Texas met in Joint Special Session on this the 4th day of May, 1982, at
7:30 p. m, in the Council Chambers, 413 Main Street, with the following

The meeting was called to order by Mayor Tate.
INVOCATION
Dr. Mark Woods of Memorial Baptist Church delivered the Invocation.
INTRODUCTIONS AND PROCIDURES
Mayor Tate then introduced the m�ribers of the Planning & Zoning Comnission and
explained the procedure to be follawed during the public hearings.
PUBLIC HEARING, ZONING APPLICATION Z82-18, MAYFIELD
The first order of business was for the City Council and Planning & Zoning
Comnission to conduct a public hearing on Zoning Application Z82-18 submitted
by John E. b7ayfield.
Mayor Tate declared the public hearing open and called upon City Planner Marc
Guy to explain the request of the applicant. Those in attendance were advised
that the property in question was 120 North Main Street. He further advised
""�`� that the current zoning was for a Specific Use Permit for on-premi_se
consw�tion of alcoholic beverages incidental to the operation of a restaurant
(in accordance with a site plan) and for all other uses in the Co�rnnzity
Business Zoning Category. Mr. �iy co�nted that the requested zoning was the
same, but included a revised site plan and a request for four skill or
coin-operated machines and two billiard tables.
Mr. Mayfield then addressed the Council, reviewing the site plan and answering
questions relating to the amended operation.
Mayor Tate then asked if there were guests present to speak for or against the
application. Mr. Nlillard Dilg, awner of the property in question, asked for
favorable consideration.

The City Secretary then reported that one letter had been received fran Mr.
Jim Ann.strong, neighboring property awner within 200 feet, expressing
favoritism of the requested zoning.
There being no further discussion, Planning & Zoning Comnission �er Harlen
Joyce made a motion to close their portion of the public hearing. The mption
was seconded by Nlember Gerald Norman and prevailed by the follawing vote:

PUBLIC HEARING, ZONING APPLICATION Z82-19, FI�7WERS
The next order of business was for the City Council and Planning & Zoning
Commission to conduct a public hearing relative to Zoning Application Z82-19
submitted. by Dean A. Flawers.
Mayor Tate declared the public hearing open and asked the City Planner to
explain the request of the applicant. Mr. Guy advised that the property in
question was a 13.7-acre tract out of the H. Suggs and J. Gibson Surveys,
which was presently zoned "R-1" Single-Family Dwelling District. He added
that the requested zoning was for "I-1" Light Industrial District Category.
A presentation was then made on behalf of the applicant, during which few
questions were asked fran members of the City Council and Planning & Zoning
Conunission.
Mayor Tate asked if there were guests to speak in regard to the requested ''""°'"
zoning. There were none. �

The City Secretary reported that she was not in receipt of any correspondence
regarding the matter.
There being no further discussion, Planning & Zoning Canm.ission Member Klee
Hawkins made a motion to close their portion of the public hearing. The
motion was seconded by Nlember Ann Glynn and prevailed by the follawing vote:

The next order of business was for the City Council and Planning & Zoning
Comnission to conduct a public hearing on Zoning Application Z82-20 submitted
by Mr. William M. Paris. +�*
Mayor Tate declared the public hearing open, after which City Planner Marc Guy
explained the request of the applicant. He noted that the property in ��.ko-�
question (Scott's Landing Marina) in the W. P. Herring Survey was presently
zoned Specific Use Permit far an-premise cons�tion of alcoholic beverages
relating to a restaurant, in accordance with a site plan, and other uses in
the "C-1" Neighborhood Business District. He further noted that the request
was for the same zoning, with a revised site plan, including catering services
and the operation of twelve skill or coinroperated machines.
Mr. Paris then addressed the Council, during which numerous questions were
asked relating to fire protection and the site plan arrangement.

