The meeting was called to order by Mayor Tate.
INVOCATION
Council Member Ron Dyer then delivered the Invocation.
INTRODUCTION & PR(�EDURE
Mayor Tate outlined the procedure for the evening and then introduced the
members of the Planning & Zoning Conmission.
PUBLIC HEARIl�IG, ZONING APPLICATION Z83-29, DAYSPRING DEVEL�OPMQ�TI' CORPORATION
The first item of business was for the City Council and Planning & Zoning
Commission to conduct a public hearing relative to Zoning Application Z83-29
submitted by Dayspring Development Corporation.
The public hearing was called to order by Mayor Tate.
City EYigineer Jim Baddaker advised that the property in question was located
on the southwest corner of Highway 121 and Hall-Johnson Road, containing
""'�"" approximately 46 acres. The current zoning was for "R-1" Single-Family
Dwelling District and "C-2" CormYunity Business District, with the requested
land use being "R-MF-2" Multi-Family District.

Mr. Dan Majors, a realtor and developer with the firm of Majors-LeBlanc in
Dallas, then presented an analysis of the site and the proposed land use and
development.
Following questions frcgn the Council and Planning & Zoning Canmission, Mayor
Tate invited those present to speak either for or against the zoning change
request. Ms. Laura Thomas, 4242 Cheek-Sparger Road, and Ms. Clara Fuller,
both neighboring property awners, spoke in opposition to the proposed land
use. There was no correspondence received relative to this zoning applica-
tion, as reported by the City Secretary.

I, There being no further discussion, Planning & Zoning Commission Member Gerald
Norman made a motion to close their portion of the public hearing. The mption
was seconded by Vice Chairman Ron Cook and prevailed by the follc�wing vote:

Council Member Ron Dyer then made a motion to close the Council's portion of
the public hearing. A second was offered by Mayor Pro Tem Ware, and the ��

The ne�t order of business was for the City Council and Planning & Zoning
Commission to conduct a public hearing relative to Zoning Application Z83-30
submitted by Mr. Nyle Mann.
Mayor Tate declared the public hearing open and called on City Engineer Jim
Baddaker to explain the request of the applicant.
Those present were informed the property to be considered was the pier located
on Lake Grapevine at Scott's Landing Marina in Oak Grove Park. The present
zoning allawed on-premise cons�tion of alcoholic beverages incidental to the
operation of a restaurant, with the requested zoning being for (1) on-premise
consw�tion of alcoholic beverages incidental to the operation of a restaurant
and (2) off-premise consLmrption of alcoholic beverages incidental to the
operation of a convenience store, all as sha�m on a site plan.
Mr. Nyle Mann then addressed the Council and Planning & Zoning Con�nission,
presenting his proposal for the property in question.

Questions frcgn the Council and Canmission follawed, after which Mayor Tate �--
invited those present to speak regarding the application. No one wished to �,,,,,�
' make a statement. It was also noted that no correspondence had been received
relative to this matter.
Commissioner Gerald Normazl then made a motion to close their portion of the
public hearing. The mption was seconded by Comnission Member Tcan Powers and
prevailed by the follawing vote:

A motion was also made by Council �er Oliver to close the Council's portion
of the public hearing. The motion, seconded by Council Member Brekken,

PUBLIC HEARING, ZONING APPLICATION Z83-31, JOHrII�1IE HIGH
The next order of business was for the City Council and Planning & Zoning
Conmission to conduct a public hearing relative to Zoning Application Z83-31 "'�"`
submitted by Mr. Johnnie High.
The public hearing was declared open by Mayor Tate, who then called on ��
Mr. Baddaker to review the application.
Mr. Baddaker advised this application involved a strip of land running from
Barton Street to Church Street just south of West Texas Street for which the
awner was requesting perntission to construct mini�warehouses in addition to
those already in use at this site.
Mr. Lee Seeton, representing the applicant, then addressed the Council and
Commission, advising that the awner wished to build additional mini-warehouses
along a portion of the north property line. The additional storage units were
to be identical to those already in place.

