placed on the agenda for public hearing at the discretion of the staff. Based on the size of the
agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry. Public
hearings may be continued to the next public hearing. Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or a
special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall have,
from the date of submittal, a period of four months to request and be scheduled on an agenda
before the Planning and Zoning Commission and City Council. If after said period of four months an
application has not been scheduled before the Commission and Council said application shall be
considered withdrawn, with forfeiture of all filing fees. The application, along with the required
filing fee may be resubmitted any time thereafter for reconsideration. Delays in scheduling
applications before the Planning and Zoning Commission and City Council created by city staff
shall not be considered a part of the four month period.

SUBJECT: CONDITIONAL USE REQUEST CU14-37; LOT 1, BLOCK A, PARK
PLACE LEXUS
Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU12-09 (Ord. 2012-16) approved at the April 17, 2012
meeting for an automobile dealership with sales and service of new and used vehicles,
specifically to allow for the installation of temporary trailers during the renovation
process, and take any other action necessary.
Conditional Use Request CU98-69 (Ord. 1999-09) was approved at the January 5, 1999
meeting to allow for the establishment of an automotive dealership (Park Place Lexus)
with sales and service of new and used vehicles. Conditional Use Request CU99-98
(Ord. 1999-98) was approved at the July 6, 1999 meeting granting an expansion to the
dealership. Conditional Use Request CU04-22 (Ord. 2004-46) was approved at the July
20, 2004 meeting to expand the sales and service areas. At the May 17, 2005 meeting
the City Council approved Conditional Use Request CU05-25 (Ord. 2005-40) on the
subject property which allowed for a 4.95 acre expansion for automobile inventory
storage. The Site Plan Review Committee at their August 24, 2005 meeting approved
Conditional Use Request CU05-40 which allowed for replacement of a 22 -foot pole sign
with a 36 -foot pole sign. Conditional Use Request CU07-42 was approved by the Site
Plan Review Committee at their January 30, 2008 meeting to allow for the addition of a
6,955 -square foot make ready building for new and used vehicles. Conditional use
Request CU12-09 (Ord. 2012-16) was approved at the April 17, 2012 Council meeting
to allow for an expansion to the service garage, car wash, pre -owned sales office and
service drive. The Site Plan Review Committee at their May 7, 2014 meeting approved
a 3,350 -square foot new car delivery area, a 387 -square foot expansion to the
previously approved 11,146 -square foot service garage to and elevation revisions to
accommodate the proposed expansions.
With this request the applicant proposes the temporary installation of two trailers (each
60 -feet by 12 -feet in size) that will contain five desks to maintain business operations
during the renovation process. One temporary bathroom trailer (28 -feet by 9 -feet in
size) is also proposed. The temporary office trailers will be removed by July 31, 2015.
The temporary bathroom trailer will be removed by October 15 of this year. See the

attached letter. Parking required for the dealership is 327 spaces -1,088 have been
provided.

Attached is a Conditional Use Application for Park Place Lexus request to install two trailers on
site for use as temporary space for employees during the renovation of the dealership. As you
are aware, the Park Place Renovation Project is extensive and will require vacating portions of
the building during this process. In order to provide continuous operations of the business,
trailers will be required to provide ongoing service to our clients. These temporary trailers will
be required for one year until the showroom renovation portion of the project is completed on
July 31, 2015. A temporary restroom trailer (as shown) will also be required until October 15th
of this year.
As you can see by the attached site plan and pictures, we are installing the trailers with an
emphasis on how they will appear on the site. A deck will be installed between the building and
the trailers. The two larger trailers will have wood siding on the exterior with a skirting to hide
the underside of the trailer.

This letter is to verify that your request for a conditional use permit located at 901 East State
Highway 114 and platted as Lot 1, Block A, Park Place Lexus to amend the previously approved
site plan for an automobile dealership with sales and service of new and used vehicles, specifically
to allow for the installation of a temporary bathroom facility to be removed by October 15, 2014 and
two temporary office trailers to be removed by July 31, 2015 was approved by the Site Plan Review
Committee on August 6, 2014. A copy of the approved site plan is enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.
