� ORDINANCE N0. 89-35 •
AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS
PROVIDING FOR AND AUTHORIZING THE EXECUTION
OF AND AGREEING TO ACCEPT A STREET
RIGHT-OF-WAY EASEMENT AND A TEMPORARY
CONSTRUCTION EASEMENT, FOR THE PURPOSE OF
WIDENING AND IMPROVING DALLAS ROAD, ON, OVER
- AND ACROSS A PORTION OF CERTAIN REAL PROPERTY
OWNED BY THE CITX AND GENERALLY LOCATED AT
307 WEST DALLAS ROAD, GRAPEVINE, TEXAS AND
��, ,,, ADJACENT AND CONTIGUOUS TO DALLAS ROAD, THE
SAID RIGHT-OF-WAY EASEMENT AND TEMPORARY
CONSTRUCTION EASEMENT BEING DESCRIBED IN THE
ATTACHED EXHIBITS "A" AND "B" , RESPECTIVELY;
PROVIDING A SEVERABILITY CLAUSE; DECLARING AN -
EMERGENCY AND PROVIDING AN EFFECTIVE DATE. �
WHEREAS, the City Council of the City of Grapevine, Texas �
(the "City" ) has heretofore initiated a program designed to
accomplish the widening and improvement of Dallas Road, a
public street located within the City; and
WHEREAS, in order to accomplish and complete the program,
the City has sought to obtain right-of-way, whether by
dedication or otherwise, from the owners of real property
adjacent and contiguous to Dallas Road; and
WHEREAS, the City owns certain real property within the
City which is adjacent and contiguous to Dallas Road and
generally located at 307 West Dallas Road (the "Property" ) ; and
WHEREAS, in order to advance the City' s program of
widening and improving Dallas Road, it is necessary that the
City provide a portion of the Property for the said widening
` and improvement; and
WHEREAS, the City is authorized, pursuant to §51. 076(a) ,
Tex. Loc. Gov. Code Ann. (Vernon) and its City Charter, to hold
property that it receives by gift, deed, devise or otherwise,
and authorized, pursuant to §251.001(a) , Tex. Loc . Gov. Code
Ann. (Vernon) and its City Charter, to acquire public property
for street purposes; and
WHEREAS, the City Council hereby finds that the granting
of an easement for street right-of-way purposes and a temporary
construction easement for the Dallas Road project as described
herein and the acceptance of such easements is in the best
interest of the citizens of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1. That all of the above premises are found to
be true and correct and are incorporated into the body of this
ordinance as if copied in their entirety.
fi Section 2 . That, for purposes of widening and
improving Dallas Road, a public street located within the City
�,1 of Grapevine, the City does hereby agree to convey and grant
the following:
A. A street right-of-way easement in, over, upon,
through and under a portion of certain real property
owned by the City and generally located at 307 West
Dallas Road, Grapevine, Texas, said portion being
described in Exhibit "A" attached hereto and
incorporated herein.

B. A temporary construction easement in, upon, over and '
across a portion of the said real property located at
307 West Dallas Road, said portion being described in '
Exhibit "B" attached hereto and incorporated herein.
The City Manager is hereby authorized and empowered to execute
on behalf of the City as grantor instruments conveying the said
right-of-way for street purposes and the said temporary
construction easement, true and correct copies of which
instruments are attached hereto as Exhibits "C" and "D" ,
_ ° � respectively, and incorporated herein.
Section 3. That �the City does hereby accept the said
Street Right-of-Way and •,Temporary Construction Easement for
� purposes of widening and improving Dallas Road.
Section 4 . If any section, article, paragraph,
sentence, clause, phrase or word in this ordinance, or -
application thereto any person or circumstances is held invalid
or unconstitutional by a Court af competent jurisdi�ti�n, s�c�
holding shall not affect the validity of the remaining portions `
of this ordinance; and the City Council hereby declares it
would have passed such remaining portions of the ordinance
despite such invalidity, which remaining portions shall remain
in full force and effect.
Section 5 . The fact that the present ordinance and
regulations of the City of Grapevine, Texas, are inadequate to
properly safeguard the health, safety, morals, peace and
general welfare of the inhabitants of the City of Grapevine,
Texas, creates an emergency for the immediate preservation of
the public business, property, health, safety and general
welfare of the public which requires that this Ordinance shall
become effective from and after the date of its passage, and it
is accordingly so ordained.

BEING 0.0425 acres of land situated in the Wm. Dooley Survey, Abstract 422,
Tarrant County, Texas, and being part of th�t certain called 1m0 ac�es of land
as described in a deed from G�neral American Life Insurance Company to City of
Grapevine, Texas, dated April 7, 1977, and recorded in Volume 6224, Page 516 of —
the Deed 8ecords of Tarrant County, Texas, said 0.0425 acres of land to be more =--
particularly described by metes and bounds as follows: - -
BEGINNING at a 3/8" iron rod found for the Northeast corner of the above
referenced City of Grapevine tract, esid point being at the intersection of the
exis[ing North right-of-way line of Dallas Road and the existing We&t right-of-
way line of Church Street;
THENCE South 00° 05' 11" East, a distance of 28.12 feet with the East boun-
dary line of said City of Grapevine tract and said existing West right-of-way
line of Church Street to a 1/2" iron rod set for corner in the proposed South
right-of-way line of Dallas Road , said point for corner being at the beginning
of a curve to the left whose functions are as follows: an angle of 86° 08' 31",
a radius of 18.00 feet, a tangent of 16.83 feet, a length of 27.06 feet and

