RESOLUTION NO. 93-41
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS AUTHORIZING THE CITY'S SPECIAL
COUNSEL TO FILE AN APPLICATION FOR PRELIMINARY
AND PERMANENT INJUNCTION IN THE CASE STYLED
CITY OF GRAPEVINE ET AL. V. DEPT. OF
TRANSPORTATION, ET AL., CAUSE NOS. 92-1151 AND
92-1158 AND TO PURSUE ANY AND ALL ACTION TO
PROTECT THE CITY FROM THE DELETERIOUS EFFECTS
ASSOCIATED WITH THE PROPOSED EXPANSION OF THE
DALLAS/FORT WORTH INTERNATIONAL AIRPORT
WITHOUT PROPERLY COMPLYING WITH THE FEDERAL
ENVIRONMENTAL LAWS; AND PROVIDING AN EFFECTIVE
DATE
WHEREAS, on or about October 1, 1993, the Dallas/Fort Worth International
, Airport Board ("Airport Board") awarded certain contracts regarding the expansion of
DFW Airport on the same day that the City of Grapevine was presenting its arguments
to the District of Columbia Court of Appeals that the Airport Board and the Federal
Aviation Administration ("FAA") failed to comply with the National Environmental
Policy Act, the National Transportation Act and the National Historic Preservation Act
�-# in preparing the Final Environmental Impact Statement ("FEIS") for the expansion of
DFW Airport; and
WHEREAS, since the FEIS included both the east side and west side runways
as one unitary project, and also assumes a full build-out of the project, it is vital that
the City of Grapevine seek injunctive relief in the District of Columbia Court to prevent
the construction of Runway 16/34-East prior to the Court's final determination of
whether the FEIS complies with federal law; and
WHEREAS, it is imperative that the health, safety and welfare of the citizens
of Grapevine be protected from the Airport Board's expansion plans while the City has
grave doubts as to the effects of the expansion on the citizens.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
��.na Section 1 . That the City Council finds that the facts contained in the preamble
are true and correct and are incorporated herein in their entirety.

Section 2. That the City Council hereby instructs its special counsel, Robert
H. Power and Cutler & Stanfield, to file an application for preliminary and permanent
injunction in the case styled CitYof Grapevine et al v Dent. of Transportation, et al.,
� Cause Nos. 92-1151 and 92-1158 and to take any and all action necessary to protect
the health, safety and general welfare of the citizens of the City of Grapevine.
Section 3. That this resolution shall take effect immediately from and after its
final date of passage and it is accordingly so ordered.
