The main purpose for calling the special meeting was for the City Council and �
Planning & Zoning Ccamission to conduct a public hearing relative tA proposed +
amexidments to Camprehensive Zoni.ng Ordinance No. 82-73 and consider a sub- :
sequent ordinance, if applicable. ¢

Mayor Pawers declared open the public hearing.
�
Public Works Director Jim Baddaker reviewed the proposed amen�nents, which ?
included a definition of floor area and floor area ratio; changes in the

Family District; "CN" Neighborhood Comr�rcial District; "CC" Community

Office District; "CBD" Central Business District; "HCO" Hotel/Corporate Office
District; "LI" Light Industrial District; "GU" Governmental Use District; and
all the planned developttient districts, "PRD-6", "PRD-12", "PC�", and "PID".
In addition, a new district, "LB" L�mited Business District, was proposed for
local neighborhood shopping areas, being less intense than the "CN"
designation. It was recam�nded by the Planning & Zoning Conmission that the
"CW" Cam�ercial Warehouse District be deleted. Mr. Baddaker also noted Staff
recamtiendation to raise zoning application fees to $500, plus $25 or $30 per
_ acre for those applications which do not conform with the Master Plan.

a' Follawing this presentation, Mayor Pawers asked if there were guests present ;
' who wished to speak relative to the proposed zoning ordinance amenc3ments. The �
� following persons then co�nented: ;
{ 1. Mr. Fred Brodsky, 5223 Royal Lane, Dallas, Texas, is the owner of a tract '
of land in northeast Grapevine fronting on Highway 121 North. The ;
� property is currently zoned "HCO" Hotel/Corporation Office, and he
� expressed concern for the proposed 100-foot building height limitation in
the "HCO" regulations. �
�
2. Mr. Bob Gass, Chasew�od Ccxnpany, 433 E. Las Colinas Boulevard, Irving, �
� Texas, addressed concerns about changes in the proposed multi-family �
; districts as they wnuld affect the Grayson Square Apartrnents develognent g
� on Highway 121 South.
;
3. Mr. John Roark, Rosevu�od Properties, 1601 Elm, Dallas, Texas, also
addressed the building height limitation in the "HCO" district, as he aans
a 130-acre tract in the northeast area which is proposed for �
hotel/cozporate office develog�uent.
€ 4. Mr. Bill Deacon, 315 W. Hudgins, Grapevine, Te�s, inquixed about the
� proposed setback for multi-family property abutting single-family tracts,
; and he expressed concern for the minimtun lot size of one acre in fhe "CN"
Neighborhood Camnercial District.
5. Mr. Cecil McGough, 178 Villa Park Drive, Flawer Nbund, Texas, also
ccann�nted relative to the proposed minimtun lot size in the Neighborhood
Co�aY�rcial District.
There being no further comments, Canmission Member Gerald Norntian made a motion
to close their portion of the public hearing. Ccnmissioner Ehgholm offered a
second to the motion, which prevailed by the ensuing vote:

A m�tion to close the public hearing was also made by Council Nle.mber Dyer and
seconded by Council M�nber Wilbanks. The motion prevailed by the follawing �

Mayor Pawers then advised that the City Council and Planni.ng & Zoning
Cc�nnission would recess briefly before considering further business. The
Canmission was to reconvene in the Council Chambers, and the City Council
would reconvene in the Conference Roan to consider additional items.
With the exception of Mayor Pro Tem Ware, all me.mbers of the City Council were
present upon reconvening in the Conference R�n.
MIS�CII�I,ANmUS REPORTS, PUBLIC OFFICIALS LIABILITY INSURANC.E `_
The next order of business was for Assistant City Manager Kelvin Knauf to
report relative to public officials liability insurance.
Mr. Knauf advised that the Staff had been unable to oontract for $3 million of
public officials liability insurance, as per Council authorization in
December, 1984. He reviewed the current instability in the insurance market �
for this type of coverage and rec�arended that the Staff again try to obtain s
the $3 million coverage in Decanber, 1985. City Attorney John Boyle also
offered comments.
During the ensuing discussion, it was the general concensus of the Council
that the Staff reapply for the coverage in December, 1985. �
No formal Council action was taken.

TERMS OF APPOIlV'IN�1T, NEW PLANNING & ZONING CONY�iISSION N�ERS

The next order of business was for the City Council to consider terms of the �"
newly appointed Planning & Zoning Cc�cmission members.
City Secretary Karen Sparui advised that Mrs. Catherine Martin and Mr. Don �
Florence had been appointed on May 7 to fill vacancies on the Planning &
Zoning Cannission. At the t�m�e of appointment, however, it was not designated
which meniY�er would asstmtie the full, three-year term and which would fill the t`
re�naining twr� years left in the tenn previously held by Mr. Wilbanks. �

Council Member Spencer then made a mption that Mr. Don Florence asstune the �
full, 3-year term. The motion, seconded by Council Me�nber Brekken, prevailed �
by the folla�wing vote: t

The next item before the City Council was to consider appointment of an Open
Space Review Conmittee. �

City Secretary Karen Sparuz advised that the Open Space Requirements, adopted �
by the Council on April 16, 1985, provided for a cc�mittee to revie�a plats �;
relative to open space proposals. The aammittee was to be appointed by the �
City Council, with the follawing meqnbership requireme�lts: One m�nber fran the {
City Council, one n�mber frcan the Planning & Zoning Commission, one n��ber �
fran the Parks & Recreation Board, arbd the Director of Parks & Recreation. �

Following discussion of the matter, Council Nle.mber Glynn made a motion that �
Sharron Spencer represent the City Council, that Ron Cook be appointed fran
the Planning & Zoning Cca�mission, Kevin Conklin will serve as the Director of �
Parks & Recreation, and that Mrs. Sue Burgtorf be appointed to the Open Space �
Review C�m.ittee as a representative of the Parks Board. The nx�tion was �
seconded by Council Member Dyer and prevailed by the ensuing vote: �

discuss pending litigation pursuant to Article 6252-17, V.A.T.C.S. , Subsection �

. Follawing the closed session, the City Council reconvened in the Council i
Chambers, with Mayor Pro Tem Ware being the only member not in attendance. `

Assistant City Manager Kelvin Knauf advised that no Council action was �
necessary as a result of the �cecutive Session. �

The next order of business was for the City Council to consider the �
recaimyendation of the Planning & Zoning Commission relative to proposed �
' `� amenc�inents to the Ccxnprehensive Zoning Ordinance. i

Vice Chairntian Ron Cook reported the Planning & Zoning Conmission recamiended i
adoption of the amenc�nents as proposed, with the follawing changes: �
1. That the zoning application fee be set at $500 for 0 to 1 acre tracts, plus
an additional $25 per acre for tracts larger than one acre.

Districts be amended to read as follows: "Screened. garbage and/or solid

Follawing Council deliberation of the matter, a motion was made by Council
Member Dyer and seconded by Council Nlember Brekken to approve the ordinance
am�ending Comprehensive Zoning Ordinance No. 82-73 as recam�nded by the �
Planning & Zoning Ccmmission, including the editorial changes noted by Council ;
M�nber Spencer, deleting the multi-family residential use from the "PCD" dis- E
trict, and tabling changes in the Hotel/Corporate Office District for further
consideration. The motion prevailed by the ensuing vote: �

City Attorney John Boyle noted that passage of the ordinance on an e�uergency
