RESOLUTION N0. 94-48
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS MAKING FINDINGS OF CERTAIN
FACTS RELATIVE TO THE PURCHASE OF LIFEPAK° 10
DEFIBRILLATOR/MONITOR/PACEMAKER; DETERMINING
THAT THE ITEM IS AVAILABLE FROM ONLY ONE
SOURCE; DETERMINING THAT THE PURCHASE OF THE
LIFEPAK ° 10 DEFIBRILLATOR/MONITOR/PACEMAKER IS
NECESSARY TO PRESERVE AND PROTECT THE PUBLIC
HEALTH AND SAFETY OF THE CITY'S RESIDENTS;
AUTHORIZING PURCHASE FROM PHISIO CONTROL
CORPORATION FOR THE AMOUNT OF S8,545.25;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, Phisio Control Corporation is the sole provider of Lifepak ° 10
Defibrillator/Monitor/Pacemaker; and
WHEREAS, the City Staff has been unable to locate anyone except Phisio
"���' Control Corporation who manufactures the Lifepak ° 10
Defibrillator/Monitor/Pacemaker for use by the City's Emergency Medical Technicians;
���° and
WHEREAS, the City Staff has determined the need to purchase a Lifepak ° 10
Defibrillator/Monitor/Pacemaker is necessary to preserve and protect the public health
and safety of the City's residents.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1 . That all of the above premises are found to be true and correct and
are incorporated into the body of this resolution as if copied in their entirety.
Section 2. That the City Council authorizes the purchase of one Lifepak ° 10
Defibrillator/Monitor/Pacemaker from Phisio Control Corporation for the total amount
of 58,545.25.
,,,�, Section 3. That the City Manager, or his designee, is authorized to take all
steps necessary to consummate the purchase of the Lifepak ° 10
Defibrillator/Monitor/Pacemaker as provided in Section 2.

�.� Section 4. That if any section, article, paragraph, sentence, ciause, phrase or
word in this resolution, or application thereof to any persons or circumstances is held
invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not
� affect the validity of the remaining portions of this resolution; and the City Council
hereby declares it would have passed such remaining portions of the resolution
despite such invalidity, which remaining portions shall remain in full force and effect.
Section 5. That this resolution shall take effect from and after the date of its
passage.

GRAPEVINE, TEXAS on this the 1 st day of November , 1994.
