AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS
ABANDONING AND VACATING AN ACCESS EASEMENT
LOCATED IN THE THOMAS MAHAN SURVEY, ABSTRACT
N0. 869, IN THE CITY OF GRAPEVINE, TEXAS, AS
HEREINAFTER DESCRIBED; PROVIDING A
SEVERABILITY CLAUSE; DECLARING AN EMERGENCY
- AND PROVIDING AN EFFECTIVE DATE
�,,, WHEREAS, the owner of a tract of land located in the Banyan
Place Addition in the City of Grapevine, Tarrant County, Texas,
has requested an access easement, as hereinafter described, be
abandoned and vacated; and
WHEREAS, the access easement, as hereinafter described, is
not needed for public use and will not be needed in the future
for public use; and
WHEREAS, abandoning and vacating the access easements will
relieve the City of Grapevine, Texas from the cost and expense of
maintaining said property and facilities.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1 . That all the matters stated in the preamble of
this ordinance are true and correct and are hereby incorporated
into the body of this ordinance as if copied in their entirety.
Section 2 . That the City of Grapevine access easement as
recorded in Cabinet A, Slide No. 202 of the Tarrant County Texas
�r Plat Records, and as described in and shown on Exhibit "A" ,
attached hereto and made a part hereof, is hereby abandoned and
vacated for public use and the same is hereby abandoned and
vacated insofar as all public right, title, duty and interest in
and to said described portion of said access easement is
concerned. The City shall have no responsibility for maintaining
said easement or any facilities located within said easement.
Section 3 . If any section, article, paragraph, sentence,
clause, phrase or word in this ordinance, or application thereto
any person or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not
affect the validity of the remaining portions of this ordinance;
and the City Council hereby declares it would have passed such
remaining portions of the ordinance despite such invalidity,
which remaining portions shall remain in full force and effect.
Section 4 . The fact that said water and sanitary sewer line
easements are no longer needed by the public for public usage and
would create a hardship or burden upon the City of Grapevine to
keep open and maintain such easements creates an urgency and an
,� emergency for the immediate preservation of the public health,
safety, and general welfare, which requires that this ordinance
shall take effect immediately from and after its passage, and it

is accordingly so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 5th day of September_, 1989 .

addition to the City of Grapevine, Tarrant County, Texas as
recorded in Cabinet A, Slide No. 202 of the Plat Records of
Tarrant County, Texas, said easement being a six foot (6 ' ) wide
easement east of and adjacent to and parallel to the west line of
Lot 2R, Block 3.
