AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS,
AMENDING THE GRAPEVINE CODE OF ORDINANCES BY
AMENDING CHAPTER 18 , SECTION 18-166 (b)
j RELATING TO MILITARY LEAVE; BY AMENDING
� _ CHAPTER 18, SECTION 18-169 (b) RELATING TO
AUTHORIZED LEAVE WITHOUT PAY; PROVIDING A
SEVERABILITY CLAUSE AND DECLARING AN
EMERGENCY AND PROVIDING AN EFFECTIVE DATE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,
TEXAS:
Section 1 . That Chapter 18, Section 18-166 (b) of the
Grapevine City Code is hereby amended to read as follows:
" (b) In accordance with Article 5765, Section 7 (a) of
Vernon' s Texas Civil Statutes, an employee
engaged in authorized military training or duties
authorized by proper authority will receive pay
and accrue benefits, as if the employee were on
the job, for up to fifteen (15) days in any one
(1) calendar year. An employee eligible for
military leave who is ordered or authorized to
participate in training or other duty for periods
longer than fifteen (15) days during a calendar
year will first be placed on military leave with
pay and then on leave without pay for any time in
excess of fifteen (15) days . "
Section 2 . That Chapter 18 , Section 18-169 (b) of the
`"` Grapevine City Code is hereby amended to read as follows :
" (b) Vacation leave and sick leave benefits shall not
accrue while an employee is on leave without pay
when the employee has not worked more than
one-half (1/2) of the pay period in which leave
is being earned. Provided, however, that
employees engaged in authorized military training
or duties shall continue to accrue vacation leave
and sick leave during the time the employee is
ordered or authorized to participate in training
or other duty, for up to fifteen (15) days. In
addition to the above, health benefits, dental
benefits, retirement benefits and life insurance
coverage shall not accrue when the employee is on
leave without pay for more than thirty (30) days.
The employee, if he so desires, shall pay the
full cost of the health benefits while he is on
, leave without pay which exceeds thirty (30) days.
� An employee returning to work after leave without
pay which extends for more than three (3) months
� shall be given an adjustment service or seniority
date and an adjusted anniversary date for merit
increase purposes. "
Section 3. If any section, article, paragraph, sentence,
clause, phrase or word in this ordinance, or application thereto
any person or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not
� affect the validity of the remaining portions of this ordinance;
and the City Council hereby declares it would have passed such
remaining portions of this ordinance despite such invalidity,
which remaining portions shall remain in full force and effect.
Section 4 . The fact that the present ordinances and
regulations of the City of Grapevine, Texas, are inadequate to
properly safeguard the health, safety, morals, peace, and
general welfare of the public creates an emergency which requires
that this ordinance become effective from and after the date of
its passage, and it is accordingly so ordained.