STREET RIGHT-OF-WAY

§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF TARRANT �
THAT, the City of Grapevine, Texas, hereinafter referred �
to as Grantor, for and in consideration of the sum of ONE
DOLLAR ($1.00) and other good and valuable consideration, to
�, , Grantor in hand paid by the City of Grapevine, Texas, the
receipt and sufficiency of which is hereby acknowledged and
confessed, and the further benefits to be derived by Grantors
as a result of projected public improvements, and for which no
�� °= lien, express or implied, is retained, have this day GRANTED,
SOLD and CONVEYED, and by these presents do hereby GRANT, SELL
and CONVEY, unto the said City of Grapevine, Texas, a municipal
corporation situated in Tarrant County, Texas, for street -
right-of-way purposes for the passage of vehicular and -
pedestrian traffic, together with th� customary uses attendant
thereto, including drainage and utilities, over, under, _
through, across and along all those certain lots, tracts or - _
parcels of land situated in Tarrant County, Texas and described _
as follows, to-wit:
All those certain tracts, pieces or
parcels of land being situated in the
County of Tarrant, State of Texas,
described in Exhibit "A" attached hereto _.__ _:._-
. - - and made a part hereof for all purposes,
._ __to-- which reference is here made for a more
particular description of said property;
It shall be conclusively presumed by the execution of
this instrument by Grantor that the person signing on behalf of
Grantor has been duly and legally authorized to so sign and
there shall be no necessity for a seal or attestation.
� TO HAVE AND TO HOLD the above described premises,
together with all and singular the rights and appurtenances
thereto, in anywise belonging unto the said City of Grapevine,
Texas, its successors and assigns forever; and Grantors,
hereinafter named, does hereby bind itself, its successors and
assigns to warrant and forever defend all and singular the said
premises unto the said City of Grapevine, Texas, its successors
and assigns, against every person whomsoever lawfully claiming
or to claim the same or any part thereof.

TEMPORARY CONSTRUCTION EASEMENT

§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF TARRANT §
That the City of Grapevine, Texas, hereinafter referred
to as Grantor, for and in consideration of the sum of ONE
DOLLAR ($1.00) to Grantor in hand paid by the City of
�,,;.,.; Grapevine, Texas, the receipt of which is hereby acknowledged,
and the further benefits to be derived by Grantor from the
projected puh?ic improvements hereinafter desribed, Grantor has
this day GRANTED, SOLD and CONVEYED, and does hereby GRANT,
�°'° SELL and CONVEY, unto the City of Grapevine, Tarrant County,
Texas, a temporary construction easement as further described
herein over, upon, across and through that property of the
Grantor described in Exhibit "A" attached hereto and -
incorporated herein. for all pur�oses (th� "Easement Area" ) .
This Temporary Construction Easement shall be for the use
by the City of Grapevine, Texas, its contractors, agents and
employees for placing or locating, at any and all times, _
persons, equipment, machinery or tools used or to be used in �
the widening and improvement of Dallas Road and the
construction, reconstruction, replacement, improving and/or
installation of utilities located within the Dallas Road right-
of-way, the said Dallas Road being a public street located
within the City of Grapevine, Texas and being contiguous and
adjacent to property owned by Grantor generally described as
and located at 307 West Dallas Road, Grapevine, Texas. Upon
completion of the said Dallas Road improvements, this Temporary
Construction Easement shall automatically terminate.
It shall be conclusively presumed by the execution of
� this instrument by Grantor that the person signing on behalf of
Grantor has been duly and legally authorized to so sign and
there shall be no necessity for a seal or attestation.
This Temporary Construction Easement shall bind and inure
to the benefit of the respective parties, their successors and
assigns .

F1ELD NOTES FOR 0.0294 ACRE TEMPORABY CONSTRUCTION EASEMENT
I BEING a 0.0294 acre temporary construction �asement situated in the Wm.
Dooley Survey, Abstract 422, Tarrant County, Texas, and being part of that cer- _
tain called 1.0 acres of land as described in a deed from General American Life _ __
Insurance Company to City of Grapevine, Texas� dated April 7, 1977, and recorded _
in Volume 6224, Page 516 of the Deed Records of Tarrant County, Texas , said
0.0294 acres of land to be more particularly described by metes and bounds as
follows:
BEGINNING at a point in the South boundary line of a 0.0425 acr.e right-of-
way, from said point a 3/8" iron rod found for the Northeast corner of said City
of Grapevine tract bears North 14° 13' 38" East, a distance of 18.00 feet;
THENCE South 86° 03' 20" West, a diatance of 191.27 feet to a point in the
South line of said 0.0425 acre right-of-way, said point being in a curve to the
right whose functions are as follows: an angle of 56° 12' 02", a radius of 18.00
feet, a tangent of 9.61 feet, a length of 17.65 feet and whose chord bears North
61° 40' 35" East, a distance of 16.96 feet; ��
THENCE in a Northeasterly direction with said curve to the right and the
South boundary line of said 0.0425 acre right-of-way a distance of 17.65 feet to '��'�
a 1/2" iron rod set at [he end of said curve;
THENCE North 86° 03' 20" East, a distance of 162.76 feet with the South
boundary line of said 0.0425 acre right-of-way to a 1/2" iron rod set a[ the
beginning of a curve to the right whose functions are as follows: an angle of
48° 38' 08", a radius of 18.00 feet, a tangent of 8.13 feet, a length of 15.28
feet and whose chord bears South 65° 46' 07" East, a distance of 14.82 feet;
THENCE in a Southeasterly direction along said curve to the right and the
South boundary line of said 0.0425 acre right-of-way a distance of 15.28 feet
back to the place of beginning and contai ' 0.0294 acrea of land or 1 ,279.09
square feet.
