Boyle, Jr. City Attorney Karen Spann City Secretary �� CALL TO ORDER �"` The meeting was called to order by Mayor Pawers. INVOCATION Council Manber Spencer delivered the Invocation. PUBLIC HF,ARING, ZONING APPLICATION Z85-23, TERRA PROPERTIES The first order of business was for the City Council and Planning & Zoning Cca�mission to conduct a public hearing relative to Zoning Application Z85-23 su�iiitted by Terra Properties. Mayor Powers declared the public hearing open. Public Works Director Jim Baddaker reported the property in question was located on the west side of State Highway 121 North, north of Anderson-Gibson Road, and extended north to the City limits line and west to Denton Creek/ Corps of Engineers property. Containing approx�mately 390 acres, the tract was presently zoned "PID" Planned Industrial District with requested zoning being for a variety of uses which included "R-MF-1" and "R-MF-2" Multi-Family Districts, "CC" C�nunity Co�nercial District, "HC" Highway Con�rcial Dis- ��* trict, "HCO" Hotel/Corporate Office District, and "LI" Light Industrial District. A portion of the tract fell within Airport Noise Zones B and C. ;,�, Mr. Jeff Fegan, representing the Office of Airport Development at the Dallas- Fort Worth International Airport, then addressed the Council and Comnission. He outlined concerns of the Airport Board relative to surrounding develo�nent such as safety/building height and envirorun�ntal cc�npatibility. Mr. Fegan noted that multi-family was an acceptable use if noise control was built into the structures. A lengthy period of questions and comments frc�n the Council and Commission followed. Concerns expressed included (1) what constitutes multi-family dwellings, (2) the possibility of future expansion of the noise contours, and (3) sound control features. 06/25/85 The applicant, Mr. Paul Spain, President of Terra Properties, then presented a slide program, which addressed site analysis, proposed land uses and open space, and previous develoFanents of the companies involved in this joint venture. Proposed right-of-way plans for expansion of State Highway 121 were also noted. Deliberation followed, with topics of discussion including (1) the affect of this zoning request on the Master Plan and future developments in airport noise zones; (2) the concept plan and the possibility of zoning contingent upon the filing of deed restrictions; (3) buildable area within the project; ,,� and (4) pending annexation of adjacent land in Denton County. The demand this project would have on utilities was also discussed at length. Public Works Director Jim Baddaker revie�d the proposed water/sewer study " � update and elaborated on proposed utility demands in the northeast area of the City. The possibility of continuing the public hearing was then discussed, and the City Council and Planning & Zoning Cam�ission outlined their requests for add.itional information frcan the applicant. Mayor Powers then opened the floor to me�nbers of the audience. The following persons, though not specifically for or against the matter, offered c�ients: 1. Mr. Jerry Brite, Manager for the U. S. Army Corps of Engineers Grapevine Lake operations, inquired about the potential flood impact on habitable areas of the property in question. 2. Mr. Jerry Spencer, 3214 Wintergreen Court, inquired about the execution of an avigation release. 3. Mrs. Barbara Nunn, 2936 Scenic, addressed the possible annexation of land in Denton County and the rnunber of multi-family units proposed in the deve lo�uent. � 4. Mr. John Mayfield, 518 Azalea, supported the location of the proposed multi-family dwellings and encouraged protection of e�isting single-family hc�nes. � � 5. Mr. Jerry Pittman, 346 Pebblebrook, representing the Grapevine-Colleyville I. S. D. Board of Trustees, expressed gratitude for the applicant's offer of land for a school site. 6. Mr. Joe Wright, 601 W. Wall Street, inquired about the number of acres within the City limits of Grapevine and camlented relative to installation of utilities to serve new develognents. 