TRIPLETT JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA14-12 513 EAST NORTHWEST HIGHWAY MEETING DATE: MONDAY, JUNE 2, 2014 RECOMMENDATION: Staff recommends the Board of Zoning Adjustment approve the following special exception to Grapevine Comprehensive Zoning Ordinance 82-73 for property located at 513 East Northwest Highway, platted as Lot 1, Block 1, Dearing Addition as follows: Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant is requesting a special exception to demolish the existing non-residential structure and construct a new convenience store as shown on the plot plan. SPECIAL CONDITION: Staff finds that a special condition exists for the special exception requested. Specifically, the site was developed in 1980 and has been in existence since that time. Currently and as proposed the site is noncompliant with the current zoning ordinance (82-73) relative to open space, maximum impervious area, front yard setback, side yard setback, rear yard setback, perimeter and site landscape area. BACKGROUND INFORMATION: On July 2, 2012 the Board of Zoning Adjustment approved a special exception to allow the demolition of an existing non-residential structure and a new convenience store to be constructed on the current site. Among the proposed improvements is the construction of a new 3,415 square foot convenience store that is 18 -square feet larger than what was presented to the Board on July 2, 2012. To accommodate the proposed improvements, a conditional use application and special exception request are required. The revised conditional use request was approved on first reading by the site Plan Review Committee at their May 7, 2014 meeting. The second reading is scheduled for June 4, 2014 contingent upon a favorable approval by the Board. The property is currently zoned "CC" Community Commercial District and is developed as a 2,569 -square foot, convenience store with gasoline sales and off -premise consumption of alcoholic beverages (beer and wine only). 0:\BZA\2014\Cases\BZA14-12.4 , The following are recent actions on the subject property. On June 6, 2012 the Site Plan Review Committee approved on first reading a conditional use application for the construction of a new 3,395 square foot convenience store that was 500 -square feet larger than what was presented to the Board on April 2, 2012. On July 2, 2012 the Board of Zoning Adjustment approved a special exception to allow the demolition of an existing non-residential structure and a new convenience store to be constructed. The second reading by the Site Plan Review Committee was approved on July 11, 2012. On March 20, 2012 the Council approved on the first reading of an ordinance a conditional use request to demolish the existing 2,569 -square foot structure and allow gasoline sales and the possession, storage, retail sale and off -premise consumption of alcoholic beverages (beer and wine only) in conjunction with a new 2,881 -square foot convenience store. The Board of Zoning Adjustment on April 2, 2012 approved two variance requests to the area and width requirements on the subject. Following approval of a special exception and the two variance requests, the second reading of the ordinance, for the subject site was approved by the Council at their April 17, 2012 meeting. On August 3, 1992 the Board of Zoning Adjustment approved a special exception on the subject site to allow the existing lot and development to remain as built including retail sale of off -premise alcoholic beverages (beer only) in conjunction with a convenience store and automotive repair. The subject site was platted in 1992 as a result of the action taken by the Board of Zoning Adjustment in it's acknowledgment of the inability to expand the site due to development on adjacent sites and street right-of-way on two other sides. NORTHW-EST HIGHWAY The first item for the Board of Zoning Adjustment to consider was BZA14-12 submitted by Anwar Dossani, for property located at 513 East Northwest Highway, platted as Lot 1, Block 1, Dearing Addition. Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and /or enlargement of a nonconforming use. The applicant requested a special exception allowing the demolition of an existing non-residential structure and construction of a new convenience store as shown on the plot plan. Mr. Triplett explained that Staff found a special condition existed for the special exception requested. Specifically, the site was developed in 1980 and had been in existence since that time. Currently and as proposed the site was noncompliant with the current zoning ordinance (82-73) relative to open space, maximum impervious area, front yard setback, side yard setback, rear yard setback, perimeter and site landscape area. Mr. Triplett went on to explain that on July 2, 2012, the Board of Zoning Adjustment had approved a special exception allowing demolition of an existing non-residential structure and construction of a new convenience store. Among the improvements proposed was new construction of a 3,415 square foot convenience store, 18 -square feet larger than presented to the Board on July 2, 2012. To accommodate the proposed improvements, a conditional use application and special exception request were required. The revised conditional use request was approved on first reading by the site Plan Review Committee at their May 7, 2014 meeting. The second reading was scheduled for June 4, 2014 contingent upon favorable approval by the Board. The property was currently zoned "CC" Community Commercial District and had been developed as a 2,569 - square foot convenience store with gasoline sales and off -premise consumption of alcoholic beverages (beer and wine only). With no questions for Mr. Triplett, contractor Pat Gallagher, representing property owners Nirmal and Arman Enterprises, Inc. of 12212 Arbor Lake Drive, Rhome, Texas, Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested favorable consideration of his request and offered to answer any questions of the Board. Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and /or enlargement of a nonconforming use. The applicant requested a special exception allowing the existing structure and property to remain as developed along with an expansion as shown on the plot plan. Mr. Triplett explained that Staff found a special condition existed for the special exception requested. Specifically, the majority of the site was an existing developed lot. The proposed reconfigured site was originally developed in 1980 and was now noncompliant with the current zoning ordinance (82-73) relative to the minimum front yard open space requirement. Mr. Triplett went on to explain that on May 20, 2014 City Council had approved on first reading of an ordinance, the site plan for the reconfigured subject property. He stated that proposed improvements to the site necessitated a special exception request to address approximately 5,580 square feet of existing paving within the required front yard landscape setback area. An existing 5,360 square foot building used for vehicle maintenance and office use was proposed to be expanded by 5,537 square feet; and an accessory use to the current operation, a vehicle fueling station existed to the rear of the existing structure and would remain as part of the proposed expansion. With no questions for Mr. Triplett, applicant Brandon Middleton, of 801 Cherry Street, Fort Worth, Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested favorable consideration of his request and offered to answer any questions of the Board.
