PURPOSES UNDER, OVER AND ACROSS THE - - HEREINAFTER DESCRIBED PROPERTY, AND �._ AUTHORIZING ITS CONDEMNATION AND / OR ,`'.', , � APPROPRIATION TO BE USED IN CONNECTION WITH --� =- _ _„ � -= BEAR RUN DRIVE; AND PROVIDING AN EFFECTNE DATE NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY Gr vr"�1rE�iii�1C, I C%�F�J, Section 1. That it is hereby determined that a public need and necessity requires that the City of Grapevine, Texas (the "City") should acquire a right-of-way for public street purposes under, over and across the property described in the attached Exhibit "A" incorporated herein for all purposes. It is further determined that the property described in Exhibit "A" is necessary for the Project. - Section 2. That in order to acquire the right-of-way for public street purposes under, over and across the property described in Exhibit "A", the Director of Public Works, or such employee as he may designate, is hereby authorized and directed to offer the sum of Two Thousand Three Hundred Fifty Dollars ($2,350.00) for the property described in Exhibit "A" as payment for the right-of-way acquired plus full damages allowable by law, which amount represents the fair cash market value of said right-of- way and the property to be acquired. Section 3. That the City of Grapevine determines to appropriate the property described in Exhibit "A" for the purpose of street right-of-way, as authorized under the Constitution and laws of the State of Texas and the provisions of the Charter of the City of Grapevine. Section 4. That the owners or parties claiming an interest in the property described in Exhibit "A", and the legal description thereof, are as follows: Owners: Bear Run Home Owners Association Howard Watson, President Tenant: None Lienholder (s): None Legal Description: See attached Exhibit "A" -::: .... r;,r,: i�.y..:...:.. .�,.� Section 5. That, in the event the property owners accept the offer made as : .. �..= authorized herein, the Director of Finance is hereby authorized to pay the above-named � owners the amount of Two Thousand Three Hundred Fifty Dollars ($2,350.00). This sum represents compensation for right-of-way for public street purposes of 337 Square `--'' Feet of land, less oil, gas and sulphur, as value for the right-of-way. Any instruments �.:�, �� necessary to effectuate the conveyance shall be approved by the City Attorney and S! '� �:;; subsequently filed with the County Clerk of Tarrant County and returned to the City ��;, Secretary for permanent record. The City is to have possession of the property �';: described in Exhibit "A" on closing. �,> �� Section 6. That should the Director of Public Works, or his designated employee, report to the City Attorney that the herein above-named property owners have refused to accept the offer to purchase as set forth above, this refusal will be evidence that the Lity cannoi agree WI[(1 in� aroperiy uwnars as t� t}�e damages ' allowable by law. In such case, the City Attorney is hereby authorized and requested to file the necessary suit(s) and take the necessary action for the prompt acquisition of the property described in Exhibit "A" by condemnation or in any manner provided by law. That should it be subsequently determined that additional persons other than those named herein have an interest in said property, then in that event, the City Attorney is authorized and directed to join said parties as defendants in said condemnation suit(s). �° x Section 8.
