RESOLUTION N0. 90-11
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS, ESTABLISHING JUNE 5,
1990 AS THE HEARING DATE TO CONSIDER ADOPTING
A CAPITAL IMPROVEMENTS PLAN FOR WATER AND
WASTE WATER IMPROVEMENTS AND IMPOSING WATER
�„ AND WASTE WATER IMPACT FEES; PROVIDING FOR
PUBLIC NOTICE OF THE HEARING IN ACCORDANCE
WITH STATE LAW AND PROVIDING AN EFFECTIVE
DATE.

WHEREAS, the Texas Local Government Code, Chapter 395, as
amended, (the "Code") ( formerly �ex. Rev. �iv. Stat. Ann. Art.
1269j-4 . 11, as amended) , provides a procedure for enabling
municipalities to enact impact fees; and
WHEREAS, the City Council of the City of Grapevine, Texas
(the "City" ) has heretofore appointed an advisory committee in
accordance with Section 395 .058 of the Code; and
WHEREAS, on June 20, 1989 , the City Council conducted a
public hearing, after proper publication of notice in
accordance with Section 395 . 044 of the Code, to consider land
use assumptions to be used to develop a capital improvements
plan pursuant to which a water and wastewater impact fee would
be imposed (the "land use assumptions" ) , and on July 11, 1989,
the City Council approved the land use assumptions upon the
adoption of Resolution No. 89-20; and
WHEREAS, a capital improvements plan that identifies
water and waste water capital improvements and facility
fi� � expansions for which impact fees may be assessed has been
developed by qualified professionals using generally accepted
engineering and planning practices in accordance with Section
395 . 014 of the Code; and
WHEREAS, the City intends to impose water and waste water
impact fees and hereby desires to establish a public hearing
date to consider adopting a capital improvements plan and
imposing water and waste water impact fees within the
designated service area; and
WHEREAS, on January 16, 1990, by adoption of Ordinance
No. 90-02, the City Council relinquished some of the City' s
territory; and
WHEREAS, the designated service area needs to be revised
to reflect the change in territorial boundaries as established
by Ordinance No. 90-02 .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1. That all of the matters in the preamble of
this resolution are true and correct and are incorporated into
� , the body of this resolution as if fully set forth herein.
Section 2 . That a public hearing date to consider
adopting a capital improvements plan for water and waste water
`�'' improvements and imposing water and waste water impact fees
shall be held on June 5, 1990 at 7 :30 p.m. in the Council
Chambers, Municipal Court Room #205, 307 West Dallas Road,
Grapevine, Texas .
Section 3 . That the designated service area on which
the proposed impact fees will be imposed and levied shall be
revised by the Public Works Director, or his duly designated
representative, to reflect the change in territorial boundaries
as established by Ordinance No. 90-02 .

Section 4 . That the City Secretary, or her duly
designated representative, shall provide public notice of the
hearing in accordance with Section 395 . 049 of the Code.
Section 5 . That in accordance with Section 395 . 048 of
the Code, on or before the date of the first publication of the
notice, the Department of Public Works shall make available to
the public during normal business hours the City' s proposed
capital improvements plan and impact fees .
� Section 6 . That in accordance with Section 395 . 050 of
the Code, on or before the fifth (5th) business day before the
date of the public hearing, the advisory committee shall file
� its written comments on the proposed capital improvements plan
and impact fees .
Section 7 . That this resolution shall take effect from
and after the date of its passage.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the lst day of May , 1990 .
