The Board approved the following request

RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the following special
exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for property located at
1150 Texan Trail, proposed to be platted as Lot 1, Block 1, Ryder Addition as follows:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception allowing the existing structure and property
to remain as developed along with an expansion as shown on the site plan.
Staff finds that a special condition exists for the special exception request. Specifically, the
majority of the site is an existing developed lot. Developed in 1980, the proposed
reconfigured site is now noncompliant with the current zoning ordinance (82-73) relative to
the minimum front yard open space requirement.
At the May 20, 2014 meeting Council approved on first reading of an ordinance the site
plan for the reconfigured subject property. Proposed improvements to the site have
necessitated a special exception request to address approximately 5,580 square feet of
existing paving within the required front yard landscape setback area. The property is
currently zoned "LI' Light Industrial District. The reconfigured lot will enable the applicant to
expand the operation by allowing vehicle parking onto the portion of the reconfigured lot
which is currently undeveloped. An existing 5,360 square foot building used for vehicle
maintenance and office uses is proposed to be expanded by 5,537 square feet, for a total
of 10,897 square feet to allow for an expanded shop and office area. As an accessory use
to the current operation, a vehicle fueling station exists to the rear of the existing structure
and will remain as part of the proposed expansion. Site improvements on the reconfigured
site include: increasing the percent of open space from two percent to 22% and increasing
the percentage of masonry on the expanded structure from zero percent to 76%. The

requirements. As discuss with City staff during our pre -development conference, it is important to Ryder to make sure
current improvements meet or exceed City code. However given the existing conditions, Ryder is requesting a
exception on both the front yard setback at the existing employee/customer parking location ONLY and the
percent masonry requirement. See attached Letter for more detail on request.

E. CHANGING NONCONFORMING USES:
Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
which such nonconforming use is located as of the effective date of this ordinance
except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded under the provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.
G. TERMINATION OF NONCONFORMING STRUCTURES:

1, Block 1, Dearing Addition.
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and /or enlargement of a nonconforming
use. The applicant requested a special exception allowing the demolition of an existing

Mr. Triplett explained that Staff found a special condition existed for the special
exception requested. Specifically, the site was developed in 1980 and had been in
existence since that time. Currently and as proposed the site was noncompliant with the
current zoning ordinance (82-73) relative to open space, maximum impervious area,
front yard setback, side yard setback, rear yard setback, perimeter and site landscape
area.
Mr. Triplett went on to explain that on July 2, 2012, the Board of Zoning Adjustment had
approved a special exception allowing demolition of an existing non-residential structure
and construction of a new convenience store. Among the improvements proposed was
new construction of a 3,415 square foot convenience store, 18 -square feet larger than
presented to the Board on July 2, 2012. To accommodate the proposed improvements,
a conditional use application and special exception request were required. The revised
conditional use request was approved on first reading by the site Plan Review
Committee at their May 7, 2014 meeting. The second reading was scheduled for June
4, 2014 contingent upon favorable approval by the Board. The property was currently
zoned "CC" Community Commercial District and had been developed as a 2,569 -
square foot convenience store with gasoline sales and off -premise consumption of
alcoholic beverages (beer and wine only).
With no questions for Mr. Triplett, contractor Pat Gallagher, representing property
owners Nirmal and Arman Enterprises, Inc. of 12212 Arbor Lake Drive, Rhome, Texas,
Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested

1150 TEXAN TRAIL
The next item for the Board of Zoning Adjustment to consider was BZA14-13 submitted
by Brandon Middleton, for property located at 1150 Texan Trail, proposed to be platted
as Lot 1, Block 1, Ryder Addition.
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and /or enlargement of a nonconforming
use. The applicant requested a special exception allowing the existing structure and
property to remain as developed along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the special
exception requested. Specifically, the majority of the site was an existing developed lot.
The proposed reconfigured site was originally developed in 1980 and was now
noncompliant with the current zoning ordinance (82-73) relative to the minimum front
yard open space requirement.
Mr. Triplett went on to explain that on May 20, 2014 City Council had approved on first
reading of an ordinance, the site plan for the reconfigured subject property. He stated
that proposed improvements to the site necessitated a special exception request to
address approximately 5,580 square feet of existing paving within the required front
yard landscape setback area. An existing 5,360 square foot building used for vehicle
maintenance and office use was proposed to be expanded by 5,537 square feet; and an
accessory use to the current operation, a vehicle fueling station existed to the rear of
the existing structure and would remain as part of the proposed expansion.
With no questions for Mr. Triplett, applicant Brandon Middleton, of 801 Cherry Street,
Fort Worth, Texas, took the Oath of Truth; he gave a brief presentation to the Board and
requested favorable consideration of his request and offered to answer any questions of
the Board.
Robert Rainwater asked if the expansion was primarily service bays. Mr. Middleton
stated that it was.
George Dalton asked if there was still landscape area in front of the property, Staff
stated that there would be landscape in the right of way.
Sal DeAngelo asked what the vehicle capacity was for the subject site. Mr. Middleton
stated that it was originally 30 trucks. Discussion was held relative to the parking table,
capacity and parking space sizes.
