HomeMy WebLinkAboutORD 1987-004 CITY OF GRAPEVINE, TEXAS ORDIlVANCE NO. 8 7-0 4 AN OR.DINANCE AMENDING THE CITY CODE OF THE CITY OF GRAPEVINE, TEXAS, BY AMEP+TDIIVG CHAPTE�i, 21, ARTICLE II, RELATING TO HOTEL OCCUPANCY TAX BY AMENDING SEC- TION 21; DIRECTING THE CITY SECRETARY TO NOTIFY ALL HOTELS WITHIN THE CITY OF THE AMENDMENT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EX- CEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) AND A ,��•� SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING AlV EFFECTIVE DATE AND DECLARING AN EMER- � GENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section l. That Chapter 21, Article II of the City Code of the City of Grapevine, Texas, relating to Hotel Occupancy Tax is hereby arnended only in the particulars stated in this ordinance and that all ordinance and that all other existing sections, subsections, paragraphs, sentences, definitions, phrases and words of said City Code are not amended, but shall remain intact and are hereby ratified, verified and affirmed. Section 2. That Section 21-25 relating to Reports is amended to read as follows: "On the last day of each month, every person required in section 21-23 to collect the tax imposed herein shall file a report with the city manager showing the consideration paid for all room occu- pancies in the preceding month, the amount of the tax collected on such occupancies, and any other information as the city manager may reasonably require. Such person shall pay the tax due on such occupancies at the time of filing such report. �ection 3. The change in the reporting and payment requirements as provided by this Ordinance shall be effective commencing March 1, 1987, with the reporting and payment requirements for the months of January and February, 1987 being due on the last day of March, 1987, and the City Secretary is hereby directed to notify all hotels within the City of Grapevine, Texas, of the change no later than February 13, 1987, by sending each hotel an executed copy of this Ordinance. Section 4. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined a sum not to exceed Two Hundred Dollars ($200.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 6. The fact that the present ordinances and regulations of the �'" City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of � public business, property, health, safety, and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and it is accordingly so ordained.
