HomeMy WebLinkAboutItem 24 - Z12-09 Vineyard Creek Estates046/ ITEM # o� PZ l TO: HONORABLE MAYOR, CITY COUNCIL MEMBERS AND THE PLANNING AND ZONING COMMISSION FROM: BRUNO RUMBELOW, CITY MANAGER SCOTT WILLIAMS, DIRECTOR OF DEVELOPMENT SERVICES MEETING DATE: NOVEMBER 20, 2012 SUBJECT: DEVELOPMENT SERVICES TECHNICAL REPORT OF ZONE CHANGE APPLICATION Z12 -09 VINEYARD CREEK ESTATES APPLICANT: Brad Meyer of Contrast Development PROPERTY LOCATION AND SIZE: The subject property is located at 2011 Hall- Johnson Road, and is proposed to be platted as Lots 1 -21, Block 1; Lots 1 -28, Block 2, and Tracts 1 and 2, Vineyard Creek Estates; and also proposed to be platted as Lots 1 -3, Block 1, Crestwood Hollow, Phase 2. The addition contains 18.864 acres and has approximately 235 feet of frontage along Hall - Johnson Road, 479 feet of frontage along Crestwood Court, 500 feet of frontage along Hughes Road and 55 feet of frontage along the northbound William D. Tate service road. REQUESTED ZONE CHANGE AND COMMENTS: The applicant is requesting a zone change to rezone 18.864 acres from "PCD" Planned _Commerce Development to "R -5.0" Zero Lot Line District for the development of 52 single family lots. At the October 16, 2012 meeting the applicant proposed the development of 53 single family lots on the subject property with an average lot size of 12,038 square feet and density of 2.81 dwelling units per acre. During the public hearing a number of comments were made by residents of the Crestwood Hollow subdivision relative to the four proposed lots that would have frontage along Crestwood Court. Most of their concerns centered on the appearance of the residential structures that would be constructed on these four lots and their desire to maintain the property values of their properties. The Planning and Zoning Commission approved the zoning request with the exception of the four proposed 0:1MU212 -09.42 1 November 13, 2012 (5:03PM) lots along Crestwood Court. The request was tabled for these four lots to give the applicant time to work out an amicable agreement with the Crestwood Hollow residents on how these lots should be developed. In conjunction with the Crestwood Hollow homeowner's association the applicant has submitted a set of deed restrictions governing the development of the lots in question. In particular the number of lots has been reduced from four to three. A minimum square footage of a dwelling unit, excluding the garage has been established at 2,480 square feet. There is also a provision for the annexation of these lots into the Crestwood Hollow Homeowner's Association. See the attached deed restrictions. PRESENT ZONING AND USE: The property is currently zoned "PCD" Planned Commerce Development District and is undeveloped. HISTORY OF TRACT AND SURROUNDING AREA: The subject and surrounding property were rezoned from uR -1" Single Family District to "PCD" Planned Commerce Development District during the 1984 Citywide rezoning. At the June 15, 2004 meeting Council approved zone change request Z04 -04 (Ord. 2004 -39) on the property to the east from "PCD" Planned Commerce Development District to "R -5.0" Zero Lot Line District for single family development. At the September 21, 2004 meeting Council approved zone change request Z04 -10 (Ord. 2004 -60) on the property to the west from "PCD" Planned Commerce Development District to "CC" Community Commercial District developed as a day spa /salon. At the June 21, 2005 meeting Council approved zone change request Z05 -04 (Ord. 2005 -45) on the property to the west from "PCD" Planned Commerce Development District to "CC" Community Commercial District for the development of an office. A special use permit (SU10 -08) was approved by Council at the October 19, 2010 meeting on property to the north for the development of a church. A Texas limited liability company and/or Assigns residing in Irving, Texas, "Owner". WHEREAS, Owner is the owner of certain real property located in Tarrant County, Texas, more particularly described in Exhibit 'A' attached hereto and incorporated herein for all purposes, also known as Crestwood Hollow Phase 2, Grapevine, Texas (the "Property "); WHEREAS, the Owner has agreed to impose certain restrictions upon the Property which restrictions will be enforceable by the Owner and the City against any owner or subsequent purchaser of the Property; NOW THEREFORE, the Owner declares that the Property is and shall be held, transferred, sold, conveyed, and occupied subject to the covenants hereinafter set forth. 1. Limitations and Restrictions — The Property shall be developed in accordance with and in compliance with the following: A. R -5.0 Zero -Lot -Line District Regulations of the City shall apply. B. The Property shall be limited to a maximum of three (3) lots. C. Minimum Floor Area: The minimum square footage of a dwelling unit shall not be less than two thousand, four hundred and eighty (2,480) square feet of floor area, excluding garages. D. The minimum roof pitch of any structure shall be eight (8) feet by twelve (12) feet. E. All roofs shall be constructed with composition shingles having a manufacturer's warranty of at least thirty (30) years. F. At least eighty percent (80 %) of the exterior walls and (100 %) of the front elevation walls (other than windows and doors) of the dwelling unit shall be clad in brick, brick veneer, stone, stone veneer, stucco, stucco veneer or Hardi -Plank type siding,provided that no Hardi -Plank type siding will be allowed on the front elevation walls. At least sixty percent (60 %) of the exterior walls (other than windows and doors) of the dwelling unit shall be clad in brick, brick veneer, stone, stone veneer, stucco or stucco veneer. G. All garage doors shall contain decorative wood clad treatment. DECLARATION OF RESTRICTIVE COVENANTS H. Front entry garages shall not be allowed except for a single garage for each dwelling unit that is set back at least twenty (20) feet back from the front building line. I. The front elevation of each dwelling unit clad in brick shall contain a brick soldier course under the front roofline. J. Each dwelling unit shall contain a minimum of two elevation offsets along the front of the dwelling. K. Each dwelling unit shall have a cast stone address plaque. L. Front driveways must be surfaced with exposed aggregate material. M. Each mailbox shall be constructed in the same style and material as the Crestwood Hollow dwelling units. N. Dwelling units shall be eligible for annexation into the Crestwood Hollow Home Owners Association. This provision is subject to execution of an agreement between Contrast Development and the Crestwood Hollow HOA regarding the terms of annexation. If an agreement is not reached prior to certificate of occupancy for any home within Crestwood Hollow Phase 2 this provision shall be null and void. O. The owner of Lot 3, Block 1 shall preserve all trees which have a caliper of three (3) inches DBH (diameter breast high) and greater which are within twenty (20) feet of the southern property line unless: (a) the tree is dead or diseased as determined by an arborist or (b) the property owner receives approval of the Crestwood Hollow Homeowner's Association to remove the tree. 2. Binding Effect and Duration -- These covenants shall remain in force and effect for a period of twenty -five (25) years from the date of execution of this instrument and shall be extended for continuous period of five (5) years unless terminated by written agreement of the City and all of the then current owners of the Property. 