AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
� - OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A
PORTION OF A PUBLIC EASEMENT AS DESCRIBED IN
EXHIBIT "A" LOCATED ACROSS GRAPEVINE LAKE
ESTATES, SECTION 1, SUBJECT TO RETENTION AND
DEDICATION AS A PEDESTRIAN, UTILITY AND
DRAINAGE EASEMENT; PROVIDING A PLAT OF
VACATION AND RETENTION AS DESCRIBED IN EXHIBIT
"B" ; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, several owners of lots located in Grapevine Lake
Estates, Section 1, have requested a portion of a public easement
located on Lot l, Block 2 , Grapevine Lake Estates, Section 1, be
vacated and abandoned and that a portion of this easement be
retained as a pedestrian, utility and drainage easement; and
WHEREAS, a portion of this public easement, as described in
Exhibit "A" , attached hereto and made a part hereof, cannot be
utilized for public use and must be corrected for future public
�,� use; and
WHEREAS, a portion of ihis public easemen� as described in
�� Exhibit "A" attached hereto and made apart here of must be retained
and continue to be dedicated to the public as a pedestrian, utility
and drainage easement for the welfare, use and benefit by the City
of Grapevine and the general public; and
WHEREAS, abandoning and vacating a portion of this public
easement and the retai-ning of a portion of this easement will
correct the access the City of Grapevine must have to provide
pedestrian, utility, drainage and other access to the property.
I3Uti�i, ^1riEREFURE, BE I'1' ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That all the matters stated in the preamble of
this ordinance are true and correct and are hereby incorporated
into the body of this ordinance as if copied in their entirety.
Section 2 . That a portion of the City of Grapevine's 50 ' wide
public easement located on Lot 1, Block 2 dedicated to the City by
plat filed in the Tarrant County Plat Records, as Grapevine Lake
Estates, Section 1, and as described in Exhibit "A" attached hereto
,�„ and made a part hereof, is hereby abandoned and vacated for public
use subject to the retention by, and continued and remaining
dedication to the City of Grapevine for the public use as a
� pedestrian, utility and drainage easement.

� Section 3 . That a plat of vacation and retention of easement
accurately displaying the portions of the above described public
easement vacated in part and retained in part is hereby attached
'�°°� hereto as Exhibit "B" and made a part hereof.
Section 4. That the terms and provisions of this ordinance
shall be deemed to be severable, and that if the validity of any
section, subsection, word, sentence, or phrase shall be held to be
invalid, it shall not affect the remaining part of this ordinance.
Section 5. The fact that the present ordinances and
regulations of the City of Grapevine, Texas, are inadequate to
properly safeguard the health, safety, morals, peace, and general
welfare of the public creates an emergency which requires that this
ordinance become effective from and after the date of its passage.
PASSED and APPROVED by the City Council of the City of
Grapevine, Texas on this the 16th day of April ,
1991.
