AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS
AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES
OF THE CITY OF GRAPEVINE, TEXAS BY ADDING A
NEW SECTION 8-5 RELATING TO DEFENSIVE DRIVING
FEES; BY ADDING A NEW SECTION 8-6 RELATING TO
DRIVING RECORD FEES; PROVIDING A SAVINGS

PROVIDING AN EFFECTIVE DATE AND DECLARING AN
EMERGENCY

WHEREAS, the Texas Legislature adopted Senate Bill 243 ,
effective September 1, 1987, which enables municipalities to
collect a ten dollar ($10. 00 ) fee for the processing of
defensive driving requests made to the City' s municipal court;
WHEREAS, the City Council hereby determines that is is in
the best interest of the City to collect a ten dollar ($10 . 00 )
fee for the processing of defensive driving requests and
driving record requests;
WHEREAS, the City Council desires to recover the cost it
incurs in processing defensive driving requests and requests
for copies of driving records;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1 . Chapter 8 of the Code of Ordinances of the
City of Grapevine, Texas is hereby amended by the addition of
two new sections , Section 8-5 and 8-6, which shall read as
follows :
"Sec. 8-5 Def ens iv e Dr iv ing Fee
A fee of ten dollars ( $10 . 00 shall be
charged as a special expense each time a
person requests to take a defensive driving
course for the purpose of having the charge
dismissed after the successful completion of
the course. The fee shall be paid into the
City treasury to recover the costs incurred
by the City in processing the person ' s
request for defensive driving school .
Sec. 8-6 Driving Record Fee
A fee of ten dollars ($10.00 ) shall be
charged as a special expense each time any
person requests a copy of his driving record
from the City. The fee shall be paid into
the City treasury to recover the costs
incurred in obtaining a copy of the person' s
driving record. "

Section 2. This ordinance shall be cumulative of all
ordinances and regulations of the City of Grapevine and s a
not repeal any of the provisions of those ordinances or
regulations, unless the provisions of those ordinances or
'"�°° regulations are in direct conflict with the terms and
provisions of this ordinance.
Section 3 . If any section, article, paragraph,
sentence, clause, phrase or word in this Ordinance, or
application thereto any person or circumstances is held invalid
or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions
of this Ordinance; and the City Council hereby declares it would
have passed such remaining portions of this Ordinance despite
such invalidity, which remaining portions shall remain in full
force and effect.
Section 4. This ordinance shall become effective after its
adoption by the City Council , provided, that this ordinance shall
not become effective prior to September 1 , 1987.
�� Section 5 . The fact that the present ordinances and
requlations of the City of Grapevine, Texas, are inadequate to
properly safeguard the health, safety, morals , peace and general
,,,�, welfare of the inhabitants of the City of Grapevine, Texas,
creates an emergency for the immediate preservation of public
business, property, health, safety and general welfare of the
public which requires that this ordinance shall become effective
from and after the date of its passage and it is accordingly so
ordained.

GRAPEVINE, TEXAS on this the 4th day of August , 1987.
