�, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS AUTHORIZING ITS SPECIAL
COUNSEL TO CHALLENGE THE CONSTITUTIONALITY AND
VALIDITY OF SENATE BILL 348 AND TO PURSUE ACTION
TO PROTECT THE CITY FROM THE DELETERIOUS
EFFECTS OF SENATE BILL 348; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, on May 6, 1993, Governor Richards signed into law S.B. 348,
which purports to strip home rule cities such as Grapevine of their right to self-
government and which prevents the City from safeguarding the health, safety and
welfare of its citizens; and
WHEREAS, it is vitally necessary for the City to challenge this legislation
because of its devastating impact on the City and to obtain a ruling from the courts
striking down this law as unconstitutional and invalid.
WHEREAS, the City Council of the City of Grapevine hereby declares and
""'�' determines that it is in the best interest of the citizens of the City to authorize its
special counsel to challenge the constitutionality and validity of S.B. 348 and to
� pursue any and all action to protect the City from the deleterious effects of S.B. 348.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1 . That the above preamble is found to be true and correct and is
incorporated into the body of this resolution as though set forth in its entirety herein.
Section 2. That the City Council hereby instructs its special counsel Robert H.
Power, to file an action challenging the constitutionality and validity of S.B. 348.
Section 3. That this resolution shall tal<e effect immediately from and after its
final date of passage, and it is accordingly so ordered.
