RESOLUTION NO. 97-5�
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
' GRAPEVINE, TEXAS FINDING THAT AN EMERGENCY
EXISTED ON NORTHWEST HIGHWAY NECESSITATING
THE IMMEDIATE RELOCATION OF THE FIRE HYDRANTS;
NEGATING THE NECESSITY TO ADVERTISE FOR
COMPETITIVE BIDS; DECLARING AN EMERGENCY AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, Texas Department of Transportation's (TxDOT's) contractor recently
began its Northwest Highway Paving and Drainage Reconstruction Project; and
WHEREAS, the condition existed that fire hydrants located along a portion of the
south side of Northwest Highway were in direct conflict with the temporary access
pavement that was intended for the use of businesses during construction; and
WHEREAS, it was critical that the fire hydrants be relocated so as not to cause
�`�° unnecessary delays to TxDOT's contractor or the local businesses; and
�, WHEREAS, it was imperative to relocate said fire hydrants immediately to ensure
fire protection by moving to a location where traffic would not be in direct conflict without
complying with the competitive bidding process requirements of the Tex. Rev. Civ. Stat.
Ann. Art 2368a; and
WHEREAS, TriDal Limited was able to respond immediately with the wherewithal
to effect repairs at a cost of$18,000.00; and
WHEREAS, the City Staff has requested the City Council to find that an emergency
did exist, that it was valid, legal and correct to waive the statutory competitive bidding
requirements, to ratify all actions of the City Staff relative to the soliciting the repair and
awarding said contract to the firm submitting the invoice.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
� 1. That all matters stated in the preamble are found to be true and correct and are
. incorporated into the body of this resolution as if copied in their entirety.
"""" 2. That the City Council does hereby find that an emergency existed on Northwest
Highway, that all actions taken by the City Staff were necessary and correct, that it was
valid, legal and correct to waive the statutory competitive bidding requirements, and that
the contract for the repair work perFormed by TriDal Limited is hereby approved and
ratified.
� 3. That this resolution become effective from and after the date of its passage.
