AN ORDINANCE OF THE CITY OF GRAPEVINE,
TEXAS, AMENDING ORDINANCE NO. 82-73, THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY
OF GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN
AS APPENDIX "D" OF THE CODE OF ORDINANCES OF
THE CITY OF GRAPEVINE, TEXAS, BY PROVIDING
��, FOR AMENDMENTS AND CHANGES TO ZONING
REGULATIONS BY AMENDING SECTION 23 "LB"
LIMITED BUSINESS DISTRICT; BY AMENDING
SECTION 24 "CN" NEIGHBORHOOD COMMERCIAL
�� DISTRICT REGULATIONS; BY AMENDING SECTION 25
"CC" COMMUNITY COMMERCIAL DISTRICT
REGULATIONS; BY AMENDING SECTION 26 "HC"
HIGHWAY COMMERCIAL DISTRICT REGULATIONS; BY
AMENDING SECTION 27 "PO" PROFESSIONAL OFFICE
DISTRICT REGULATIONS; BY AMENDING SECTION 47
SITE PLAN REVIEW; AND BY AMENDING SECTION 60
SIGN STANDARDS; PROVIDING A PENALTY OF FINE
NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS
($2 ,000 .00) FOR EACH OFFENSE AND A SEPARATE
OFFENSE SHALL BE DEEMED COMMITTED EACH DAY
DURING OR ON WHICH AN OFFENSE OCCURS OR
CONTINUES; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,
TEXAS:
� Section 1 . That Ordinance No. 82-73, the Comprehensive
Zoning Ordinance of the City of Grapevine, Texas, same being also
known as Appendix "D" of the Code of Ordinances of the City of
� � Grapevine, Texas, is hereby amended in the following particulars,
and all other sections, subsections, paragraphs, definitions,
words and phrases of said Appendix "D" are not amended but are
hereby ratified, verified, and affirmed:
A. That Section 23 relative to "LB" Limited Business District
is hereby amended by amending Section 23 .K. to read as
follows:
"K. Off-Street Parking: Off-street parking shall be
provided in accordance with the provisions of
Sections 56 and 58 and shall be landscaped in
accordance with Section 53 of this ordinance. "
B. That Section 24 relative to "CN" Neighborhood Commercial
District Regulations is hereby amended by amending
Section 24.K. to read as follows:
"K. Off-street Parking: Off-street parking shall be
provided in accordance with the provisions of
'� " Sections 56 and 58 and shall be landscaped in
accordance with Section 53 of this ordinance. "
v�.-� C. That Section 25 relative to "CC" Community Commercial
District Regulations is hereby amended by amending
Section 25.K. to read as follows:
"K. Off-street Parking: Off-street parking shall be
provided in accordance with the provisions of
Sections 56 and 58 and shall be landscaped in
accordance with Section 53 of this ordinance. "
D. That Section 26 relative to "HC" Highway Commercial District
Regulations is hereby amended by amending Section 26 .A. 7 . and
by the addition of Section 26.A. 21 . to read as follows:
"7 . Automotive sales, and service, new or used cars
and trucks. All vehicles must be in an operating
condition and all open display or storage areas
must be surfaced and developed in accordance with
all applicable ordinances of the City. "

E. That Section 26 relative to "HC" Highway Commercial District
�-� Regulations is hereby amended by amending Section 26.K. to
read as follows:
"K. Off-street Parking: Off-street parking shall be
`�° provided in accordance with the provisions of
Sections 56 and 58 and shall be landscaped in
accordance with Section 53 of this ordinance. "
F. That Section 27 relative to "PO" Professional Office District
' Regulations is hereby amended by amending Section 27 .K. to
read as follows:
"K. Off-street Parking: Off-street parking shall be
provided in accordance with the provisions of
Sections 56 and 58 and shall be landscaped in
accordance with Section 53 of this ordinance. "
G. That Section 47 relative to Site Plan Review is hereby
amended by amending Section 47 .E. 1 . to read in accordance
with the attached Exhibit "A" which is incorporated herein
for all purposes and made a part hereof.
H. That Section 60 relative to Sign Standards is hereby amended
by amending Section 60.B. 2 . (c) 12 to read as follows:
' "12 . Pole sign conditional uses: The following
conditional uses may be permitted provided they
meet the provisions of Section 48 and a
� � conditional use permit is issued: A sign face
with changeable copy exceeding thirty (30) percent
of the gross surface area of the sign face.
Planned commercial centers located adjacent to
Highway 121 , Highway 360 and Highway 114 (excluding
Business 114) may have a pole sign, a minimum of
twenty (20) feet in height up to forty (40) feet in
height. For pole signs exceeding twenty (20) feet
in height, the sign cabinet dimensional
requirements shall be a maximum of thirty-six (36)
inches in depth and a maximum gross surface area
of two hundred eighty-eight (288) square feet
(S.F. ) . There shall be no minimum or maximum
cabinet width or height regulations for signs
approved with a conditional use exceeding twenty
(20) feet in height. "
Section 2. Any person violating any of the provisions of
this ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined in a sum not to exceed Two
�"� Thousand Dollars ($2 ,000 .00) for each offense and a separate
offense shall be deemed committed each day during or on which an
offense occurs or continues.

