AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS
ADJUSTING AND ESTABLISHING THE BOUNDARY LINE
BETWEEN THE CITY OF GRAPEVINE AND �'HE CITY OF
LEWISVILLE, TEXAS; PROVIDING FOR THE
DISANNEXATION OF, AND�OR THE RELEASE OF
p , EXTRATERRITORIAL JURISDICTION OVER, THE
TERRITORY DESCRIBED HEREIN; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE �„���� �

WHEREAS, the City of Grapevine, Texas (the "City" ) is a
home rule city pursuant to article 11, Section 5 of the Texas
Constitution, Chapter 9 of the Tex. Loc . Gov. Code Ann.
(Vernon) , as amended (the "Code" ) , and its Home Rule Charter;
and
WHEREAS, the City has, pursuant to Section 2 . 02 of its
Home Rule Charter, all powers provided to it by the Texas
Constitutidn anci �y any anoi ail legisiation adopted by the
Texas Legisl,ature; and
WHEREAS, the City is empowered pursuant to section 43 .021
of the Code to fix the boundaries of the City and exchange area
with other municipalities, empowered by Section 43 . 031 of the
Code to make mutually agreeable changes in its boundary with
other municipalities that are less than 1, 000 feet in width,
� and empowered by Section 42 . 023 of the Code to reduce the
City' s extraterritorial jurisdiction by the adoption of an
ordinance on resolution; and
,,,� WHEREAS, the corporate limits of the City abut the
corporate limits of the City of Lewisville, Texas ( "LewisvillE�" )
in tne extrem� northeast corner o� �he City; anci
�
WHEREAS, the City and Lewisville have each heretofore
annexed by ordinance the territory described in Exhibit "A"
attached hereto and incorporated herein, which territory is
outlined in yellow on Exhibit "D" attached hereto and
incorporated herein; and
WHEREAS, the City Council hereby finds and determines
that such territory is not suitable or necessary for City
purposes; and
WHEREAS, the Gity and Lewisville have heretofore enteres3 ,
into a Boundary Adjustment Agreement, a true and correct copy
of which is attached hereto as Exhibit _ __"B" and incorporated

herein, wherein the City agrees to disannex and/or relinquish
and release any extraterritorial jurisdiction it has or may
have in any land north of that line described in Exhibit "C"
and as shown in red on Exhibit "D" (the "Boundary Line�;^ �which .
Exhibits are attached hereto and incorporated herein, with the
western limit of such line being described in Exhibit "C" and
outlined on Exhibit "D" , and Lewisville agrees to disannex
,�,,, and/or release or relinquish any extraterritorial jurisdiction
it has or may have in any land south of the Boundary Line; and
WHEREAS, the City Council finds that the adoption of this
�""""" Ordinance is in the best interests of the citizens of the City
of Grapevine. .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1. That all of the above premises are found to
be true and correct and are incorporated into the body of this
ordinance as if copied in their entirety.

Section 2 . That the City of Grapevine disannexes,
and/or in the alternative relinquishes and releases from the
City any extraterritorial jurisdiction it has or may have in,
the land described in the attached Exhibit "A" and any other
land which lies north of the line described in Exhibit "C" and
depicted in red on Exhibit "D" (the "Boundary Line" ) , with the
western limit of-the area disannexed, released and relinquished
being the west line of the B.B.B. & C.R.R. Survey, Abstract
A-145 (Denton County Records) , Abstract A-1772 (Dallas County
,�. , Records) as described in Exhibit "C" and shown on Exhibit "D" ,
and grants to Lewisville all of its rights and interest in and .
to the said land.
� `� Section 3 . That the City does hereby accept and adopt
the Boundary Line as the boundary between the City and the City
of Lewisville.
Section 4 . This Ordinance is contingent and shall not
be deemed effective until such time as Lewisville adopts an
ordinance and takes any other action necessary to disannex
and/or relinguish any extraterritorial jurisdiction it has or
may have in land south of the Boundary Line. Provided,
however, tnaL upon the adoption by Lewisviile oi any such
Ordinance on the taking of any such other necessary action,
this Ordinance shall have an effective date of December 31,
1989 . At the time that both Grapevine and Lewisville have
taken the steps necessary to fulfill and complete the terms of
the Boundary Adjustment Agreement, Grapevine shall have no
right, jurisdiction or control over any territory north of the
Boundary Line.
Section 5 . If any section, article, paragraph,
sentence, clause, phrase or word in this ordinance, or
application thereto any person or circumstances is held invalid
�, or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions
of -�his orciinance; and the Ci-�.y Counc�l here�y dec�ares it
�' would have passed such remaining portions of the ordinance
despite such invalidity, which remaining portions shall remain
in full force and effect.
Section 6 . The fact that the present ordinance and
regulations of the City of Grapevine, Texas, are inadequate to
properly safeguard the health, safety, morals, peace and
general welfare of the inhabitants of the City of Grapevine,
Texas, creates an emergency for the immediate preservation of
the public business, property, health, safety and general
welfare of the public which requires that this Ordinance shall
become effective from and after the date of its passage in
accordance with the other sections of this Ordinance, and it is
accordingly so ordained.

