PLANNER 11 DATE: APRIL 13, 2016 SUBJECT: CONDITIONAL USE REQUEST CU16-05, PLANNED DEVELOPMENT OVERLAY PD16-04 LOT 1, BLOCK 1, BRAUM'S ADDITION RECOMMENDATION Staff recommends the Site Plan Review Committee consider the proposed changes to Conditional Use Request CU12-15 and Planned Development Overlay PD12-02 approved at the May 15, 2012 meeting to allow for a restaurant with drive through service and a planned development overlay to include but not be limited to deviation from the landscape setback requirement, specifically to expand the building footprint revise the exterior elevations and revise the lot layout in conjunction with a restaurant and take any other action necessary. BACKGROUND INFORMATION Conditional Use Request CU12-15, Planned Development Overlay PD12-02 and Zone Change Application Z12-03 were approved by City Council at the May 15, 2012 meeting. The request included a zone change to rezone 14,000 square feet (.321 acres) from "PO" Professional Office District to "HC" Highway Commercial District. The request also included and conditional use request for a restaurant with drive-through service and a planned development overlay to include deviation from the landscape setback requirement. The request was to allow for a new 5,756 square foot Braum's restaurant/retail store on the subject lot with drive-through service on the west side of the structure (two windows) and two order lanes on the north side of the structure. One, ten (10) feet in height, 100 square feet in size monument sign was shown near the southwest corner of the site. Seating for 80 patrons was proposed along 3,000 square feet of the structure devoted to retail sales of various items (milk, bread, eggs, etc.). The applicant requested a planned development overlay to vary from the ten (10) foot landscaping setback requirement relative to parking/vehicle uses and adjacent properties. The applicant provided 6.5 feet along the eastern property line and 4.5 feet along the northern property line. The zone change request was to allow for 14,000 square feet along the northern portion of the site to provide the space necessary for the restaurant/retail structure and associated parking. With this request the applicant proposes the following changes: Building area: • Previous — 5,756 square feet 0:\ZCU\CU 1 6-05\PD1 6-04.4spre • Current— 5,990 square feet Building height • Previous — 22 feet, 4 inches • Current— 29 feet, 4 inches Impervious area: • Previous — 41,393 square feet • Current— 39,752 square feet Open space • Previous — 13,107 square feet • Current— 14,548 square feet Parking spaces: • Previous — 61 spaces • Current — 60 spaces • Required — 48 spaces The applicant is also requesting a planned development overlay to vary from the ten (10) foot landscaping setback requirement relative to parking/vehicle uses and adjacent properties. The applicant proposes providing 6.5 feet along the eastern property line and 4.5 feet along the northern property line. A condition of the previously approved case included the applicant working with Public Works to provide traffic control between the drive through and the handicapped parking spaces, reposition the dumpster and redesign the dumpster enclosure doors as to not impede the adjacent parking spaces. Traffic control devices have been added and the dumpster has been repositioned as shown on the dimensional control site plan. The exterior faced is revised as shown on the attached exterior elevation sheet.
