The meeting was called to order by Mayor Tate.
INVOCATION
Council Member Larry Oliver delivered the Invocation.
INTRODUCTION & PROC�DURE
Mayor Tate then introduced the members of the Planning & Zoning Cc�mnission and
reviewed the procedure to be followed during the meeting.
PUBLIC HEARING, ZONING APPLICATION Z83-42, CITY OF GRAPEVINE
The first item of business was for the City Council and Planning & Zoning
Commission to conduct a public hearing relative to Zoning Application Z83-42
submitted by the City of Grapevine.
The public hearing was declared open by Mayor Tate.
Public Works Director Jim Baddaker then reviewed the application, noting the
property in question was located on the northwest corner of Church and Nash
Street directly behind the existing Police/Library Building. The current
zoning was "R-1" Single-Family Dwelling District with the proposed zoning
being "R-3.5" 'Itao-Family Dwelling District. (The City planned a governmental
use as an additional parking lot.) It was also noted the proposed use is
consistent with the Master Plan rec�ndation.
At the invitation of Mayor Tate, there were no guests present who wished to
speak regarding the application. It was also noted that no correspondence had
been received relative to this zoning request.
There being little discussion, a motion was made by Co�mi.ssioner Harlen Joyce
that their portion of the public hearing be closed. The mQtion was seconded
by C�ani.ssion Member Gerald Norman and prevailed by the follawing vote:

The next order of business was for the City Council and Planning & Zoning
Commission to conduct a public hearing relative to Zoning Application Z83-43
submitted by Mr. I2�.idy Paniagua.
Mayor Tate declared open the public hearing.
Public Works Director Jim Baddaker advised that, due to the moratoritun
resolution, the City Council and Planning & Zoning Connussion could not
consider this zoning application as the requested zoning was inconsistent with
the Master Plan recomnended use. (Subject tract being located on the
Northeast corner of Dove Road and Worthington Street.) The notice of public
hearing had, however, been published in the newspaper prior to this discovery,
thus requiring inclusion in the agenda..
No Council or Planning & Zoning Commission action was taken.
PUBLIC HEARING, ZONING APPLICATION Z83-44, MR. RODMAN JORDAN
The ne� item before the City Council and Planning & Zoning Commission was to
conduct a public hearing relative to Zoning Application Z83-44 submitted by
Mr. R�an Jordan. �'"
The public hearing was declared open by Mayor Tate. � �.
Those in attendance were advised by Mr. Baddaker that the property to be
considered was located north of East Northwest Highway just west of its
intersection with Dooley Street. Said property being a 6.057-acre tract of
land presently zoned "C-2" Canmunity Business, with the requested zoning being
"C-OU" CcaruY�rcial Outdoor District.
Mr. Millard Dilg, representing the applicant, then requested this application
be tabled until November 15, 1983 due to some difficulties in obtaining
financing for the proposed project. ,
A m�tion was then made by Catmussion �er Shane Wilbanks and seconded by
Conm.issioner Ron Cook to accept the applicant's request and table the public
hearing on Zoning Application Z83-44 until NovP.mber 15, 1983. The m�tion
prevailed by the ensuing vote:

Nays . None

Council Member Ron Dyer also made a mption to table the public hearing on the
zoning request of Mr. Jordan until the meeting of November 15, 1983. The "��

The next order of business was for the City Council and Planning & Zoning
Commission to conduct a public hearing relative to Zoning Application Z83-45
submitted by Mr. Glen NIcC�.itcheon.

The public hearing was declared open by Mayor Tate, who called on Public Works
Director Jim Baddaker to explain the request of the applicant.
Mr. Baddaker advised the property in question was located at 708 West
Northwest Highway and was currently zoned "C-2" C�munity Business. The
applicant was requesting "C-OU" Com�ercial Outdoor zoning.
Mr. Glen NIcC�tcheon then addressed the Council and Comnission and outlined his
plans to move his business, B & G Muffler, to the above-named location and to
�� install an outdoor lift for vehicle repair.
Mayor Tate then invited those guests present to speak regarding the proposed
zoning request. No one wished to speak. It was also noted by the City
Secretary that no correspondence had been received relative to this matter.
Follawing brief discussion, Comnissioner Gerald Norman made a motion to close
the public hearing. The m�tion was seconded by Ca�nussion Member Joyce and
prevailed by the follawing vote:
Ayes . Spencer, Cook, Joyce, Norman, Pawers, & Wilbanks
Nays . None
Absent: Atkins
A motion was also made by Council Member Oliver to close the Council's portion
of the public hearing. A second was offered by Council Member Brekken, and
the motion prevailed by the follawing vote:

PUBLIC HEARING, ZONING APPLICATION Z83-46, C�NTRAL PARK DEVEL�OPMENT
The next order of business was for the City Council and Planning & Zoning
�� Comrussion to conduct a public hearing relative to Zoning Application Z83-46
submitted by Central Park Development.