Brief discussion follawed, after which the Mayor invited those present to
voice their opinion regarding this matter. Marge Boland, owner of Grapevine
Children's Academy at 221 W. Texas, and Josie Ferris, 317 Church Street, both
spoke in opposition to the requested zoning. The City Secretary also reported
receipt of a letter of opposition fram Clinton M. Berry, 215 Church Street,
and a letter of opposition signed by six neighboring property awners. She
noted that over 200 of the surrounding property within 200' was awned by
persons in opposition to the zoning request, thus requiring a 3/4 vote of the
City Council to approve the application.

A mr�tion was then made by Commissioner Tcan Pawers to close their portion of
the public hearing. The mr�tion was seconded by Coimiissioner Gerald Norman and

Council Member Marion Brekken made a mc�tion to close the Council's portion of
the public hearing. The motion, seconded by Council Member Dyer, prevailed by

The next order of business was for the City Council and Planning & Zoning
Conmission to conduct a public hearing relative to Zoning Application Z83-32
submitted by the DFW Airport Hilton Hotel.
The public hearing was declared open by Mayor Tate.
City Ehgineer Jim Baddaker advised that the Hilton Hotel, located at 1800
�'""' Highway 26 East, was currently zoned for "SP" Specific Use Permit District
?� allaaing on-premise constunption of alcoholic beverages incidental to the

operation of a hotel/conference center, and providing other amenities. At
this time, hotel management wished to revise the site plan to add a maximum of
15 coinroperated game machines and 2 pool tables.
It was then noted that neither the applicant nor his representative were
present at the meeting and continuation of the public hearing at a later date
was suggested.
Comnission Member Tom Pawers then made a mQtion to table the public hearing of
Zoning Application Z83-32 until September 20, 1983. The motion was seconded
by Coimtissioner Ron Cook and prevailed by the follawing vote:
Ayes . Spencer, Cook, Norman, Pawers, & Wilbanks
Nays . None

A motion was also made by Council M�ember Jim Glynn to table the public hearing
of Zoning Application Z83-32 until September 20, 1983. A second was offered

�. The next order of business was for the City Council and Planning & Zoning
Commission to conduct a public hearing relative to Zoning Application Z83-33
submitted by Sunwest Properties.
Mayor Tate declared the public hearing open.
Mr. Baddaker reported the property in question was located on the southwest
corner of Highway 26 and William D. Tate Avenue and is currently zoned "R-1"
Single-Family Dwelling District with the requested zoning being for "C-C"
Community Camrercial Zoning.

Mr. William C. Bell of the engineering firnl of Carter & Burgess ttien presented
their proposal for development of said property, noting that they intended to
build an office park complex on this site.
At the invitation of Mayor Tate, no one present wished to speak either for or
against the zoning application. It was also reported that no correspondence
had been received regarding this matter.
There being little discussion, Canmissioner Shane Wilbanks then moved to close
the Planning & Zoning Ccm�nission portion of the public hearing. The motion ��
was seconded by Conmission Nl�mber Gerald Norman and prevailed by the follawing

PUBLIC HEARING, ZONING APPLICATION Z83-34, BOB TAYLOR
The next order of business was for the City Council and Planning & Zoning
Conmission to conduct a public hearing relative to Zoning Application Z83-34
submitted by Mr. Bob Taylor.
Mayor Tate declared open the public hearing and called on City Engineer
Jim Baddaker to explain the request of the applicant.
Those present were advised the subject property is located on the east side of
Highway 121 midway between Timberline Drive and Hall-Johnson Road. Current ���
zoning on the tract is "R-1" Single-Family D�lling District with requested
zoning being for "M-FW" Freeway District. ,��
Mr. Bob Taylor then stated his purpose in choosing this tract of land and
answered inquiries from the City Council and Planning & Zoning Canmission.
Follawing the invitation of the Mayor, no one present wished to speak
regarding this application. The City Secretary also reported that no
correspondence had been received relative to Zoning P,pplication Z83-34.
There being little discussion, Conmission Member Gerald Norman moved to close
their portion of the public hearing. The motion was seconded by Commissioner
Ron Cook and prevailed by the following vote:

