AN ORDINANCE AMENDING A CONDITIQNAL USE
PERMIT ORDINANCE NQ. 87-70 FOR A PLANNED
COMMERCIAL CENTER IN ACCORDANCE WITH

COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF

ORDINANCE NO. 82--73 ALL IN ACCORDANCE WITH A
SITE PLAN APPRUVED PURSUANT TO SECTIQN 47 OF
ORDINANCE N{J. $2-73 AND ALL C}THER CONDITIt)NS,
RESTRICTIt�NS AND SAFEGUARDS IMPC}5ED HEREIN;
CORRECTING THE OFFICIAL ZONING MAP;
PRESERVTNG ALL OTHER PORTIONS OF THE ZONING
ORDINANCE; PROVIDING A CLAUSE RELATING TO
SEVERABTLITY; DETERMINING THAT THE PUBLIC
INTERESTS, MQRALS AND GENERAL WELFARE DEMAND
THE ISSUANCE OF THIS GONDITSONAL USE PERMIT;
PROVIDING A PENALTY NOT TO EXCEED THE SUM OF
TWQ THOUSANI7 DOLLARS E$2,OQ0 .00) AND A
SEPARATE OFFENSE SHALL BE DEEMED COMMITTED
UPON EACH DAY DURING OR ON WHICH A VIOLATION
OCCLIRS
WHEREAS, an app2ication was made requesting issuance of a
�,,, conditional use permit by making applicatians for same c;�ith the
Planning & Zoning Cammission of the City of Grapevine, Texas, as
required �y State statutes and the zoning ordinance of the City
of Grapevine, Texas, and all the l�gal requirements, conditions
and prerequisites having been complied with, the ca�e having come
before the City Council of the City of Grapevine, Texas, after
all legal natices requirements, conditions and prerequisites
having been complied with; and
WHEREA�, the City Council of the City af Grapevine, Texas,
at a public hearing called by the City Cauncil did consider the
following factors in making a determi.nation as to whether this
requested conditional use permit should be granted or denied:
safety of the motoring public and the pedestrians using the
facilities in the area immediately surrounding the si�e; safety
from fire hazards and measures for fire control; protection of
adjacent praperty from flaod or wa�er da�nages, naise producing
elements, and glare of �.he vehicular and stationary lights and
effect of such lights on established character of the
neighborhaod; locatian, lighting, and types o� signs and relation
of sign� to traffic control and adjacent property; street size
and adequacy of width for traffic reasonably expected to be
" generated by �.he proposed use around the site and in the
immedia�.e neighborhoad; adequacy of parking as determined by
requirements of this ordinance far off-street parking facilities;
locatian of ingress and egress poin�s for parking and off-stree�
lacating spaces, and protection o�' public health by surfacing on
all parking areas ta control dust; �ffect on the promotion o�
health and the general welfare; effect Qn light and air; �.he
effect on the avercrowding of the land; the effect on �he
concentration of populatian; the e�fect on the transpartation,
water, sewerage, school.s, parks and other facila,ties; and
WHEREAS, the City Gouncil of the City of Grapevine, Texas,
at a public hearing called by the City Council of the City of
Grapevine, Texas, did consider the following factors in making a
determina�ian as to whether �his requested conditianal use perntit
shauld be granted ar denied; effect on the congestion af the
streets, the fire hazards, panics and other dangers passibly
present in the securing of safety from same, the effec� on the
promotian of h�alth and the general welfare, effect on adeguate
light and air, the ef�ect on the overcrowding of the land, the
""'�' effect on the cancentration of population, the effect on the
transportation, water, sewerage, schools, parks and ather public
facilities; and
WHEREAS, all af the requirements of Sectian 48 of Ordinance
No. 82-73 have been satisfied by the submissian af evidence at a
public hearing; and
WHEREAS, �he City Council further considered among other
things the charac�er of the exi�ting zQning dis�rict and its
peculiar suitability for particular uses and with the view to
conserve the value af buildings and encourage the mast
apprapriate use af land throughaut this city; and
WHEREAS, the City Cauncil of �he City of Grapevine, Texas,
does find that there is a public necessity �or the granting of
this conditional use permi�, that the public demands it, that the
pubZic interest clearly requires the amendment, that the zoning
changes do no� unreasonably invade the rights af those who bought
or impraved property with reference to the elassification whieh
existed at the time their original investment was made; and
WHEREA�, the City Council of �he City of Grapevine, Texas
daes find that the conditional use permit less�ns the congestion
�,,.<.��,
in the streets, helps secure safety from fire, panic and other
dangers, prevents the overcrowding of land, avoids undue
concentra�ian of papulatior_, facilitates the adequate provisions
of transportatian, water, sewerage, schoals, parks and other
public requirements; and
WHEREA�, the City Council of the City of Grapevine, Texas,
has determined that �.here is a necessity and need for this
conditional use permit and has also found and determined that
there has been a change in �he conditions oz the property
surrounding and in cl.ose proximity to the property requested for
a change since this praperty was originally classified and,
there�ore, feels that the issuance af this conditional use permit
for the particular piece of praperty is needed, is called for,
and is in th� best interest of the public at large, �he citizens
of the City af Grapevine, Texas, and helps promate the general
health, safety and welfare o� this community.