Mayor Tate declared the public hearing open, and Public works Director Jim
Baddaker revie�aed the application.
Those present were advised the subject property was a 4.7-acre tract of land
located on the south side of West Northwest Highway near its intersection with
Cross Creek Drive. The present zoning was "R-1" Single-Family Dwelling
District, and the requested zoning was "P-O" Profession Office District for
the develo�zt of a three-story office building.
There being no one present to represent the applicant, a motion was made by
Conm.issioner Tom Pawers to table the public hearing on Zoning Application
Z83-46 until Nove.mber 15, 1983. A second was offered by Conmissioner RQn
Cook, and the motion prevailed by the follawinq vote:

Nays . None

A similar motion was also made by Mayor Pro Tem ware to table this public
hearing until November 15, 1983. The motion was seconded by Council Nlember

Mayor Tate then advised that the Planning & Zoning Comnission �uld recess to
the Civic Center, 311 Main Street, to deliberate the remainder of their agenda
items. The City Council was also to recess briefly before considering further
business.
The City Council reconvened nxxr�entarily in the Council Chambers with all
members present except Council Meanber Dunn.

CONSIDERATION OF � NffNUTFS
The next order of business was for the City Council to consider the minutes of
the meeting of October 4, 1983.
There being no additions or corrections, a mr�tion was made by Mayor Pro Tem
Ware and seconded by Council Member Glynn to approve the minutes as published.
The motion prevailed by the ensuing vote:

PUBLIC HEARTNG, H�2DSHIP E�TION FROM NIORATORIUM ,
GRAPEVINE SPA, POOL, & SUPPLY
The next item of business was for the City Council to conduct a public hearing
relative to application for extraordinary hardship exemption fran moratorium
sub�itted by Mr. Tim Bc�wling representing Grapevine Spa, Pool, & Supply and
consideration of same.
The public hearing was declared open by Mayor Tate, who then outlined the
procedure to be followed.
Public Works Director Jim Baddaker noted that an application for extraordinazy
hardship exemption fran the moratorium, as provided in Resolution No. 83-34,
had been received from Grapevine Spa, Pool, & Supply. The tract of land which
is included in the mpratoritan area is located at 919 West Northwest Highway
and is currently zoned "SP" Specific Use Perniit District for the retail sale
of spas and pools and providing certain conditions, all in accordance with a
site plan, and further providing all other uses in the "C-2" ComYnznity
Business District Category. The Master Plan recamnends law intensity
office/can�ercial use of this property.
Follawing Mr. Baddaker's presentation of the details of this application, "�`�
those persons who wished to testify during the public hearing were sworn in
by the City Secretary.

Mr. T�m Bowling, representing Grapevine Spa, Pool, & Supply, then addressed
the City Council. He noted they wished to build a warehouse-type storage
building to the rear of said tract of land. This building was to store
equi�xrent and supplies and was also to house an additional office. He also
reviewed actions taken to develop the property in this manner.
Various exhibits relative to said development were then entered into the record
and accepted by Mayor Tate.
Follaaing this presentation, Council discussion was in order and n�rous
questions were asked of Mr. Bawling. This discussion included concern
relative to the applicant's expexiditures prior to August 2, 1983, and whether
the proposed building was to be considered a principle use or an accessory use
of the property.
The Mayor then asked if there were any persons present who wished to make a
statement relative to the hardship application. No one wished to speak. It
was also noted that no correspondence or petitions had been received.
A motion was then made by Mayor Pro Tem Ware to close the public hearing. A
second was offered by Council Member Glynn, and the mr�tion prevailed by the ""�'`
follvwing vote:

The City Council did then deliberate the merits of the hardship request for
waiver of the building permit mr�ratori�n.
A subsequent motion was made by Council Nlember Dyer that the application for
extraordinary hardship exemption for the moratoritun submitted by Grapevine
Spa, Pool, & Supply be denied. T'he motion was seconded by Council Me.mber Jim
Glynn and prevailed by the following vote:

The next item of business was for the City Council to conduct a public hearing
relative to application for extraordinary hardship exemption fram m�ratorium
submitted by Mr. Rick Reutlinger and consideration of same.

