AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS
DEDICATING TEMPORARY CONSTRUCTION EASEMENTS
AND PERMANENT WATER PIPELINE EASEMENTS TO BE
UTILIZED SOLELY BY THE CITY OF GRAPEVINE,
TEXAS, MORE PARTICULARLY DESCRIBED ON THE
ATTACHED EXHIBITS "A" , "B" , "C" AND "D" ,
�ff' RESPECTIVELY; PROVIDING A SEVERABILITY
CLAUSE; DECLARING AN EMERGENCY AND PROVIDING
AN EFFECTIVE DATE

WHEREAS, the owner of the tracts of land located in the
Archibald F. Leonard Survey and B. B. Johnson Survey in the City
of Grapevine, Texas desires to dedicate temporary construction
easements and permanent water pipeline easements to be used
solely and exclusively by the City of Grapevine, Texas, as
hereinafter described; and
WHEREAS, the easements, as hereinafter described, are needed
for public use and will be needed in the future for public use;
and
WHEREAS, dedicating said easements will be in the best
interest of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1 . That a portion of two tracts of land recorded in
Volume 8220 , Page 432 and Volume 388-192, Page 29 , of the Tarrant
County Deed Records, and more particularly described in Exhibits
�,>._, "A" and "B" , respectively, attached hereto and made a part
hereof, are hereby dedicated for the sole and exclusive use by
the City of Grapevine, Texas as temporary construction easements,
as provided in the temporary construction easements attached
hereto as Exhibits "A" and "B" , respectively, and incorporated
herein for all purposes.
Section 2. That a portion of two tracts of land recorded in
Volume 8220, Page 432 and Volume 388-192 , Page 29 , of the Tarrant
County Deed Records, and more particularly described in Exhibits
"C" and "D" , respectively, attached hereto and made a part
hereof, are hereby dedicated for the sole and exclusive use by
the City of Grapevine, Texas as permanent water pipeline
easements, as provided in the permanent water pipeline easements
attached hereto as Exhibits "C" and "D" , respectively, and
incorporated herein for all purposes.
Section 3 . If any section, article, paragraph, sentence,
clause, phrase or word in this ordinance, or application thereto
any person or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not
,. affect the validity of the remaining portions of this ordinance;
and the City Council hereby declares it would have passed such
remaining portions of the ordinance despite such invalidity,

which remaining portions shall remain in full force and effect.
Section 4 . The fact that the present ordinances and
regulations of the City of Grapevine, Texas, are inadequate to
properly safeguard the health, safety, morals, peace, and general
welfare of the public creates an emergency which requires that
this ordinance become effective from and after the date of its
passage, and it is accordingly so ordained.

hand paid by the City of Grapevine, Texas, a municipal corporation
situated in Dallas, Tarrant and Denton Counties Texas, the receipt of
which is hereby aclmowledged, and other good and valuable consideration
inclucling the benefits that will accrue to our propesty, do hereby GIVE,
GRANr and EXTIIQD to the said City of Grapevine, Texas, its successors
and assigns, the right to construct a water pipeline
facility and appurtenances upon and across land described as follaws:

The City of Grapevine, Texas, shall have the right and privilege to
remove and dispose of, offsite trees, brush, debris, excess excavated

material, etc. in the easements, that would interfere with access to the
construction site and that would interfere with construction of the said

The City of Grapevine, Texas, will at all times, after doing any wnrk in
, connecti.on with the construction of said water pipeline facilities
restore said premises as nearly to the condition in which same were
. found before such work was undertaken, including repair of all fences
� that might be disturbed or damaged in performing said w�rk, and further �

upon the condition that in the use of the aforesaid rights and

a nuisance or do any act that will be detrimental to said premises and
that said tract will not be used by said City of Grapevine, Texas, for
any other purpose, under this grant, except herein provided.

the Deed Records of Tarrant County, Texas , and also being in an existing Texas

Archibald F. Leonard Survey, Abstract 946, Tarrant County, Texas, said 0.14 acre
temporary construction easement being more particularly described by metes and
bounds as follows:
BEGINNING at a point for the Southeast corner of above mentioned 0.14 acre
temporary construction easement and being in tt�e East boundary line of above
referenced City of Grapevine tract and the East line of said Texas Power � Light
