HomeMy WebLinkAboutORD 1989-078 ORDINANCE NO. 89-78 AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, AMENDING ORDINANCE NO. 82-73, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS APPENDIX "D" OF THE CODE OF ORDINANCES OF THE CITY OF GRAPEVINE, TEXAS, BY PROVIDING �-� FOR AMENDMENTS AND CHANGES TO ZONING REGULATIONS BY AMENDING SECTION 12 DEFINITIONS; BY AMENDING SECTION 25 "CC" COMMUNITY COMMERCIAL DISTRICT REGULATIONS; BY AMENDING SECTION 31 "LI" LIGHT INDUSTRIAL DISTRICT REGULATIONS; BY AMENDING SECTION 48 CONDITIONAL USES; BY AMENDING SECTION 49 SPECIAL USE PERMITS; BY AMENDING SECTION 53 LANDSCAPING REGULATIONS AND BY AMENDING SECTION 60 SIGN STANDARDS; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2, 000. 00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That Ordinance No. 82-73, the Comprehensive � Zoning Ordinance of the City of Grapevine, Texas, same being also � known as Appendix "D" of the Code of Ordinances of the City o Grapevine, Texas, is hereby amended in the following particulars, � and all other sections, subsections, paragraphs, definitions, words and phrases of said Appendix "D" are not amended but are hereby ratified, verified, and affirmed: A. That Section 12 Definitions is hereby amended by adding a definition to read as follows: � "365 . Reverse frontage lots shall mean a corner lot, the rear of which abuts the side of another lot. B. That Section 25 relative to "CC" Community Commercial District Regulations is hereby amended by adding Section 25 .C. 14 to read as follows: "14 . Outdoor commercial amusements such as golf driving ranges, miniature golf, archery. C. That Section 25 relative to "CC" Community Commercial District Regulations is hereby amended by amending Section 25 .G. 1 and 25 .G. 2 to read as follows: � '""� "1 . Lot width-Every Lot shall have a minimum width o one hundred twenty (120) feet. �� 2 . Lot depth-Every lot shall have a minimum depth of not less than one hundred twenty (120) feet. " C. That Section 31 relative to "LI" Light Industrial District is hereby amended by amending Section 31 Purpose to read as follows: "PURPOSE: The LI Light Industrial District is designed to accommodate light manufacturing, assembly, research and wholesale activities with limitations on outdoor storage. " D. That Section 31 relative to "LI" Light Industrial District is hereby amended by adding Section 31 .A. 4 . to read as follows: "4 . Other manufacturing, research, wholesale or storage uses provided that such uses shall be contained within an enclosed building. " E. That Section 31 relative to "LI" Light Industrial District is hereby amended by adding Section 31.A. 15. to �° � read as follows: "15. Welding repair completely within an enclosed building with no outside storage. " F. That Section 31 relative to "LI" Light Industrial District is hereby amended by amending Section 31 .B. 3. and 31 .B. 4 . to read as follows: "3 . Screened refuse and garbage storage on a concrete pad, no nearer than fifty (50) feet to a residentially zoned district. "4 . Outside storage, provided that such storage shall be completely encompassed by a blind fence or wall at least seven (7) feet high and provided that materials stored shall be stacked no higher than one foot below the top of the fence or wall. No accessory outside storage is permitted for uses listed in Section 31 .A. 4 . , 7 . , 13 . , and 15 . G. That Section 31 relative to "LI" Light Industrial District is hereby amended by adding Section 31 .C. 9 . to read as follows: "9 . Any other manufacturing, warehousing, or wholesale ""�' uses, not provided for in Section 31 .A. Permitted Uses, Section 31 .0 Conditional Uses , and not listed �„ in Section 31 .D, Limitation of Uses. H. That Section 31 relative to "LI" Light Industrial District is hereby amended by adding Section 31 .D. 10 . , 31 .D. 11 . and 31 .D. 12 . and renumbering accordingly to read as follows: "10 . Saw and planing mills. 11 . Primary production or storage of wood, metal, or chemical products from raw materials. 12 . Foundry type operations. 13 . Any other uses or structures not specifically, provisionally, or by reasonable implication permitted herein. 14 . Any use not conforming to the performance standards set forth in Section 55 of this Ordinance. " I . That Section 48 relative to Conditional Uses is hereby amended by amending Section 48 .F. 3.b. to read as '�� follows: "b. the nature and extent of screening on the site; " � J. That Section 48 relative to Conditional Uses is hereby amended by adding Section 48.F. 11 . to read as follows: "11 . The Director of Community Development has approved the detailed landscaping plan as having met the provisions of Section 53 . " K. That Section 49 relative to Special Use Permits is hereby amended by amending Section 49 .F. 10 . (b) to read as follows: " (b) The nature and extent of screening on the site. " L. That Section 49 relative to Special Use Permits is hereby amended by adding Section 49 .F. 17 . to read as follows: ��>_- "17 . Whether the Director of Community Development has approved the detailed landscaping plan as having met the provisions of Section 53 . " M. That Section 53 relative to Landscaping Regulations is hereby amended by amending Section 53 .H. 1 .c . to read as follows: "c. Interior areas of parking lots shall contain planting islands located so as to best relieve the expense of paving. Planter islands must be located no further apart than every twelve (12) parking spaces and at the terminus of all rows of parking. Such islands shall contain at least one (1) tree. Planter islands shall not be required for lots containing less than thirty-five thousand (35 , 000) square feet. The remainder shall be landscaped with shrubs, lawn, ground cover and other appropriate material not to exceed three (3) feet in height. Interior planter islands shall have a minimum size of nine (9) by eighteen (18) feet. " N. That Section 60 relative to Sign Standards is hereby amended by amending Section 60 .B. 2 . (c) (12) to read as follows: �""' " (12) Pole Sign Conditional Uses: The following conditional uses may be permitted provided they meet the provisions of Section 48 and a Conditional Use Permit ' is issued: A sign face with changeable copy exceeding thirty (30) percent of the gross surface area of the sign face. Planned commercial centers located adjacent to Highway 121, Highway 360 and Highway 114 (excluding Business 114) may have a pole sign, a minimum of twenty (20) feet in height up to forty (40) feet in height. For pole signs exceeding twenty (20) feet in height the sign cabinet dimensional requirements shall be a maximum of fourteen (14) inches in depth and a maximum gross surface area of two hundred eighty-eight (288) square feet (S.F. ) . There shall be no minimum or maximum cabinet width or height regulations for signs approved with a conditional use exceeding twenty (20) feet in height. Section 2 . Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and `�"'"`� upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2 , 000 . 00) for each offense and a separate offense shall be deemed committed each day during or on which an offense occurs or continues. Seetion 3 . If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. , PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on first reading on this the �th day of November , 1989 • PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on second and final reading on this the 21st day of November , 1989 .