The next order of business was for the City Council and Planning & Zoning
Cammission to conduct a public hearing relative to Zoning Application Z83-35
submitted by Ms. Patti Hoff.
The public hearing was declared open by Mayor Tate.
Mr. Ba.ddaker reported the subject property involved. approximately 105 acres
located east of Highway 121 and north of Hall-Johnson Road. C�.irrently the
tract was zoned "R-1" Single-Family Dwelling District with requested zoning
being "S-P" Site Plan for a single-family, attached condominitun comnunity with
amenities.

Mr. Clyde Hueppelsheuser, representing the applicant and other property
awners, advised those present of their proposal for a private comrn�nity of
condominituns and single-family, attached homes. The proposal also provides
land designated for private recreational facilities.
The ensuing discussion centered around density per acre, how said density was
computed, and the reasoning for Site Plan Zoning versus Planned Unit
Develo�anent.
,�. Only one person present wished to speak relative to this zoning request;
Ms. Laura Thomas, 4242 Cheek-Sparger, spoke in opposition to the proposed land
use. City Secretary Karen Spann reported no correspondence had been received
� concerning this application.
Commissioner Ron Cook then made a m�tion to close their portion of the public
hearing. The motion, seconded by Comnission N1�mber Tan Pawers, prevailed by
the following vote:

Council Member Oliver also made a motion to close the Council's portion of the
public hearing. A second was offered by Council Member Jim Glynn, and the

CITIZE[�1S REQUESTS
Laguna Vista Homeawners
Dr. Lee Dodson, 1309 Laguna Vista, representing the Laguna Vista Area
�`� Homeawners' Association, then presented the follaving petition containing 123
� signatures and spoke in support of the Master Plan implementation.

This petition is to shaw our support for the implementation of the
Master Plan. The Laguna Vista Area Homeawners Association wish to
support the Master Plan calling for single family zoning on the
52.067 acres located on Dove I,00p Road north of Marina Del Rey
Apartm�nts. This acreage is currently zoned for developm�azt of
multifamily and an office tawer.

Mr. Danny King, 808 Hummingbird, then addressed the Council and respectfully
requested that the flying of model ai.rplanes be allawed in the Oak Grove Park
facilities.
The Vineyard Homeowners
A representative of the Vineyard Homeawners' Association, Mr. Johnny Rogers,
#5 Windy Knoll, then e�ressed their encouragement for and support of a
�* possible implem�ntation of the Master Plan and suggested a building mpratoritun
also be considered.
,,,�„ Park Place Homecx�mers
Mr. David Cunningham, 1822 E�erglade Court, also spoke representing the Park
Place Homeawners' Association. He encouraged the City Council to pursue
implementation of the Master Plan and expressed their support of such action.
Russwood Estates Homec�nmers

to, can assure quality growth for us all.
We think a moratoritun on develo�nt of land which does not follaw
the master plan is necessary until a master plan ordinance is

ORDINANCE, RESTRICI'ING USE OF PARK FACILITIES
The next order of business was for the City Council to consider an ordinance
am�nding the City Code relative to Parks & Recreation.
Kevin Conklin, Director of Parks & Recreation, then outlined the proposed
ordinance, which would (1) prohibit motor vehicle traffic except in
specifically designated areas; (2) prohi.bit golf practice in all park

facilities; and (3) prohibit flying pawered model airplanes in all park
facilities. He also noted several problems which have occurred or are likely
to occur in the future as a result of the aforementioned activities.
The caption of the proposed ordinance was read by the City Secretary.
A lengthy discussion ensued, during which it was the general consensus of the
City Council that such an ordinance might severely limit park activities.
Council Memb�r Charles Dunn then made a motion to table consideration of this
item and refer the matter to the Parks & Recreation Board for their input and
' revision. A second was offered by Mayor Pro Tem Ware, and the m�tion

