OF THE CITY OF GRAPEVINE, TEXAS SAME BEING
ALSO KNOWN AS APPENDIX "D"' OF THE CITY CODE, -
BY GRANTING A CONDITIONAL USE PERMIT TO ALLOW

PRESERVING ALL OTHER PORTIONS OF THE Z�NING
ORDINANCE; PROVIDING A CLAUSE RELATING TQ
SEVERABILITY; DETERMINING THAT THE PUBLIC
INTERESTS, MORALS AND GENERAL WELFARE I}EMAND
TI�E ISSUANCE C?F THIS CONDITIONAL U5E PERMIT;
PROVIDING A PENALTY N4T TQ EXCEED THE SLTM OF
TWO THOUSAND DOLLARS {$2 ,pOQ. 00) AND A
SEPARATE OFFENSE SHALL BE DEEMED COMMITTED
UPON EACH DAY DURTNG OR ON WHICH A VIOLATION
OCCURS; AND DECLARING AN EMERGENCY
WHEREAS, an applicatian was made requesting issuance of a
conditianal use permi� by making applications far same with the
Planning & Zoning Commission of the Ci�.y of Grapevine, Texas, as
required by State statu�es and the zoning ordinance of the City
of Grapevine, Texas, and all the legal requirements, canditions
and prerequisi�es having been complied with, the case having come
before the City Cauncil of the City of Grapevine, Texas, after
��,� alI 1.egal natices requirements, conditians and prerequisites
having been complied with; and
WHEREAS, the City Council o� the City of Grapevine, Texas,
at a public hearing called by �he City Council did consider the
following factor� in making a determination as ta whether this
requested conditional use permit should be granted or denied:
safety of the motoring public and the pede�trians using the
facilities in the area immediately surrounding �he site; safety
fram fire hazards and mc�asures for fire contzol; protection af
adjacent praperty from flaod or water damages, noise producing
elements, and glare of the vehicular and statianary lights and
effect of such lights an established character of the
neighborhoad; locatian, lighting, and types of signs and relation
of signs to traffic control and adjacent property; street size
and adequacy of width for �.raffic reasonably expected to be
generated by the propased use around the site and in the
immediate neighborhood; adequacy af parking as determined by
requirements af thi.s ordinance for of�'-street parking facili�ies;
location a£ ingress and egres� points �or parkang and off-street
locating spaces, and protection of public heal�h by surfacing on
�,, all parking areas to cantrol dust; effect on �.he promotion of
health and �he general welfare; effect on light and air; the
effect on the overcrowding of the land; the effect an the
concentration of population; the effect on the transpar�ation,
`� water sewera e schaols
, g , , parks and ather facilities; and
WHEREAS, the City Council of �he City af Grapevine, Texas,
at a public hearing called by the City Council af the City of
Grapevine, Texas, did cansider the following factors in making a
determination as ta whether this requested conditional use permit
should be granted or denied; effect on �.he congestion o£ the
streets, the fire hazards, panics and other dangers possibly
present in the securing of safety from same, the effect on the
promotion of heal�h and the general wel�are, effect an adequate
3ight and air, the effect on the overcrowding of the 1and, the
effect on the concentration of population, �he effect an the
transpartation, water, sewerage, schools, parks and other public
facilities; and
WHEREAS, all of the requirements of Section 48 of Ordinance
'"`� No. 82-73 have been satisfied by the submi�sion of evidence at a
public h�aring; and
�,,, WHEREAS, the City Council further considered among other
things the character af the existing zoning district and its
peculiar suitability for particular uses and with the view to
conserve the value of buildings and encourage the most
apprapriate use of land thraughou� �his city; and
WHEREAS, the City Council of the City of Grapevine, Texas,
does find that there is a public necessity far the granting of
this condztianal u�e permit, that the pub2ic demands i�, that �he
public interest ciearly requires the amendment, that the zoning
changes do nat unreasonably invade the rights of those who bought
ar improved property with reference to the classificatian which
existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas
does find �hat the conditional use permit lessens the congestion
in the streets, helps secure safety from fire, panic and other
dangers, prevents the overcrowding of land, avoids undue
concentration of populati�n, facilitates the adequate pravisians
of transportatian, water, sewerage, schools, parks and ather
public requirements; and
WHEREAS, the City Council of the City af Grapevine, Texas,
has determined that there is a necessity and need for this
� .,o conditional use permit and has also found and determined that
there has been a change in the conditions of the property
surraunding and in close proximity to the property requested for
a change since this property was originally classzfied and,
therefore, feels that the issuance of this conditional use permit
far the particular piece o� property is needed, is called for,
and is in �he best interest of the public at large, the citizens
of the City o� Grapevine, Texas, and helps promote th� general
health, safety and welfare of this community.
NOW, THEREFORE, BE IT ORDAINED B� THE CTTF COUNCIL OF THE
CITY aF GRAPEVINE, TEXAS:
Sectian 3 . That the Ci�y does hereby issue a conditional
use permit in accordance with Section 48 of Ordinance No. 82-73 ,
the Comprehensive Zoning Ordinance of the City of Grapevine,
Texas same being also known as Appendix "D" of the City Code, by
granting a condi�ional use permit to allow a nonprofit insti�ute,
Grapevine Relief and Community Exchange (G.R.A.C.E. } , �o occupy a
residence in a district zaned "R-7. 5" Single-Family District
Regulations under City of Grapevine Qrdinance No. 82-73 , the
„�„ fallowing property knawn as 311 Smith Street, all in accardance
with a site plan approved pursuant �o Section 47 of Ordinance No.
82-73, attached hereto and made a part hereof as Exhibit "A" , and
all other conditions, re�trictions, and safeguards imposed
�"' herein:
1 . Construct a fence along the south praperty line �o
the sidewalk, meeting fence requirements by
July 2Q, 1989;
2. Post sign to direct all parking to the First
Baptist Church parking lat; and
3 . Parking allowed only in tha driveway, no parking
allowed in yard areas.
Section 2. The City Manager is hereby directed to amend the
official zoning map of the City of Grapevine, Texas, to reflect
the herein conditianal use permit.
Sectian 3. That in aIl ather respects �he use of the tract
or tracts af land herein above described shall be subject to all
the applicable regulations contained in said City af Grapevine
zoning ordinance and all ather applicable and pertinent

