City Council to consider the establishment of a moratorium on the issuance of building per- mits and the processing of subdivision plats while the zoning case is pending for a period of time not to exceed ninety (90) days . � IV. City Secre y � ;� STATE OF TEXAS COUNZY OF TARRAIVT CITY OF GRAPEVINE The City Council of the City of Grapevine, Texas met in S�ecial Session on this the 9th day of November, 1982 at 7:30 p.m, in the Council Ch��mbers, 413 Main Street, with the follawing persons present to wit: �.,, William D. Tate Mayor Ted R. Ware Mayor Pro Tem C. L. Oliver Council Member � Marion Brekken Council Member Ron Dyer Council M�ember constituting a quonun with Council �ers Charles Duruz and William Shafer absent, with the follawing members of the City Staff: James L. Hancock City Manager Bill Eisen Assistant City Manager John F. Boyle, Jr. City Attorney Shirley Armstrong City Secretary CAL.L TO ORDER Mayor Tate called the meeting to order. INVOCATION The Invocation was delivered by Mayor Pro Tem Ted Ware. CITIZEL�TS REQUESTS Mayor Tate advised that Mr. Ross Foster, 3908 Deepwood, Colleyville, Texas, an �"" attorney representing Miller of Texas, had requested permission to address the f ; Council. � � Mr. Foster advised the Council that he was concerned about the possibility of the City of Grapevine instituting a zoning case and rezoning properties within the City that were awned by his client. He suggested that the Council make certain a substantial change of circtnnstances or a public necessity existed regarding subject properties prior to supporting a zoning change. The Council took no action regarding Mr. Foster's co�nts. ZONING CASE, INSTITUTID BY THE CITY OF GRAPEVINE The first order of business was for the City Council to consider instructing the City Staff to institute a zoning case under the City's Co�rehensive Zoning Ordinance No. 82-73, enacted November 2, 1982. A lengthy discussion then ensued ampng members of the Council concerning the approach to the item being considered. Follawing the discussion, Council Nlemb�r Brekken made a motion to refer the matter to the Planning & Zoning Conanission requesting that a rec�ndation of approximately twelve tracts of land for rezoning consideration be proposed to the Council during their meeting of November 16. The motion was seconded by �"'" Mayor Pro Tem Ware and prevailed by the follawing vote: Ayes . Tate, Ware, Oliver, Brekken, & Dyer �r.r Nays . None Absent: Duruz & Shafer MORATORIUM ON PROPERTY FOR REZONING The next order of business was for the City Council to consider the establish- ment of a moratoritun on the issuance of building permits and the processing of subdivision plats while the zoning case is pending for a period of time not to exceed ninety days. 11/09/82 In view of the previous irotion, Mayor Pro Tem Ware made a motion to table consideration of the item. The motion was seconded by Council Member Oliver and prevailed by the follawing vote: Ayes . Tate, Ware, Oliver, Brekken, & Dyer Nays . None Absent: Dunn & Shafer MISCEIZANEOUS REPORTS AND/OR DISCUSSIONS w�.�, Developers Larry Lightner and Joe Wright both addressed the Council expressing concern relative to the possibility of a City instigated zoning case, the ' manner in which it would be handled, and the effect it could ha.ve on their ,,,�,�; business. Mayor Tate thanked the guests for their attendance and concern. No formal action was taken regarding the statemPaZts made.
