SUBJECT: SANITARY SEWER EASEMENT ABANDONMENT — 608 SOUTH
DOOLEY STREET AND 420 EAST COLLEGE STREET
RECOMMENDATION: City Council consider adopting an ordinance abandoning a 10 -foot wide
sanitary sewer easement on Lot 2R1 and 2R2, Block 23, Original Town of
Grapevine, and take any necessary action.
FUNDING SOURCE:
BACKGROUND: Property owners located at 608 South Dooley Street and 420 East
College Street have requested the City to abandon a 10 -foot wide sanitary
sewer easement that was never occupied. The sanitary sewer easement
was originally dedicated from Lots 2R1 and 2R2, Block 23, Original Town
of Grapevine plat in May 2017.
Staff recommends approval.
ORDINANCE NO. 2020-047
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A 10
FOOT SANITARY SEWER UTILITY ON LOTS 2R1 AND 2R2,
BLOCK 23, ORIGINAL TOWN OF GRAPEVINE TO THE CITY
OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED
WHEREAS, Lots 2R1 and 2R2, Block 23, Original Town of Grapevine located at
608 S. Dooley Street and 420 E. College Street, City of Grapevine, Tarrant County, Texas
has requested that a 10 foot Sanitary Sewer Easement of said lot, as herein after
described, be abandoned and vacated; and
WHEREAS, this easement was originally dedicated to the City as a 10 foot Sanitary
Sewer Easement on the plat of Lots 2R1 and 2R2, Block 23, Original Town of Grapevine
Addition according to Instrument #D217275699; and
WHEREAS, the applicant has received signatures from all public franchise utility
companies and the easement is not needed for public use and will not be needed in the
future for public use; and
WHEREAS, abandoning and vacating the said easement will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the 876 square feet Sanitary Sewer Easement located on Lots
2R1 and 2R2, Block 23, Original Town of Grapevine in Exhibits 1, 2 & 3", attached hereto
and incorporated herein for all purposes, is hereby abandoned and vacated for public use
and the same is hereby abandoned and vacated insofar as all public right, title, interest in
and to said right of way is concerned.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase
shall be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the easement is no longer needed by the public for public
usage and would create a hardship or burden upon the City of Grapevine to keep open
and maintain such easement creates an urgency and an emergency for the immediate
preservation of the public health, safety, and general welfare which requires that this
ordinance shall take effect immediately from and after its passage and it is accordingly so
ordained.

All that certain tract or parcel of land situated in the WILLIAM DOOLEY SURVEY, ABSTRACT
NO. 422, Tarrant County, Texas and being a portion of Lot 2R1, Block 23, ORIGINAL TOWN
OF GRAPEVINE, an Addition to the City of Grapevine, Tarrant County, Texas as recorded in
Instrument No. D217275699, Deed Records, Tarrant County, Texas and being more
particularly described by metes and bounds as follows:
BEGINNING at a 1/2 inch capped steel rod stamped "PRISM SURVEYS" found (CM) for the
southwest corner of said Lot 2R1, being the northwest corner of Lot 2R2 of said Block 23;
THENCE North 00 degrees 01 minutes 34 seconds East with the westerly boundary line of
said Lot 2R1, 10.00 feet, from which an "X" cut in concrete found bears North 00 degrees
01 minutes 34 seconds East, at 98.50 feet;
THENCE South 89 degrees 58 minutes 26 seconds East departing said boundary, 10.00 feet;
THENCE South 00 degrees 01 minutes 34 seconds West, 10.00 feet to the northerly boundary
line of said Lot 2R2;
THENCE North 89 degrees 58 minutes 26 seconds West with said northerly boundary line
10.00 feet to the Place of Beginning and containing 0.002 of an acre or 100 square feet,
as surveyed by Prism Surveys, Inc. during the month of August, 2020.
The plat hereon is an accurate representation of an actual survey made on the ground
under my supervision and the boundary lines, corners, and dimensions of said property are
as indicated.