NOW, THEREF4RE, BE IT ORDAINED BY THE CITY COUNCIL 4F THE
CITY OF GRAPEVINE, TEXAS:
Section l . That Ordinance No. 87-70 of the City of
Grapevine, Texas, granting a conditional use permit on a tract of
land zoned "HC" Highway Commercial and containing approximately
13 .514 acres and as more particularly described in Exhibit "A" ,
'"�"' attached hereto and incorporated herein, is hereby amended in the
fol3.owing partieulars.
'�+'' A. By amending and expanding the said conditional use permit by
amending the si�.e plan a�tached as Exhibit "B'" to Ordinance
No. 87-7Q to reflect a new pad site (Pad #6, being Lot 3,
Black 1 of the Hayley Addition of �he City af Grapevine) ,
for restauran� purposes. A true and correct copy of the
si�.e plan as amended is attached hereto as Exhibit "B" and
is incorporated herein for aIl purposes;
B. By amending and expanding the said conditonal use permit for
and to permit the storage, possessian, retail sale and
on-premise consumption of alcohalic beverages (beer and wine
only) in conjunctian with the operation of the restaurant
use permi�ted in Sec�ion 1 .A. of this Ordinance and within
the pad site (Pad #6} depicted, in the a�tached E�hibzt "B" ;
and
C. By amending and expanding the said conditianal use permi�
for and to permit a farty foot (40 ' ) pole sign located along
�he frontage of State Highway 114 as shown on Exhibit "B"
and more particuarly described in Exhibit "C" a�tached
hereto and incorporated herein.
Section 2 . The City Manager is hereby directed to amend �he
o�ficial zoning map of �he City of Grapevine, Texas, to reflec�
the herein conditional use permit.
Section 3 . That in all ather respects the use of the trac�
or tracts of land herein above described shaZl be subject to all
the app�icable regulatians contained in said City of Grapevine
zoning ardinance and a11 other applicable and pertinen�
ordinances of �he Ci�y o� Grapevine, Texas.
�ection 4 . That �he zoning regulations and districts a�
herein established have been made in accardance with the
camprehensive glan for �he purpose of pramoting health, safety,
marals and the generai welfare of the community. They have been
designed with respec� to bo�h present eonditions and �he
condi�zons reasonably anticipated to exist in the foreseeable
future; ta lessen congestion in the streets; to secure safety
from fire, panic, flaad and other dangers; provide adeguate ligh�
and air; to prevent overcrowding of land, to avaid undue
cancentration af population; facilitate the adequate provisions
of transportation, water, sewerage, drainage and surface water,
parks and other public requiremen�s, and to make adequate
proviUions for the normal business, commercial needs and
�'�` develapment af the c�mmuni��. They have been made with
reasonable eonsideratian, among other things, af the chara�ter af
� the district, and its peculiar suztability for the particular
uses and with a view of conserving the value of buildings and
encauraging the most appropriate use of land throughout the
cammunity.
Seetion 5. This ardi�ance shal3 be cumulative of all other
ardinance� of the Ci�y of Grapevine, Texas, affecting zoning and
shaZl nat repeal any af the provisions of said ordinances excep�
in thase instances where provisions af thase ordinances which are
in direct conflict with �he provisians af this ordinance.
Section 6 . That the terms and provisions of this ordinance
shall be deemed to be severable and that if the validity of the
zoning a£fecting any pQrtian of the tract or tracts of Iand
described herein shali be declared �a be invalid, the same shall
nat affect the validity of the zoning af the balance of the tract
or tracts of land described herein.
Section 7 . That any person or corporatian who shall violate
any of the provisians of this ordinance or fail to camply
therewith, or wi�h any of the requirements thereaf, or who sha11
build or alter any building or use in viol.ation a� any detai2ed
`�� s�atement or plan submitted and approved hereunder, sha21 be
guilty of a misdemean�r and shall be 3iable ta a �ine af not more
than Two Thousand Dollars ($2,Q00.00) , and each day such
va.ola�.ion shall be permitted to exist shall constitute a separate
offense. The owner or owners of any building or premises, or
part thereof, where anything in violation o� this ordinance shall
be placed or shall exist, and any architect, builder, contractor,
agent, parson, or cc�rporation employed in connection therewi�h,
and who may have assisted in the cammission of any such
viola�.ion, shali be guilty of a separate offense and upon
canviction sha11 be fined as herein provided. The City o�
Grapevine, likewise, shall have the pawer �,o enforce �he
provisions of this ardinance through civil court action as
provided by State law.
