Box 95104 Grapevine, Texas 76099 CC ,- Y P4z-*a= TO: HONORABLE MAYOR, CITY COUNCIL MEMBERS AND THE PLANNING AND ZONING COMMISSION FROM: BRUNO RUMBELOW, CITY MANAGER SCOTT WILLIAMS, DEVELOPMENT SERVICES DIRECTOR MEETING DATE: JANUARY 19, 2010 SUBJECT: DEVELOPMENT SERVICES TECHNICAL REPORT OF CONDITIONAL USE APPLICATION CU09-47 DFW INDUSTRIAL PARK PHASE 3 APPLICANT: Eugene Middleton PROPERTY LOCATION AND SIZE: The subject property is located at 1702 and 1712 Minters Chapel Road and is proposed to be platted as Lots 1 R1 and 1 R2, DFW Industrial Park, Phase 3. The addition contains 3.6 acres and has approximately 391 feet of frontage along Minters Chapel Road. REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to establish a planned industrial park. It is the applicant's intent to subdivide an existing lot with two industrial/warehouse structures into two lots to facilitate the sale of the southernmost lot (1712 Minters Chapel Road). Given that this property is already developed, the only way to assist this process is to establish- a planned industrial park. This will allow the forbearance of interior landscaping and building setback requirements along the common property line between the two newly established lots. There are issues; however, meeting open space, impervious area, front and rear yard setback requirements as established in the "LI" Light Industrial District which will require consideration by the Board of Zoning Adjustment. If considered favorably by Council, the applicant will appear before the Board of Zoning Adjustment at their February 1, 2010 meeting and pending their action, will return to 0:/ZCU/CU09-47.4 1 January 13, 2010 (12:28PM) Council at the February 16, 2010 joint City Council and P&Z meeting for the second reading of the ordinance. PRESENT ZONING AND USE: The property is currently zoned "LI" Light Industrial District and is developed with two industrial/warehouse buildings of 82,575 square feet and 74,199 square feet respectively. HISTORY OF TRACT AND SURROUNDING AREA: The subject and surrounding properties to the north, south, and westwere zoned "I-1" Light Industrial District prior to the 1984 City Rezoning. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "LI" Light Industrial District—vacant SOUTH: "LI" Light Industrial District—vacant EAST: D/FW International Airport property WEST: "LI" Light Industrial District—industrial/warehouse developed property AIRPORT IMPACT: The subject tract is located within "Zone B" Middle Zone of Effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. In "Zone B" the following uses may be considered only if sound treatment is included in building design: multifamily apartments, motels, office buildings, movie theaters, restaurants, personal and business services. Single family residential and sound sensitive uses such as schools and churches should avoid this zone. The applicant's proposal is an appropriate use in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as an Industrial land use. The applicant's proposal is in compliance with the Master Plan. /rs 0:2CU/CU09-47.4 2 January 13, 2010 (12:28PM) MEM # 12 --- MEMO Z' MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: FEBRUARY 16, 2010 SUBJECT: CONDITIONAL USE REQUEST CU09-47 RECOMMENDATION: Staff recommends the City Council approve Conditional Use Request CU09-47 on the second reading of an ordinance, and take any other action necessary. Conditional Use Request CU09-47 was submitted by Eugene Middleton and was approved on the first reading of an ordinance by Council at the January 19, 2010 meeting. Conditional Use Request CU09-47 was a request to establish a planned industrial park on 3.60 acres zoned "LI" Light Industrial District and developed with two industrial/warehouse buildings of 82,575 square feet and 74,199 square feet respectively. The purpose of the planned industrial park designation was to facilitate subdividing the subject site into two lots to facilitate the sale of the southernmost lot (1712 Minters Chapel Road). The applicant sought four variance requests from the Board of Zoning Adjustment relative to the minimum open space, maximum impervious area, front yard setback and rear yard setback for the subject site. The Board approved the variance requests at their February 1, 2010 meeting. /at 0:2CMU09-47.41 February 8, 2010 (2:25PM) a a a A A oil°sg wA Stl31 W m MaasS au 69 I I —y K pp _ G2 - p$j All I+I ZIq s — s m , , I zw 'gigH TI TT' M , > gg co U : g coO`GWk aw - @S owgo @ s z asg SGL U gg o E MaasS au 69 I I —y K pp _ G2 - p$j All I+I ZIq s — s m , , I zw 'gigH TI TT' M , > March 5, 2010 Eugene Middleton Middleton & Associates 1111 S Main St #123 Grapevine, TX 76051 RE: GRAPEVINE FILE #CU09-47 Dear Mr. Middleton, This letter is to verify that your request for a conditional use permit to establish a planned industrial park on property located at 1702 an 1712 Minters Chapel Road and platted as Lots 1 R1 and 1R2, DFW Industrial Park, Phase III was approved by City Council on February 16, 2010. A copy of the approved site plan and Ordiance 2010-03 are enclosed. On January 19, 2010, the Planning and Zoning Commission recommended the City Council approve the request. Any changes to a site plan approved with a conditional use or a special use (no matter how minor or major) can only be approved by city council through the public hearing process. No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a Building Permit is obtained and the erection or alteration of a structure is started, or (2) an Occupancy Permit is obtained and a use commenced. The City Council may grant one additional extension not exceeding one (1) year, upon written application, without notice or hearing. No additional extension shall be granted without complying with the notice and hearing requirements for an initial application for a Conditional Use Permit. This site is approximately 3.6 acres in size, zoned Light Industrial and located at the southwest corner of S.H. 114 and Minters Chapel Road in Grapevine. This lot was developed in 1984 and consists of two large buildings, 1702 and 1712 Minters Chapel Road. Both buildings were constructed for warehouse and office use. The current owner of the property, BREOF AIP Dallas, LP, purchased the property in 2005 and is locally represented by CB Richard Ellis. The purpose for this application is to allow the subdivision of Lot 1 into two separate parcels, Lots 1A and 1 B. A replat for this lot was submitted to the city several weeks ago by CBG Surveying. This subdivision will give the current owners the ability to sell the building located at 1712 Minters Chapel to a local Grapevine businessman so that he may expand and centralize his business. This building has been vacant since early 2008, and CB Richard Ellis has been working on this deal for over 18 months. This Conditional Use Permit will not cause any injury to the value, use or enjoyment of other property in the neighborhood. Unfortunately, due to the year in which these buildings were permitted and constructed, they no longer conform to several of the zoning requirements within the Light Industrial zoning classification. These deficiencies are not a result of the proposed subdivision, but merely a difference between the ordinances of 1984 and today. We have looked at options to help remedy the deficiencies, but due to surrounding developments, parking and loading requirements, fire lanes and property lines, we are unable to resolve these issues. The attached sheet and site plans list the requested variances to be submitted to the Board of Zoning Adjustment. CBRE CUP Submittal We would be happy to meet with staff to discuss any questions you may have about our request. Thank you for consideration of our application.