Mayor Tate declared the public hearing open.
Public Works Director Jim Baddaker advised that an application for
extraordinary hardship exemption from the moratori�un, as provided by
Resolution No. 83-34, had been submitted by Rick Reutlinger on October 4,
1983. The property illustrated in the application is located at 303 west
Northwest Highway and was zoned in June, 1983 for "S-P" Site Plan District for
a veterinary hospital, avernight boarding of animals during treat�nent only,
and also included all other uses in the "C-C" C�rnznity Co�rcial District.
The reco�ndation of the Master Plan Update 1980 was for low intensity
office/coirrtnercial use of subject property.
Mr. Baddaker presented additional details relative to this application, and

building permit had been issued to Mrs. Vance for the purpose of adding a
bathroom to the downstairs of a tawnhome, said addition being considered an ���
accessory structure to the principle use of the property and, thus, allawed

Mr. Baddaker also stated the notice of public hearing for this application had
been advertised and, therefore, it had been included as an agenda item.

had submitted an application for extraordinary hardship exemption fram the
moratoritnn, as provided by Resolution No. 83-34, on October 6, 1983. The
property in question is located on the west side of Park Boulevard, directly
south of the existing Woodlake Apartm�xit develo�xnent. C�.irrently the tract is
zoned for a Specific Use Permit for multi-family dwellings and provides for
the number of units not to exceed 16 units per acre. The use of the property
as rec�nded by the Master Plan is for meditun density residential.

Mr. Barry Knight, representing the applicant, displayed an artist's rendering
of the present multi-family development and outlined the six points noted on
the application. He reviewed the zoning history, the existing develo�xit,
and the proposed development of the 26-acre tract. F�hibits presented by Mr.
Knight were also entered into the record and accepted by the City.
During the ensuing Council discussion and inquiry, Mr. Knight requested the
public hearing be tabled to allaw him to bring documented evidence before the
City Council.

Property. It is my belief that their property should be left under

currently the Dove Rd. project needs to be completed before any more
,�_,� permits are issued in the areas west of Park Blvd. to the city
limits and north of Dove Rd. The city desperately needs to wr�rk
with Southlake and the county to widen and resurface Kimball Rd.
fran Hwy. 114 to Yates Corner before any m�re building is allawed.
Lastly I w�ould encourage the city to place a fee of $1000.00 on each
single family building permit and $300.00 per unit on each
apartrrent co�lex. This money should be xeserved for street, water,
and sewer improvements. It seems only fair for the developers to
pay these fees for expansion instead of placing the burden on
current tax payers.

The next item to be considered by the City Council was an ordinance relative
to a taxicab franchise (M�etropolitan Transportation Services, Inc.) , first
reading.
The caption of the proposed ordinance was presented by the City Secretary.
Assistant City Manager Bill Eisen reported that a proposed franchise agreemer�t
had been negotiated with Metropolitan Taxi, which included the follvwing
provisions:
�"`'� 1. The length of the franchise shall be five years with an option
to renew for an additional five years if both parties agree.

2. Metropolitan Taxi shall be authorized to aperate up to 120 cabs
in the City of Grapevine.
3. M�tropolitan Taxi shall operate under the provisions of Chapter
22 of the City Code pertaining to regulation of taxicabs.
A second reading of this ordinance is also required by the City Charter, said
reading being 30 days after the first reading.

', been received. He advised that said bids had now been received, with lowest

identified.

execute an agreement with Standard Insurance Ccx�any for the provision of

parking lot.
Public Works Director Jim Baddaker reported that bids had been received for
renovation of the upstairs of the Police/L�brary Building and construction of
the adjacent parking lot. He noted the low bid on the parking lot project was
received fran Seva Corporation in the amount of $54,153.62, and the law bid on
the building project was received fram Cardinal Builders in the amr�unt of
$335,000. He further elaborated on the qualifications of these finns.
Council M�.mber Larry Oliver, Chairmari of the Municipal Facilities Committee,
affirmed the Staff reco�ndation for awarding the bid for the parking lot
construction to Seva Corporation in the amount of $54,153.62. He also noted "*�"'�

Estates had requested that 5' of the existing right-of-�aay along these lots on
Dunn Street be abandoned by the City. He added that this portion of
right-of�aay was no longer needed, and the Staff recomnended the City Council
approve the ordinance to abandon and vacate said property.
