All work completed to date has been executed with out incident or concern by the City, the Corps, or the consulting environmental engineers. In light of our sincere efforts to cooperate with the City of Grapevine in executing this successful project, we deeply regret the confusion regarding the installation of a landscaping plan that was not approved by City Council. During the approval process we submitted plans and held meetings with the Planning Department to discuss and resolve difficulties inherent in our plans, which specified certain tree sizes and species that were unavailable. We were therefore required to submit additional designs reflecting available trees with the intent to meet the quantities reflected in the approved plan. Unfortunately, this effort resulted in miscommunication and we built to a plan that was not approved by City Council. We realized the extent of this miscommunication when we met with the Planning Department to discuss additional issues regarding two species of quarantined or unobtainable trees. Since then we have been in communication with the City and our consultants to try to find an acceptable solution to the City. We reviewed numerous available options including supplementing the existing landscaping with an acceptable number of additional trees to more than meet the total caliper requirement in the original plan. This solution would yield more trees than originally required by City Council, resulting in a greater long- term benefit to the City of Grapevine. To obtain occupancy prior to resolving the requirements of our landscaping, we are providing the city with the following assurance of our continued cooperation. If required by the City, Evergreen Alliance Golf agrees to provide the City of Grapevine with a guarantee that the previously approved plan will be installed (provided material is available) and the non-compliant landscaping will be removed. Evergreen Alliance Golf is hopeful that we can resolve this issue as quickly as possible for the City as well as the Cowboys Golf Club.