application. There were none. The City Secretazy reported that she was not

PUBLIC HEP,RING, ZONING APPLICATION Z82-21, WIDE�TER
The next order of business was for the City Council and Planning & Zoning
Commission to conduct a public hearing on Zoning Application Z82-21 submitted
by Mr. James Widener.
Mayor Tate declared the public hearing open and asked Mr. �iy to explain the
request of the applicant. Those in attendance were advised that the property
in question was a 9.8-acre tract out of the A. Foster Survey, located
generally west of Ball Street and east of Highway 121. They were advised that
the present zoning was "R-1" Single-Family with the requested zoning being for
"C-2" Conurnznity Business District Zoning Category.
Mr. Widener then addressed the Council explaining the proposed use of the
property.
"""�"' There was then a lengthy discussion during which members of the City Council
�' and Planni.ng & Zoning Canmission asked numerous questions relating to
;� ingress/egress, screening fences, parking facilities, proposed use, and
existing utility easements.
Mayor Tate then asked if there were guests present to speak for or against the
application. Mr. J. T. Rogers, Mr. Jake Grable, and an unidentified guest
(all residents on Ball Street) spoke in opposition to the requested zoning,
primarily because of the proximity of the property in question to a
residential neighborhood.
Mr. Jesse Woods made a statem�nt to the Council about the irrelevancy of a site
plan if a zoning category of "C-2" Conanercial Business District is granted.
The City Secretary then reported that she was in receipt of two letters, one
fran 'I'exas Power and Light Company and one fr� Mr. Guy Kelley, both
neighboring property awners within 200 feet, advising that they had no
opposition to the requested zoning.
There being no further discussion, Planning & Zoning Canmission Mez�r Ann
Glynn made a motion to close their portion of the public hearing. The motion
was seconded by Nlember Harlen Joyce and prevailed by the follcxaing vote:

The next order of business was for the City Council and Planning & Zoning
Co�nission to conduct a public hearing relative to the replat of Lots 1 & 2,
Block 107, College Heights Addition.

City E,hgineer Jiri Baddaker reported that the replat would simply combine Lots
1 and 2 into one lot. He added that the replat w�uld meet all requirements of
the City and that the City Staff recomnended approval.
Mayor Tate asked if there were guests present to speak in regard to the
replat.
Ms. Willie Mae Hawkins spoke in opposition to the construction of an apartment
c�lex on the site, but was advised by Mayor Tate that the purpose of the
hearing was to consider the replat and not for zoning purposes. There were no �*�
other guests present who desired to speak.
The City Secretary reported that she was not in receipt of any letters or �,.,,
petitions regarding the matter.
There being no further discussion, Planning & Zoning Comnission Member Harlen
Joyce made a motion to close their portion of the public hearing. The motion
was seconded. by Nlember Ron Cook and prevailed by the follawing vote:
Ayes: Spencer, Cook, Joyce, Glynn, Norman, Hawkins, & Pawers
Nays: None
Councilman Shafer then made a motion to close the Council's portion of the

Housing Advisory & Appeals Board and Uniform Building Code of Appeals
Mayor Tate advised that one appointment needed to be ma.de to the Housing
P,dvisory & Appeals Board and the Uniform Building Code of Appeals.
Council Member Brekken made a mption that Tibor Penzes be appointed. The
motion was seconded by Councilznan Dyer and prevailed by the folla�ing vote:

relating to Austin Patio Dude Ranch zoning case.
The City Secretary read the caption of the proposed zoning ordinance advising
that a maxirrnun number of coin-operated machines needed to be inserted into the
ordinance.
Mayor Pro Tem Ware made a mr�tion that the ordinance be adopted with a maxirrnam
of ten coin-operated machines. The motion was seconded by Counci]man Shafer
and prevailed by the follawing vote:

The next order of business was for the City Council to consider the extension
of the marketing agreement with Municipal Software.

City Manager Jim Hancock advised the Council that the current contract with
Municipal Software Consultants is for a term of three years and a royalty fee
, of twenty-five percent (25�) of the application software sales price. He
' added that the president of the firm, Mr. David Johnson, had requested a
', 5-year contract with a twenty-two percent (22�) royalty fee to the City of
I Grapevine for all sales thereafter. The Council was advised that it was the
' recommendation of the City Staff that the contract be extended as outlined.
�'I Following a short discussion, Councilman Oliver made a motion to authorize the
� City Staff to enter into an extended contract with Municipal Software ,.��,
', Consultants as reconanended. The motion was seconded by Counci]ma�z Dunn and
'�, prevailed. by the follawing vote:

�!, The next order of business was for the City Council to consider an ordinance
', relating to water and sewer rates.
�, City Manager Jim Hancock gave a brief history relating to the need for a rate
�, increase in water and sewer rates.
I�� Mr. Tony Reed, Freese & Nichols Engineering Firm, then presented a review of
i water and sewer rates, April, 1982, and recom�xided an increase in rates
'I accordingly. The Council then reviewed the proposed increase schedule.
The City Secretary then read the caption of the ordinance incorporating the
rec�nded rates.
Councilm��n Oliver, Chairman of the Utility Connnittee, then gave a brief report
recommending the increase.
A motion was then made by Councilman Oliver to adopt the ordinance w*�►
implementing the water rate schedule showing increased mininnmt with two steps �
and the sewer rate schedule reflecting revised minim�un with a flat rate. The

III The next order of business was for the City Council to consider an ordinance
abandoning a portion of a sewer line easement on IAt 21, Block 4, Parra L�.nda

Mr. Baddaker advised that the house on the lot in question was encroaching on ��
