This request was tabled at the May 15th meeting pending the resolution of this building code issue. Council amended Section 67, Amendments, to require a one year waiting period for requests (zone change, conditional and special uses) that have been withdrawn by the applicant prior to and/or after the public hearing. That decision was based on the concern that applicants were abusing the option to "withdraw" a request as a means of gauging public sentiment, the Planning and Zoning Commission's and the City Council's opinions of their request. By withdrawing, the applicant avoided the one-year waiting period for denied requests.
