RESOLUTION NO. 95-30
,�, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS FINDING THAT AN EMERGENCY
EXISTS AT THE OUTFALL OF THE CITY'S CONCRETE
LINED DRAINAGE CHANNEL IN COUNTRYSIDE ESTATES
NECESSITATING THE SOLICITING OF BID PROPOSALS
FOR THE REPAIR OF THE FAILED CHANNEL PAVEMENT
SECTIONS; NEGATING THE NECESSITY TO ADVERTISE
FOR COMPETITIVE BIDS; DECLARING AN EMERGENCY
AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the concrete lined drainage channel in Countryside Estates is
experiencing substantial undermining of the channel lining; and
WHEREAS, the undermining of the channel lining has led to a failure of the
channel lining at the downstream outfall of the channel as it discharges into
Colleyville; and
WHEREAS, it is imperative to preserve the City's property and to protect the
"'�" citizen's health and welfare in providing adequate stormwater systems throughout the
, City that the channel be repaired immediately without complying with the competitive
� bidding requirements of Tex. Rev. Civ. Stat. Ann. Art 2368a; and
WHEREAS, the City Staff received bid proposals from five (5) firms to repair the
channel; and
WHEREAS, the low proposal was from J-N Construction Company at a cost of
522,902.40, a cost that is found to be reasonable and within the market value for
similar type of construction activity; and
WHEREAS, the City Staff has requested the City Council to find that an
emergency does exist, that it is valid, legal and correct to waive the statutory
competitive bidding requirements, to ratify all actions of the city Staff relative to the
soliciting of bid proposals, and awarding said contract to the firm submitting the low
proposal.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:

1 . That all matters stated in the preamble are found to be true and correct and
�,,,, are incorporated into the body of this resolution as if copied in their entirety.
2. That the City Council does hereby find that an emergency exists at the
concrete lined drainage channel in Countryside Estates which is experiencing
substantial undermining of channel lining, that all actions taken by the City Staff in
„� soliciting bid proposals is necessary and correct, that it is valid, legal and correct to
waive the statutory competitive bidding requirements, and that a contract for this
repair work is hereby awarded to J-N Construction Company are in all things approved
and ratified.
3. The fact that the present resolutions and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals,
peace and general welfare of the inhabitants of the City of Grapevine, Texas creates
an emergency for the immediate preservation of the public business, property, health,
safety and general welfare of the public which requires that this resolution become
effective from and after the date of its passage and it is accordingly so resolved.