FUNDING AGREII�NT, IBM SYS'I�I 36 COMPUZ�R
The next item before the City Council was consideration of a resolution
authorizing the City Staff to execute a funding agreement for an IBM System 36
ccxr�uter.
Mr. Lee Maness, Director of Finance, reported that Municipal Funding
Corporation of America was to finance the new IBM System 36 computer, the
purchase of which was approved by the City Council on June 7, 1983. He then
reviewed the proposed contract, which provided for 36 monthly paym�its of
$1,820.46 and a sim�le interest rate of 10.5�, and added the total cost of the
system was $56,500.
It was also noted the computer naw in use, an IBM System 34, was to be
transferred to the Police/Library Building for police, library, and municipal
court records.

Assistant City Manager Bill Eisen outlined the application for participation
in the Texas Main Street Program and noted the efforts of the Chamber of
�r Comrerce Historical Affairs and Beautification Committee in com�leting the
application and obtaining supplemental information. The application should be
submitted to the Texas Historic Commission in early Septe.mb�r, and the City
Staff rec�nded approval of a resolution authorizing the application, with
funds for a Project Manager being obtained from Hotel/Nbtel Tax proceeds.

The following item of business was for the City Council to consider setting a
date for public hearing relative to a taxicab franchise application.
City Secretary Karen Spann reported that an application for a taxicab
franchise had been received fram Metropolitan Transportation Services, Inc.
She noted the City Staff w�uld investigate the application and study possible
City Code amenchr�ents relative to a taxicab franchise and report to the Council
at a later date. The Staff did, hawever, recom��nd that a public hearing on
this matter be set by the City Council for Septe�nber 6, 1983.
A motion was then made by Council Me,mber Larry Oliver that a public hearing to
consider the taxicab franchise application of Metropolitan Transportation
Services, Inc, be set for September 6, 1983. The motion, seconded. by Mayor

Paniagua had submitted an application and was to be considered for appointsnent
at this time. She added that the vacant term expires in April, 1984.
There being little discussion, Council Member Brekken made a motion that
Ft�idy Paniagua be appointed to fill the vacant term on District 2 of the

The ne�t item of business was for the City Council to consider authorizing the
City Staff to execute an agreement relative to pipeline relocation on the
Timberline Drive reconstruction project.
City Manager Jim Hancock reported that an estimate had been received fran the
Amber Pipeline co�any for relocation of their petroletun pipeline relative to
the Timberline Drive reconstruction project. The estimate was in the amount ""�'"
of $18,964.50.
It was noted during the ensuing discussion that the pipeline easement had been �...,-�
received several years prior to the dedication of rightrof�way for street
purposes. Concern was also expressed for the suspected high cost of the
estimate.
Follawing lengthy deliberation, City Attorney John Boyle suggested that a
resolution could be considered which w�uld provide for negotiation with A��ber
Pipeline Ccx�rpany for vacation of the easement and relocation of the pipeline
at the best possible price.

City Engineer Jim Baddaker reported that the proposed plat covers
approximately 4 acres of land located on the north side of Timberline Drive
between the Memorial Baptist Church and Oak Creek Estates and does confornn to
City Code requirements. The Planning & Zoning Canmission unanimr�usly
recormiended approval of the plat on July 19, 1983. Mr. Baddaker also noted
the 30-day limitation for Council action would expire on August 19, 1983.
There being little discussion, Mayor Pro Tem Ware made a motion to approve the
final plat of Timbercreek Village. A second was offered by Council Ntember
