RESOLUTION NO. 91-39
�' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, DETERMINING A PUBLIC NEED AND
NECESSITY FOR THE ACQUISITION OF FEE SIMPLE TITLE
TO AN APPROXIMATE 42.888 ACRES OF LAND LOCATED IN
THE G. M. BALL SURVEY, ABSTRACT NO. 234 ; W.
DRISKELL SURVEY, ABSTRACT NO. 405; AND THE J. H.
� HUGHES SURVEY, ABSTRACT NO. 2028, TARRANT COUNTY,
TEXAS, FOR A PUBLIC PARK, AND ASSOCIATED
MUNICIPAL PURPOSES; AUTHORIZING THE CITY ATTORNEY
TO FILE EMINENT DOMAIN PROCEEDINGS TO ACQUIRE THE
SUBJECT PROPERTY; PROVIDING AN EFFECTIVE DATE.
WHEREA3, the City Council of the City of Grapevine,
Texas, upon consideration of the matter, has determined that
there is a public necessity for the welfare of the City of
Grapevine and the public-at-large, to acquire certain real
property for a public park, and associated municipal
purposes; and,
WHEREAS, in accordance with the above, the City Council
of the City of Grapevine, Texas hereby finds that it is in
the public interest to acquire fee simple title to real
�.� property for the above stated municipal purposes; and,
WHEREAS, the real property to be acquired for such
purposes is an approximate 42.888 acres, more or less, of
land located in the G. M. Ball Survey, Abstract No. 234; W.
Driskell Survey, Abstract No. 405; and the J. H. Hughes
Survey, Abstract No. 2028, and is more particularly described
in Exhibit "A" attached hereto and made a part hereof by
reference (the "Property") ;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COIINCIL OF
THE CITY OF GRAPEVINE, TEBAB:
Section I. The City Council hereby finds and
determines that it is necessary for the welfare of the City
and its citizens and is in the public interest to acquire fee
simple title to the Property for a public park, and
associated municipal purposes.
Section II. The City Manager, or his designee, is
hereby authorized on behalf of the City to attempt to agree
on damages and compensation to be paid to owners of the
Property and to make an official offer to said owners. If
the City Manager or his designee determines that an agreement
as to damages and compensation cannot be reached, then the
City Attorney, or his designee, is hereby authorized to file
or cause to be filed, against the owners and interested

acquire fee simple title to the Property.

Section III. It is the intent of the City Council that
this Resolution authorizes the condemnation of all property
;�,,, required to construct and use as a public park, and other
associated municipal purposes. If it is later determined
that there are any errors in the descriptions contained
herein or if later surveys contain more accurate revised
descriptions, the City Attorney or his designee is authorized
to have such errors corrected or revisions made without the
necessit� of obtaining a new City Council Resolution
authorizing the condemnation of the corrected or revised
Property.
Section IV. The findings of fact, recitations and
provisions set out in the preamble of this Resolution are
adopted and made a part of the body of this Resolution, as
fully as if the same were set forth herein.
Section V. This Resolution shall become effective
immediately from and after its approval.