7. Mr. Jim S�vann, 1018 Riverside, encouraged develo�anent of a utility plan for the City. The following letters were then entered into the record: ------------------------------------------------------------------------------ June 23, 1985 Dear Mayor Pawers and City Council Members: In regards to the zoning proposal submitted by Terra Properties, I � �st say that this is a hard decision to make. We have fought against allowing any more apartn�nts in Grapevine as well as fighting developers of industrial sites who cane in and totally �x� destroy the terrain of our countryside. But, I know that this land is going to be developed one way or the other, and it is our duty to allaw only what is best for Grapevine. In viewing this property, we feel that this land is truly wnrth preserving and is too pretty to be stripped down and leveled off for an industrial site. Therefore, w+e believe that the beauty of this area could be better preserved by allowing apartmP_nts to be built there. (2) 06/25/85 We also feel that a careful study should be made as to the number of units that are to be allowed and that a definite ceiling be set. Thank you for letting us state our opinions. Box 729 Grapevine, Texas 76051 Dear Ms. Carroll: Re: Zoning P,pplication Z85-23 This letter will state my objection to the request for "R-MF-1" (Tract 1) and "R-MF-2" (Tract 2) zoning requirements requested by Terra Properties in the above referenced application. The major reason for my objection is that this area is presently free of any residential develognent and should be kept this way in order to avoid conflict with future "HCO" uses. Residents could feel the need to object to office and hotel use in their front yards. � I further question the desirability of placing multi-family units in a "B" noise zone even with effective sound proofing. I assuttie these �' units will house children who will be playing outside and will be constantly subjected to noise and exhaust ftunes fran airplanes flying a few hundred feet overhead. For the above tw� reasons, I object only to the approval of tYie multi-family zoning requested by Terra Properties. The purpose of this letter is to question the proposed multi-family district in the vicinity of the "HCO" zoning currently under con- sideration. The proposed "HCO" zoning i.ncludes design requirements which restrict office develo�xnent in favor of adjacent residential (3) 06/25/85 districts. Ehcroachment of residential develo�anent in the can- mercial areas delineated for "HCO" zoning could further restrict the uses and design of "HCA" develognent. It is requested that any rezoning to multi-family districts be held in abeyance until such time as "HCO" zoning is finalized and design require�nents are fully explored. The Catmission was to reconvene in the Conference Room, 413 Main Street, to consider further business. The City Council was called back to order momentarily in the Council Chambers. All members were present with the �X '� exception of Council Member Dyer. PREVIEW PROMOTIONAL FII�i OF GRAPEVINE, CONVENTION & VISITORS BUREAU Convention & Visitors Bureau Director Bob Phillips advised that a video had been prepared and wr�uld be presented to meeting planners to attract conventions to Grapevine. The City Council then previewed the film and offered favorable co�nents. RESOLUTION, MORATORIUM EXTII�ISION, PARCEL NO. 164 (JOE WRIGHT) The next order of business was for the City Council to consider a resolution extending the voluntary moratoritun on City Parcel No. 164 (Joe Wright) . The caption of the proposed resolution was presented by City Secretary Karen Spann, who advised that Parcel No. 164, located on the far north end of Lucas Drive, was currently zoned "R-3" Multi-Family Dwelling District. The tract was under a voluntary mpratori�n which was to expire on June 30, 1985. Zoning Application Z85-22 had been submitted for consideration of all residential districts and was to be heard on August 20, 1985. An extension of the mr�ratoritun was necessary to cover the lapse, and the property awner had agreed � to extend it through August 31. There being little discussion, Council Member Wilbanks made a mption to , ,,� approve the resolution and extend the mr�ratoritun. The motion, seconded by Mayor Pro Tem Ware, prevailed by the ensuing vote: Ayes . Powers, Ware, Brekken, Glynn, Spencer, & Wilbanks Nays . None Absent: Dyer (4) 06/25/85 RESOLUTION NO. 85-34 A RESOLUTION IMPOSING AND �TETIDING A MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS IN CERTAIN DEFINID ARE11S BY MUT[TAL AGREII��IIVT BEZ�7EEL�I THE CITY AND TI� QWNE�.S OF THE PROPERTY RECON�IDATION, GRAPEVINE I�AI� COMMIZTEE � The next item before the City Council was to consider the rec�ndation of the Grapevi.ne Lake Comnittee and take any necessazy action. �'` Council Member Spencer, Chairn�an of the Grapevine Lake Ccmmittee, review�ed conditions at the lake, specifically at Meadowmere Park. 