,,,�, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS RECOGNIZING THE IMPORTANCE OF
PRESERVING A PART OF THE CITY'S HERITAGE BY
ACQUISITION OF THE NASH FARM HOMESTEAD BY THE
GRAPEVINE HERITAGE FOUNDATION; PROVIDING FOR
THE GRANTING OF FUNDS TO THE HERITAGE
FOUNDATION TO PAY FOR ONE-HALF OF THE COST OF
CONSTRUCTING HUDGINS STREET BETWEEN BALL
STREET AND COLLEGE STREET CONTIGUOUS TO THE
NASH FARM HOMESTEAD; ACCEPTING A DEDICATION
OF ONE-HALF ACRE OF PROPERTY FROM CMPA - EAGLE,
INC. IN SATISFACTION OF THE OPEN SPACE
REQUIREMENT OF APPENDIX D ZONING, SECTION 51
RELATIVE TO OPEN SPACE AND RECREATIONAL AREA;
AUTHORIZING THE EXECUTION OF NECESSARY
DOCUMENTS TO CARRY OUT THE TRANSACTION AND
PROVIDING AN EFFECTIVE DATE
"� WHEREAS, CMPA - Eagle, Inc. a Texas Corporation, has acquired certain
property in the City of Grapevine which property includes the Nash Farm Homestead;
'� and
WHEREAS, CMPA - Eagle, Inc. has agreed to convey approximately 3.343
acres of said Nash Farm Homestead to the Grapevine Heritage Foundation and to
execute an assignment of an option to purchase an additional approximately 1 .503
acres of the said Nash Farm Homestead; and
WHEREAS, the earnest money contract between CMPA - Eagle, Inc. and the
Grapevine Heritage Foundation obligates the Foundation to pay the actual out of
pocket costs incurred in constructing Hudgins Street between Ball Street and College
Street; and
WHEREAS, the City believes and finds that the construction of Hudgins Street
is necessary and vital for the development of the property being acquired by the
Foundation and the City does hereby agree to make a one-time grant to the
Foundation in the amount necessary to fund one-half of the cost of constructing
Hudgins Street, which one-half is currently estimated at 5183,838; and
�, WHEREAS, CMPA - Eagle, Inc. is proposing to develop property contiguous to
Hudgins and in close proximity to the Nash Farm Homestead for single family
residential construction, and CMPA - Eagle, Inc. has offered to dedicate to the City
�► of Grapevine one-half acre for open space in satisfaction of requirements in the City's
zoning ordinance, Appendix D, Zoning in the City Code of Ordinances, Section 51 ,
which offer the City does accept; and

WHEREAS, the City Council finds that the preservation of the Nash Farm
Homestead is in the best interest of the City and contributes to the preservation of the
health, safety and general welfare and enhances property values and the quality of

WHEREAS, the City Council authorizes and approves the execution of all
necessary legal documents, as approved by the City Manager and City Attorney,
necessary to carry out this transaction.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1 . That all matters in the preamble are found to be true and correct
and are incorporated into the body of this resolution as if copied in their entirety.
Section 2. That the City does hereby agree to grant to the Grapevine Heritage
Foundation the necessary funds to pay for one-half of the cost of Hudgins Street,
between Ball Street and College Street all as detailed in an unimproved property
earnest money contract between CMPA - Eagle, Inc. and the Grapevine Heritage
Foundation, which contract in addendum I calls for Hudgins Street, including utilities,
''°�� to be constructed in accordance with plans and specifications developed by Turner,
Collie and Braden. The current estimated cost of one-half of the street project is
'� 5183,838. The City of Grapevine by this resolution commits to expend a maximum
of $183,838. This maximum may be increased by subsequent City Council
resolution.
Section 3. CMPA - Eagle, Inc. agrees to dedicate to the City of Grapevine all
of the lot, tract, and parcel of land described in Exhibit "A" attached hereto and
incorporated herein for all purposes for open space purpose pursuant to the City's
zoning ordinance, Appendix D of its Code of Ordinances, Section 51 . The City, by
this resolution, does hereby acknowledge said proposed dedication and does agree to
accept same.
Section 4. That the City Manager is hereby authorized and directed to sign all
necessary documents, as approved by the City Attorney, to carry out this transaction
and to fund one-half (1/2) of the cost of Hudgins Street.
Section 5. That this resolution shall take effect from and after the date of its
passage.
