A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS FINDING THAT AN EMERGENCY
EXISTS AT THE SANITARY SEWER LINE CROSSING OF
BIG BEAR CREEK AT PARR PARK NECESSITATING THE
IMMEDIATE REPAIR OF THE FAILED SEWER LINE;
NEGATING THE NECESSITY TO ADVERTISE FOR
COMPETITIVE BIDS; DECLARING AN EMERGENCY AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, the sanitary sewer line crossing of Big Bear Creek at Parr Park
sustained substantial damage as a result of high and turbulent water; and
WHEREAS, the sanitary sewer line failed discharging untreated sewage into Big
Bear Creek; and
WHEREAS, it is imperative to preserve the City's property and to protect the
citizen's health and welfare in providing adequate conveyance of sanitary sewer and to
comply with the rules and regulations established by the Environmental Protection Agency
�, and the Texas Natural Resource Conservation Commission that the sanitary sewer line
be repaired immediately without complying with the competitive bidding process
requirements of the Tex. Rev. Civ. Stat. Ann. Art 2368a; and
WHEREAS, Wright Construction Company was able to respond immediately with
the wherewithal to effect repairs at a cost of $36,896.00; and
WHEREAS, the City Staff has requested the City Council to find that an emergency
does exist, that it is valid, legal and correct to waive the statutory competitive bidding
requirements, to ratify all actions of the City Staff relative to the soliciting the repair and
awarding said contract to the firm submitting the invoice.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
1. That all matters stated in the preamble are found to be true and correct and are
� incorporated into the body of this resolution as if copied in their entirety.
2. That the City Council does hereby find that an emergency exists at Big Bear
� Creek in Parr Park, that all actions taken by the City Staff is necessary and correct, that
it is valid, legal and correct to waive the statutory competitive bidding requirements, and
that a contract for this repair work is hereby awarded to Wright Construction Company and
is in all things approved and ratified.
3. The fact that the present resolutions and regulations of the City of Grapevine,
Texas, are inadequate to properly safeguard the health, safety, morals, peace and general
welfare of the inhabitants of the City of Grapevine, Texas creates an emergency for the
� immediate preservation of the public business, property, health, safety and general welfare
of the public which requires that this resolution become effective from and after the date
of its passage and it is accordingly so resolved.
