HomeMy WebLinkAboutORD 1987-044 ORDINANCE NO. g7-44 AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF GRAPEVINE, TEXAS, BY AMENDING ARTICLE IX OF CHAPTER 7, SECTION 7-180 RELATING TO DEFINITIONS; BY ADDING SECTION 7-193 (e) RELATING TO AREAS OF SHALLOW FLOODING; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200 . 00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON �, EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That the Grapevine City Code be, and the same is, hereby amended by amending Section 7-180 relating to the definition of structure and that it should read as follows: STRUCTURE means a walled and roofed building, a manufactured home, or a gas or liquid storage tank, that is principally above ground. Section 2 . That the Grapevine City Code be, and the same is, hereby amended by adding Section 7-193 (e) relating to areas ' ""�"°" of shallow flooding and that it should read as follows : ,�,,, Section 7-193 STANDARDS FOR AREAS OF SHALLOW FLOODING (AO/AH ZONES) (e) Located within the areas of special flood hazard established in Section 7-188 are areas designated as shallow flooding. These areas have special flood hazards associated with base flood depths of 1 to 3 feet where a clearly defined channel does not exist and where the path of flooding is unpredictable and where velocity flow may be evident. Such flooding is characterized by ponding or sheet flow; therefore, the following provisions apply: (1) All new construction and substantial improvements of residential structures have the lowest floor (including basement) elevated above the highest adjacent grade at least as high as the depth number specified in feet on the community' s FIRM (at least two feet if no depth number is specified) . (2) All new construction and substantial improvements '"�" of nonresidential structures; (a) have the lowest floor (including basement) �„ elevated above the highest adjacent grade at least as high as the depth number specified in feet on the community' s FIRM (at least two feet if no depth number is specified) , or; (b) together with attendant utility and sanitary facilities be designed so that below the base flood level the structure is watertight with walls substantially impermeable to the passage of water and with structural com- ponents having the capability of resisting hydrostatic and hydrodynamic loads of effects of buoyancy. (3) A registered professional engineer shall submit a certification to the Floodplain Administrator that the standards of this Section, as proposed in Section 7-190 , are satisfied. (4) Require within Zones AH or AO adequate drainage paths around structures on slopes, to guide flood waters around and away from proposed structures. � Section 3 . That this ordinance shall be cumulative of all other ordinances of the City and shall not repeal any of the provisions of said ordinances except in those instances where ;�, provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 4. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Hundred ($200. 00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 5. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance, is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance, and the City Council hereby declares it would have passed such remaining of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6 . The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to � �' " properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of Grapevine, Texas, �,� creates an emergency for the immediate preservation of public business, property, health, safety, and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and it is accordingly so ordained.