'I�ao possibilities were considered by the Cca�tLittee to provide City regulation (1) annexation of the park or (2) leasing the park frcan the Corps of Engineers. She continued that the rec�ndation of the Cc�n¢nittee was to annex Meadc�vn�re Park into the City limits. The annexation area was reviewed as well as ordinances proposed to provide law enforcement. Police Chief H. A. Deggans and Lake Operations Manager Jerry Brite also offered supportive c�nts. Duri.ng the ensuing deliberation, it was noted that the Corps of Engineers would continue to maintain and operate the park area and provide utilities. Follawing this discussion, Council Men�r Brekken made a motion to authorize the City Staff to proceed with annexation of the Meadcx�nnere Park area. None Absent: Dyer e� PLANNING & ZONING COMMISSION RECON�TDATION PRELIMINARY PLAT OF SHADOW GLEL�T PHASE II, FINAL PLAT SHADOW GLII�T PHASE I � The next two it�ns of business, being related in nature, v,�re considered jointly. The City Council was to consider the rec�ndation of the Planning & Zoning C�ussion relative to the preliminary plat of Shadow Glen, Phase II and the final plat of Shadow Glen, Phase I (Phase I tabled fran June 18, 1985) . Shadow Glen, Phase I is located on the north side of Hughes Rr�ad and woest of Grapevine-Euless Road. Shadaw Glen, Phase II is located on the south side of Hughes Road between Baze Road and State Highway 121 South. Both tracts are zoned for "R-7.5" Single-Family development. Planning & Zoning Coirnnission Chairntian Rick Atkins reported the Comnission unanimpusly reccx�nended approval of the preliminary plat of Phase II. They also rec�nded acceptance of 2.3 acres of land and $35,000 for park develo�nent within Phase II to satisfy the open space requirements of both subdivisions. The Comnission's reco�ndation relative to the final plat of Phase I was considered on June 18, 1985, when they recon�riended approval of the final plat of Shadaw Glen, Phase I and acceptance of the additional open space in Phase II. The vote was 5 to 1. �� Discussion ensued relative to both develognents, with main topics of concern being residential street intersections with Hughes Road and the open space �, proposal. Following this deliberation, Mayor Pro Tem Ware made a motion to approve the prel�minary plat of Shadow Glen, Phase II, with 100,000 square feet of land to be dedicated for park purposes. This approval was conditional upon receipt of a letter frcgn the developer/owner agreeing to said park dedication. The motion was seconded by Council Member Spencer and prevailed by the ensuing vote: (5) 06/25/85 Ayes . Powers, Ware, Brekken, Glynn, Spencer, & Wilbanks Nays . None Absent: Dyer Council Member Brekken then offered a mr�tion that the final plat of Shadow Glen, Phase I be approved, and the requirements of Section 51 of Ordinance No. 82-73 relating to Open Space and Recreational Areas are to be partially satisfied by the payment of cash in lieu of dedication of open space or park or recreational areas and requiring the place�nent of the following statement on the face of the plat: "Developer/Owner shall pay to the City of Grapevine concurrently with the formal acceptance by the City of Grapevine of the street and utility improvements required by this plat the stBn of $35,000, which is equal to the fair market value of a portion of land that would be required to dedicated or reserved for open space or park and recreational areas pursuant to Section 51 of Ordinance No. 82-73, as amended. The balance of the requirements of said Section 51 shall be satisfied by the dedication of 100,000 square feet of land within the Shadow Glen, Phase II subdivision for open space or park and recreational areas." The Mayor was also instructed and directed to sign and approve the plat only upon satisfaction of the required statement being placed on the plat. The motion was seconded by Mayor Pro Tem Ware and prevailed. by the following vote: Ayes . Powers, Ware, Brekken, Glynn, Spencer, & Wilbanks Nays . None Absent: Dyer MISCELLANEOUS REPORTS Council Member Glynn then offered reports relative to recent meetings of the Housing Authority Advisory Board and the Golf Course P,dvisory Board. Other miscellaneous topics of discussion included the parking of recreational �► vehicles on City streets and traffic control on State Highway 121 South at TimY�erline Drive. � ADJOURI�IT The deliberations of the City Council having been concluded, a motion to adjourn the meeting was made by Mayor Pro Tem Ware and seconded by Council Member Brekken.
