AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS,
ABANDONING AND VACATING A PORTION OF "OLD"
SOUTH BALL STR�E�' IN THE CITY OF GRAPEVINE,

TEXAS, AS HEREINAFTER DESCRIBEI}; ° PROV�IDING A
SEVERABILITY CLAUSE; DEGLAR_ING AN '•EM£R�E`NCY
AND PROVIDING AN EFFECTIVE DATE �

WHEREAS, the owners of the proper�y abutti`ng a portion , of
�+ "old" South Ball Street in the City of Grapevine, Texas, have
requested a portion of right-of-way of "old" South "Ball Street,
as hereinafter described, be �bandor.ed and vacated; and
WHEREAS, a portion of the right-of-way of said street, as
hereinafter described, is not now needed for public use and will
not be needed in the future for public use; and
WHEREAS, abandoning and vacating a portion of the
right-of-way of said street will relieve the City of Grapevine,
Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1 . That the portion of right-of-way of "old" South
Ball Street located within the property described in Exhibits
"A" "B" "C" "D" "E" and "F" attached hereto and incorporated

herein for all purposes, is hereby abandoned and vacated for
�,,�,, public use, to the respective property owners and the same is
hereby abandoned and vacated insofar as all publ"ic right, title,
and interest in and to said described portion of said
� right-of-way is concerned.
Section 2. That the Mayor, be, and is hereby authorized to
execute Quitclaim Deeds to evidence release of the City' s
interest in the heretofore described property to the owners of
the property abutting said right-of-way, (a) Highway 114 and Ball
Street Joint Venture; (b) Rand Theatres of Texas, Inc. ; and (c)
Texas Utilities Electric Company, who officially declared by
affidavit that they are the rightful owners of the underlying fee
title to the right-of-way vacated and abandoned by this
ordinance.
Section 3 . The City shall provide a Quitclaim Deed to
Highway 114 and Ball Street Joint Venture for the property more
particularly described in the attached Exhibits "A" and "B" ; the
City shall provide a Quitclaim Deed to Rand Theatres of Texas,
Inc. , for the property more particularly described in the
attached Exhibits "C" and "D"; and the City shall provide a
Quitclaim Deed to Texas Utilities Electric Company for the
property more particularly described in the attached Exhibits "E"
and "F" .

Section 4 . That the terms and provisions of this ordinance
shall be deemed to be severable, and that if the validity of any
section, subsection, word, sentence, or phrase shall be held to
�'""° be invalid, it shall not affect the remaining part of this
ordinance.
Section 5 . That the effective date of this ordinance shall
be April 5, 1988 . -
Section 6 . This ordinance shall be filed with Tarrant
County Deed Records .

Section 7 . The fact that said portion of right-of-way of
"old" South Ball Street is no longer needed by the public for
public usage or traveling and would create a hardship or burden
upon the City of Grapevine to keep open and maintain such
right-of-way creates an urgency and an emergency for the
immediate preservation of the public health, safety, and general.
welfare, which requires that this ordinance shall take effect
immediately from and after its passage, and it is accordingly so .