Section 3. If any section, article, paragraph, sentence,
clause, phrase or word in this ordinance, or application thereto
any person or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not
affect the validity of the remaining portions of this ordinance;
and the City Council hereby declares it would have passed such
remaining portions of the ordinance despite such invalidity,
which remaining portions shall remain in full force and effect.
Section 4 . The fact that the present ordinances and
regulations of the City of Grapevine, Texas, are inadequate to
properly safeguard the health, safety, morals, peace, and general
welfare of the public creates an emergency which requires that
this ordinance become effective from and after the date of its
passage, and it is accordingly so ordained.

3. Any permitted, accessory, or conditional use in the follc�ring
industrial districts: LI.

Overlay Districts.
��, 5. All permitted, accessory, and conditional uses in the
Governmental Use (GU) District. _
6. All development in the PRD-6, PRD-12, PC�, and PID districts
except single family detached dwellings and their related
accessory uses and structures. Any site plan issued in
connection with a planned develoFanent district must be in
conformance with the approved Master Development Plan for that
district.
D. �T DEVEL�OPMENT. The follaaing activities and uses shall not
� require c�liance with this section unless otherwise required by .
this Ordinance.
1. Construction of a single family detached dwelling on an
existing or platted single family lot.
2. Construction of any permitted accessory use to a single family
dwelling on an existing or planned single family lot.
3. Deposit and contauring of fill on land provided other �
,� .,
regulations of the City of Grapevine are met.
4. Additions to any buildings or use, legally existing at the
�,�, date of this Ordinance, when such addition does not exceed two
hundred (200) square feet or one-third (1/3) of the gross
floor area of the existing building or use, whichever is
greater.
5. Any perntitted use of a ten�ozazy nature for a peric�d not to
exceed one (1) year.
E. COI�ITENTS OF SITE PT.ADT APPLICATION.
1. Whenever a Site Plan is reqi.tired under subsection C, the
application for site plan approval shall include the follawing
i.nformation and material:
(a) Site Plan Applicatian
� (1) The applicant's n�ne and address and his legal
interest in the subject property.
(2) The awner's name and address, if different
fram the applicant, with the owner's signed
�„ consent to the fil�ng of the application. t

proposed use substantially confornis to the Master

I� (b) Site Plan Requirements
(1) All site plans submitted in conjunction with a
� Conditional Use, Section 48 or a Special Use,
Section 49 shall be drawn by a Registered Surveyor,
Registered Architect, or Registered E�gineer. ""'�'
(2) The site plan shall include the name of the .,,�
site plan, submittal date, case rnmlber(s) , scale,
north point, name of awners, and name of person
preparing the site plan, consecutive sheet niunbers
and a vicinity map
(3) Location of existing boundarv lines and
dimensions of the tract.
(4) Any proposed grading or regrading of the
subject property; any significant natural,
topographical or physical features of the property,
including, at least, existing soil conditions, water
courses, marshes, trees in excess of four (4) inches
in diameter, rock outcroppings and existing contours
in ex�ess of two (2) feet in one hundred (100) feet.

(5) I.ncate center line of existing water courses,
drainage features and floodway and drainaqe
eas�nents.

slope and gradient of vehicular ele�nts; and total
lot coverage of all circulation elements, divided
between vehicular and pedestrian ways.
(9) Location and size of existinq and proposed
streets and alleys with location of all street
medians and intersections adjacent to the area of
request. _
�,„,,„, (10) Copy of Pe�nit to Construct Access Driveway
Facilities on Highway Right of Way issued by the
Texas State Department of Highways and Public
.Transportation.
(11) The location and size of existing and proposed
water and sewer public utilities on and adjacent to
the'site and fire hydrant locations.
(12) All existing and proposed surface and
subsurface drainage f.acilities, including culverts,
drains and detention ponds, showing size and
dimensions of flow.
(13) Location, size and arrangement of all out.door
signs and the location and intensity of all outdoor
� lightinq and exterior auditory speakers.
(14) Location and height of fences or screen
plantings and the type or kind of building materials
or plantings to be used f.or fencing or screening.
(15) Final elevations of proposed structures with
the type or kind of building materials used.

and ordinances of the City.
(21) Parking for disabled persons should be
designated according to Chapter 23 Section 23-64
through 23-69 of the Code of Ordinances.

Section 50.B.3.

2. Whenever a Conditional Use Pezmit is r red ��

submitted, subject to the provisions of Subsection F.
(a) Al1 fina]_ environmental assessments and environmental
�mpact state.ments for thc proposed building, structure,
use, developn�nt or activity if either or both are
required pursuant to state or federal law, including but
n,ot limited to the National Environmental Policy Act (as
amended) .
(b) Copies of all studies or analyses upon which have been
� based projections relied upon by the applicant of the
need or d�nand for the proposed building, structure, use,
development or activity, together with copies of all
studies or analyses upon which the applicant has relied
in selecting a location for the proposed building,
structure, use, development or activity over alternatives
thereto;
(c) A description of the present use, assessed value and
' actual land value of land which will be used or adversely "��'
� i�acted by the proposed building, structure, use,
developcnent or activity and by each alternative thereto