3. Amendments — This Declaration may be amended only pursuant to a written amendment executed by City and all of the then current owners of the Property and recorded in the Deed Records of Tarrant County, Texas. 4. Enforcement — The City shall have the right (but not the duty) to enforce the provisions of this Declaration. Enforcement shall be by any proceeding at law or in equity against any person or persons violating or attempting to violate any part of this Declaration, either to restrain violation or to recover damages. Failure by the City to DECLARATION OF RESTRICTIVE COVENANTS 2 enforce any provision of this Declaration shall in no event be deemed a waiver of the right to do so thereafter. With respect to any litigation hereunder, the prevailing party shall be entitled to recover court costs and reasonable attorneys' fees from the non - prevailing party. 5. Severability -- Invalidation of any one or more of the covenants, conditions and restrictions contained herein, or any portion thereof, by a judgment or court order shall not affect any of the other provisions herein contained, which shall remain in full force and effect. In the event any provision of the instrument requires an act that would violate any law, ordinance or regulation promulgated by a governmental body having jurisdiction, then the actions so required herein shall be excused and such law, ordinance or regulation shall control. 6. Interpretation — The section headings appearing in this instrument are for convenience of reference only and are not intended, to any extent and for any purpose, to limit or define the text of any section hereof. 7,, Exercise of Police Power - Nothing herein, in any manner, shall preclude the City from exercising its police power, including the zoning and rezoning of the Property. and WHEREAS, the City Council of the City of Grapevine, Texas at a public hearing called by the City Council did consider the following factors in making a determination as to whether these requested changes, should be granted or denied; safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the site; safety from fire hazards and measures for fire control, protection of adjacent property from flood or water damages, noise producing elements and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood, location, lighting and types of signs and relation of signs to traffic control and adjacent property, street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood, adequacy of parking as determined by requirements of this ordinance for off - street parking facilities, location of ingress and egress points for parking and off - street locating spaces, and protection of public health by surfacing on all parking areas to control dust, effect on the promotion of health and the general welfare, effect on light and air, the effect on the transportation, water sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas at a public hearing called by the City Council of the City of Grapevine, Texas did consider the following factors in making a determination as to whether this requested change should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, the effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, the City Council further considered among other things the character of the district and its peculiar suitability for particular uses and with the view to conserve the value of buildings, encourage the most appropriate use of land throughout this city; and WHEREAS, the City Council of the City of Grapevine, Texas does find that there is a public necessity for the zoning change, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and does find that the change in zoning lessens the congestion in the streets, helps secure safety from fire, panic and other dangers; promotes health and the general welfare; provides adequate light and air; prevents the overcrowding of land; avoids undue concentration of population; facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas has determined that there is a necessity and need for this change in zoning and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified; and, therefore, feels that a change in zoning classification forthe particular piece of property is needed, is called for, and is in the best interest of the public at large, the citizens of the City of Grapevine, Texas and helps promote the general health, safety, and welfare of this community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City of Grapevine Ordinance No. 82 -73, being the Comprehensive Zoning Ordinance of the City of Grapevine, Texas same being also known as Appendix "D" of the City Code of Grapevine, Texas, be, and the same is hereby ORD. NO. 2 amended and changed by Zoning Application Z12 -09 to rezone the following described property to -wit: being an 18.864 acre tract of land out of the William Driskill Survey, Abstract No. 405 (2011 Hall - Johnson Road) more fully and completely described in Exhibit "A ", attached hereto and made a part hereof which was previously zoned "PCD" Planned Commerce Development District is hereby changed to "R -5.0" Zero Lot Line District Regulations, all in accordance with Comprehensive Zoning Ordinance No. 82 -73, as amended. Provided, however, that the property described in Exhibit "B" shall be governed by the deed restrictions in Exhibit "C ", attached hereto and made a part hereof. Section 2. That the City Manager is hereby directed to correct the official zoning map of the City of Grapevine, Texas to reflect the herein change in zoning. Section 3. That in all other respects, the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinances and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future, to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions forthe normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed two thousand dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. ORD. NO. 3 Section 8. That this ordinance shall become effective from and after the date of its final passage.