WHEREAS, the City of Grapevine, Texas ( "Grapevine") and "�

the City of Lewisville, Texas ( "Lewisville" ) (together, the �

"Cities" ) are home rule municipalities pursuant to article 11, �—

Rule Charters; and
WHEREAS, pursuant to Section 43 . 021 of the Code,
Grapevine and Lewisville are authorized and empowered to fix
their boundaries and exchange area with other municipalities,
and pursuant to section 43 . 031 may make mutually agreeable
changes in their boundaries that are less than 1, 000 feet in
width; and
WHEREAS, the Cities are further empowered pursuant to
Section 42 . 023 of the Code to reduce their extraterritorial
jurisdiction by ordinance or resolution; and
WHEREAS, Grapevine has heretofore annexed certain
territory which generally lies north of the line described in
Exhibit "A" attached hereto (the "Boundary Line" ) and south of
the north line of Dallas County, is described more accurately
in Exhibit "B" attached hereto, and is depicted and colored in
yellow on Exhibit "C" attached hereto, and Lewisville has
heretofore annexed the same territory; and
WHEREAS, having annexed the same territory, the Cities
now desire to reach a satisfactory agreement regarding the
loca��n of their mutual boundary, and for that purpose enter

WHEREAS, this Aqreement is in the best interests of the
citizens of the City of Grapevine and the City of Lewisville.
W I T N E S S E T H:
NOW, THEREFORE, for and in consideration of the mutual
promises and covenants herein made and the benefits to each
party resulting herefrom, the City of Grapevine, Texas and the
City of Lewisville, Texas do hereby contract, covenant and
agree as follows :
l . The Boundary Line as described in Exhibit "A" and as
outlined in red on Exhibit "C" , which Exhibits are attached
hereto and incorporated herein, is hereby found to be the
boundary between the Cities, and in accordance therewith the
Cities agree as follows :
A. Grapevine releases, relinquishes, discontinues and

disannexes in favor of Lewisville any and all territory which
Grapevine controls or may control, whether by annexation or by
its extraterritorial jurisdiction, north of the Boundary Line.
Grapevine shall, in order to establish the Boundary Line, enact
any resolution or ordinance and take any other action requi�ed
by law.
B. Lewisville releases, relinquishes, discontinues and
disannexes in favor of Grapevine any and all territory which
Lewisville controls or may control, whether by annexation or by
its extraterritorial jurisdiction, south of the Boundary Line.
Lewisville shall, in order to establish the Boundary Line,
adopt any resolution or ordinance and take any other action
required by law.

2 . Grapevine and Lewisville agree that the adoption of °

shall be contingent, and shall neither be deemed effective nor �.��
enforceable by one City against the other, unless and until �

such time as each City has adopted such a resolution or
ordinance or taken such other necessary acts . Provided,
however, that upon adoption of any such ordinance or
resolutionor the taking of any necessary act by both of the
Cities, the Cities agree that the effective date of this
Agreement shall be December 31, 1989 .
3 . The persons signing this Agreement on behalf of the
Cities have been duly authorized and empowered to do so .
