material. The pad must
extend a minimum six (6) inches in front and behind the first course of stone, and be a minimum
six (6) inches in depth. Compact the aggregate in maximum eight (8) inch lifts and check top
elevation for level.
3. Rose Course
Place a string line along the back of the stone to align the wall units. Begin laying stone at the
lowest elevation of the wall. Place wall stones Nat on the leveling pad with facings aligned
according to plans. If necessary, remove rear lip of the stone so that it will lie flat on the leveling
pad. Place the stones side-by-side, flush against each other, and in full contact with the leveling
pad. Level the stone front -to -back and side-to-side. Check the stones for proper horizontal
alignment.
4. Wall Construction
Clean any debris off the top of the stones. Place the second course of stones on the base course
maintaining running bond pattern (do not align vertical joints). Push or pull each stone forward
as for as possible to ensure stone -to -stone engagement and the correct setback. Fill all voids
between and within concrete wall stones with drainage aggregate. Backfill with drainage
aggregate directly behind the stone. Fill behind the aggregate with soil meeting design
parameters. Place and compact the backfill material before the next course is laid. Hand -
operated equipment should be used within four (4) feet of the wall. Avoid driving heavy
equipment within the some area.
.S. Drainage
Fill in the area behind the stones with drainage aggregate to a minimum horizontal dimension
of 12 inches. Place a perforated drain pipe at the base of the drainage aggregate and above
the wall's front Finished grade at the toe. Daylight or direct the drain to an area lower than the
lowest drain elevation in the wall. Additional drainage design may be required.
6. Compaction
Place the backfill soil behind the drainage aggregate and compact the backfill within four (4)
feet of the wall with a hand -operated compactor. Aggregate is to be level with or slightly Flow
the top of each course. Repeat at the front of the wall. Add soil and compact backfill soil as
necessary. Testing for proper compaction may be required.
7. -Grid Reinforcement Placement
Check approved wall construction plan for grid placement. Determine which courses will have
reinforcement grid placed into the backfill. Measure and cut the reinforcement grid to the
design length in the plans. The reinforcement grid has a design strength direction to be laid
perpendicular to the wall. Place the front edge of the material on the designated top course a
maximum of one and half (1'/2) inches From the face of the stone. Apply the next course of
stones to secure it in place. At the back of the wall, pull the reinforcement taut. Add drainage
aggregate behind the stones, then add the backfill soil and compact. Testing for proper density
and compaction may be necessary to meet project requirements. A minimum of six (6) inches
of backfill over the grid is required prior to operating most vehicles on top of the reinforcement.
8. Finish Grade and Surface Drainage
Protect your wall from water damage and erosion with a finished grade to provide positive
drainage away from the wall at the top and bottom of the wall structure, To minimize infiltration
of water into the top of the backfill area of the wall, place a minimum six (6) inches of soil with
low permeability (clay or similar materials).

On Tuesday evening, June 17, 2014 at 7:30 P.M. in the City Council Chambers, 2nd Floor,
200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
CU14-22 — Classic Fleet Sales - by Speed Fab Crete for property located at 2501 William
D Tate Avenue and platted as Lot 1R2, Block 1R1, Classic Hummer Addition. The
applicant is requesting a conditional use permit to allow 143,866 square foot parking lot
expansion to facilitate inventory vehicles and a 20 foot pole sign. The property is zoned
"CC" Community Commercial and is owned by 2501 Partners Ltd.
CU14-23 - Ohlook Performing Arts Center - submitted by Beth van Amerongen for
property located at 1629 West Northwest Highway and platted as Lot 1, Block 1, Northwest
Plaza Addition. The applicant is requesting a conditional use permit to increase the
existing space from 2,256 square feet to 3,702 square feet. The property is zoned "SP"
Site Plan and is owned by Interproperty Northwest LLC.
CU14-24 — So Cal Tacos - submitted by So -Cal Tacos #1 LLC for property located at 2140
Hall Johnson Road #118 and platted as Lot 2, Block 1, Heritage Plaza Addition. The
applicant is requesting a conditional use permit to allow outside dining and outside
speakers in conjunction with a restaurant. The property is zoned "CC" Community
Commercial District and is owned by Heritage Crossing TX LP.
CU14-25, - Water Oaks Event Center - submitted by WOC Events for property located at
2040 Enchanted Way and proposed to be platted as Lot 1, Block 1, Water Oaks Event
Center. The applicant is requesting a conditional use permit to allow the possession,
storage, retail sales and on -premise consumption of alcoholic beverages (beer, wine and
mixed beverages) and outside speakers in conjunction with a wedding and events center.
The property is zoned "CC" Community Commercial District and owned by James Martino.
AM14-04 - AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73 - The
City Council and the Commission will consider amendments and changes to the
Comprehensive Zoning Ordinance, No. 82-73, same being Appendix D of the Code of
Ordinances as follows: Section 42, Supplementary District Regulations relative to a
Brewer's Permit (B permit), and to all appropriate zoning districts relative to accessory
structures and buffer yards and any other additions, deletions, or changes to various
sections, articles and provisions contained in said Ordinance No. 82-73.