ordinances of the City of Grapevine, Texas,
Sec�ian 4 . That �he zoning regulations and distric�s as
herein es�ablished have been made in accordance with the
� comprehensive plan for the purpose of promoting health, safety,
morals and the general welfare af the community. They have been
designed with respect ta both present conditians and the
conditions reasanably anticipated to exist in the foreseeable
future; to lessen conges�ion in the streets; �o secure safety
from fire, panic, flood and o�her dangers; provide adequate light
and air; to prevent overcrowding of land, to avoid undue
concen�ration of population; facilitate the adequate provisions
of transpartation, wa�er, sewerage, drainage and surface water,
parks and ather public requ�rements, and to make adequate
provisions for the normal business, cammercial needs and
development of the community, They have been made with
reasonable cansideration, among o�her things, of the character of
the district, and its peculiar suitabili�y for the particular
uses and with a view of conserving the value of buildings and
encouraging the most appropriate use of Iand throughout the
community.
Sectian 5. This ordinance shall be cumulative of a11. other
ordinances o� the City af Grapevine, Texas, affecting zpning and
sha11 na� repeal any of the provisians o� �aid ordinances except
f in those instances where pravisions of thase ordinance� which are
in direct conflict with the provisions of this ordinance.
�-� Sectian 6 . That the terms and pravisions of this ordinance
shall be deemed to be severable and that if the validity of the
zoning affecting any portian of the tract or tracts of land
described herein shall be declared to be invalid, the same shall
not affect the validity of the zoning of the balance o� the tract
or tracts of land described herein.
Section 7. That any person or carporation who shall vialate
any of the provisions of �his ardinance or fail. to camply
therewith, or with any of the requirements thereof, ar wha shall
build or alter any building ar use in viala�ian of any detailed
statement or plan submitted and approved hereunder, shall be
guilty af a misdemeanor and shall be liable to a fine of not more
than Two Thousand Dollars ($2, OQQ.04) , and each day such
violation shall be permitted to exist sha11 constitute a separate
offense. The owner or owners of any building or premises, or
part thereaf, where anything in violation of this ordinance shall
be placed or shall exist, and any architect, builder, contractor,
agent, person, or corporatian employed in connectian therewith,
and who may have assisted in the commissian of any such
violati4n, shall be guilty of a separate o�fense and upon
canviction shall be fined as herein provided. The City of
Grapevine, likewise, shall have the power to enforce the
provisions of this ordinance through civil court action as

provided by �tate 1aw.
Section 8. The fact that the present zoning ordinance and
regulations of the City of Grapevine, Texas are inadequa�e to
properly safeguard the heai�h, safety, marals, peace and general
welfare of the inhabitants of the City of Grapevine, Texas,
creates an emergency for �.he immediate preservation af the public
business, property, health, safety and general welfare o� the
public which requires that this ordinance sha11 became effective
from and atter �.he date of its final passage, and it is
accordingly �o ordained.
