SUBJECT: CONDITIONAL USE REQUEST CU01-03, KING ARTHUR'S CASTLE
Staff recommends the Site Plan Review Committee consider the proposed changes to
the previously approved site plan associated with CU99-38 King Arthur's Castle,
originally approved by Council at the September 21, 1999 joint public hearing and take
any action necessary.
Conditional Use Request CU99-38 (Ord. 99-142) was originally considered and
approved at the September 21, 1999 joint public hearing. At that meeting the applicant
requested to amend the previously approved site plan of CU94-14 (Ord. 94-49) for a
drive-through convenience store with off -premise alcohol beverage sales to allow for a
200 square foot retail expansion and the addition of gasoline sales. The applicant was
required to seek a new conditional use permit at that time because the previous one
had expired. Conditional Use Request CU99-38 was later granted a one year extension
by Council at the September 5, 2000 meeting.
With this request the applicant is seeking slight modifications to the exterior fagade, i.e.
reducing the number of windows on the north, south, and east elevations, eliminating a
door on the west elevation and creating a set of double doors at the doorway entrance
rather than a single doorway. The applicant also proposes modification to the floorplan
layout which includes a shifting of the sales counter to the west, the addition of a walk-in
cooler along the northeast wall of the store, and the addition of retail display.

Please find attached Mr. Feroz's revised Conditional Use Permit Application.
We have concluded it is necessary to resubmit this CUP once again, due to the fact that
Mr. Feroz made some floor plan and elevation changes since the CU99-38 was submitted
and approved.
The site plan, grading plan, landscape plan, etc. remain the same as that submitted with
CU99-38. A small 6 ft wood fence was added around the ground mounted AC equipment
on the south side.
The revised floor plan merely reflects layout changes that were made to the interiors
which were not known at the time of CU99-38. The elevations are very similar except
that there is now a double front entry door. Two windows were made smaller near the
front entry. Two windows were also eliminated.
We hope that these small changes can be approved with only a DRC review.
