Home My WebLink AboutORD 1990-003 l � �----- � � ORDINANCE NO. 90-03 ' AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A PORTION OF SANITARY SEWER LINE EASEMENTS LOCATED ON LOTS 3, 4 , 7 AND 8 OF BLOCK 15 OF THE CITY OF GRAPEVINE ADDITION AND LOT 5, BLOCK 22 OF THE TOWN OF GRAPEVINE ADDITION IN THE CITY tr OF GRAPEVINE, TEXAS, AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE AND DECLARING AN � � EMERGENCY WHEREAS, the owners of tracts of land located in the City of Grapevine Addition and Town of Grapevine, in the City of Grapevine, Texas, has requested that portions of sanitary sewer line easements, as hereinafter described, be abandoned and vacated; and WHEREAS, the portions of said sanitary sewer line easements, as hereinafter described, are not needed for public use and will not be needed in the future for public use; and WHEREAS, abandoning and vacating these portions of said sanitary sewer line easements will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: �- Section 1 . That a portion of the City of Grapevine' s utility easement as recorded in Volume 7660 Page 177 of the Tarrant County Deed Records, designated as easement "A" on the map attached hereto �'""'" as Attachment 1 and made a part hereof and as more particularly described in Exhibit "A" , attached hereto and made a part hereof, (a portion of Lots 3 , 4 , 7 and 8 , Block 15 , City of Grapevine Addition) is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, and interest in and to said described portion of said utility easement is concerned. Section 2 . That a portion of the City of Grapevine' s utility easement as recorded in Volume 8061 , Page 376 of the Tarrant County Deed Records, designated as easement "B" on the map attached hereto as Attachment 1 and made a part hereof and as more particularly - described in Exhibit "B" , attached hereto and made a part hereof, (a portion of Lot 4 , Block 15 , City of Grapevine Addition) is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as alt public right, title, and interest in and to said described portion of said utility easement is concerned. Section 3 . That a portion of the City of Grapevine' s utility easement as recorded in Volume 8044 , Page 1882 of the Tarrant County „�� Deed Records, designated as easement "C" on the map attached hereto as Attachment 1 and made a part hereof and as more particularly described in Exhibit "C" , attached hereto and made a part hereof, (a �, portion of Lot 5 , Block 22 , Town of Grapevine) is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, and interest in and to said described portion of said utility easement is concerned. Section 4 . That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence, or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. - -: C� '� '? # '� `` 't � :. � t`.' �� '' ' v.� F Section 5 . The fact that the present ordinances and regula- tions of the City of Grapevine, Texas, are inadequate to properly� safeguard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage.
