ORDINANCE NO. 90-63

� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS, ABANDONING AND VACATING
UTILITY AND DRAINAGE EASEMENTS IN WINDING
CREEK ESTATES, SECTION II IN THE CITY OF
GRAPEVINE, TEXAS, AS HEREINAFTER DESCRIBED;
PROVIDING A SEVERABILITY CLAUSE; DECLARING
AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE
WHEREAS, numerous drainage and utility easements located in
Winding Creek Estates, Section II in the City of Grapevine,
Texas, as described in Exhibits "A" through "F" attached hereto
and incorporated herein for all purposes, is not needed for
public use and will not be needed in the future for public use;
and
WHEREAS, abandoning and vacating these drainage and utility
easements will relieve the City of Grapevine, Texas from the cost
and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE

Section l . That all the matters stated in the preamble of
this ordinance are true and correct and are hereby incorporated
into the body of this ordinance as if copied in their entirety.
Section 2 . That drainage and utility easements dedicated to
the public by plat of Winding Creek Estates, Section II, recorded
in Volume 388-203, Pages 35 and 36 and in Cabinet A, Slide 238 of
the Tarrant County Plat Records, as shown in Exhibits "A" through
"F" , attached hereto and made a part hereof, is hereby abandoned
and vacated for public use and the same are hereby abandoned and
vacated insofar as all public right, title, and interest in and
to said public drainage and utility easements are concerned.
Section 3 . That the terms and provisions of this ordinance
shall be deemed to be severable, and that if the validity of any
section, subsection, word, sentence, or phrase shall be held to
be invalid, it shall not affect the remaining part of this
ordinance.
Section 4 . The fact that the present ordinances and regula-
tions of the City of Grapevine, Texas, are inadequate to properly
� safeguard the health, safety, morals, peace, and general welfare
� of the public creates an emergency which requires that this
{ ordinance become effective from and after the date of its

We, DAVID W. THARP and SUSAN L. THARP , as owners of Lot 6 ,
Block 5 , WINDING CREEK ESTATES SECTION II ,
an Addition to the City of Grapevine, Texas, recorded in Volume
388-203 , Pages 35 and 36 , Plat Records, Tarrant County, Texas,
do hereby request the vacation and abandonment of utility easement
particularly described in attached Exhibit "A" .
We, DAVID W. THARP and SUSAN L. THARP , will hold the City of
Grapevine, Texas, harmless, and indemnify it against all suits,
costs, expenses and damages that may arise or grow out of such
vacation and abandonment.
