AN ORDINANCE OF THE CITY OF GRAPEVINE,
TEXAS, RELATING TO THE REGULATION OF
VEHICLES WHICH TRANSPORT PERSONS FOR
HIRE BY AMENDING CHAPTER 3, ARTICLE III,
CHAPTER 2A OF THE GRAPEVINE CITY CODE
RELATING TO THE DALLAS-FORT WORTH
� INTERNATIONAL AIRPORT REGULATIONS BY
PROVIDING A NEW SUBSECTION 1-4 (22)
RELATING TO DEFINITIONS; BY AMENDING
SECTION 2-9 (c) RELATING TO FEES; BY
AMENDING SECTION 5-10 (b) AND BY
PROVIDING A NEW SECTION 5-10 (j) RELATING
TO SCHEDULED BUS AND LIMOUSINE SERVICE;
BY PROVIDING A NEW SECTION 7-2 (f)
RELATING TO VEHICLE EQUIPMENT; BY
AMENDING CHAPTER 22 OF THE GRAPEVINE
CITY CODE RELATING TO TAXICABS BY
AMENDING SECTION 22-1 . 5 RELATING TO
DEFINITIONS; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A SAVINGS CLAUSE;
PROVIDING A PENALTY OF FINE NOT TO
EXCEED THE SUM OF TWO HUNDRED DOLLARS
($200. 00) FOR EACH OFFENSE AND A
SEPARATE OFFENSE SHALL BE DEEMED
COMMITTED EACH DAY DURING OR ON WHICH AN
OFFENSE OCCURS OR CONTINUES; DECLARING
AN EMERGENCY AND PROVIDING AN EFFECTIVE
DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,
TEXAS :
Section 1 . That the City Code of the City of Grapevine,
Texas, is hereby amended by amending Chapter 3 , Article III,
Chapter 2A, Section 1-4 relating to Definitions by the addition
of a new subsection 1-4 (22) which shall read as follows:
" (22) Shared ride/shuttle vehicle means a limousine that
has a manufacturer' s rated seating capacity of not
more than eight (8) passengers. "
Section 2. That the City Code of the City of Grapevine,
Texas, is hereby amended by amending Chapter 3, Article III ,
Chapter 2A, Section 2-9 (c) relating to Fees is hereby amended to
read as follows :
" (c) In addition to the annual fee required in subsection
(a) the holder of a bus operating authority shall pay
a gate fee of four dollars ($4. 00) and the holder of
a limousine operating authority shall pay a gate fee
of two dollars ($2. 00) for shared ride/shuttle
vehicles and three dollars ($3 . 00) for all other
limousines, in a manner prescribed by the
administrator, each time a bus or limousine:
(1) exits the airport, if providing prearranged
service; or

(2) completes a scheduled route through the airport,
if providing scheduled service. "
Section 3 . That the City Code of the City of Grapevine,
Texas, is hereby amended by amending Chapter 3, Article III,
Chapter 2A, Section 5-10 (b) relating to Scheduled Bus and
Limousine Service is hereby amended to read as follows:
" (b) A driver or holder shall follow the scheduled route
regardless of whether the bus or limousine is filled
to capacity, unless otherwise authorized by the
administrator in procedures governing shared ride/
shuttle vehicles. "
Section 4 . That the City Code of the City of Grapevine,
Texas, is hereby amended by amending Chapter 3 , Article III ,
Chapter 2A, Section 5-10 relating to Scheduled Bus by the
addition of a new subsection 5-10 (j) which shall read as follows :
�' % " (j) A holder of an operating authority for a scheduled
limousine service that uses shared ride/shuttle
vehicles shall log, on a tape recorder and in a
manner approved by the administrator, all radio and
telephone communications between all customers and
the limousine service dispatcher and between the
limousine service dispatcher and all drivers. The
purpose of the log is to document the limousine
service ' s dispatch of extra vehicles to complete
scheduled routes for vehicles that are filled to
capacity. "
Section 5 . That the City Code of the City of Grapevine,
Texas, is hereby amended by amending Chapter 3 , Article III,
Chapter 2A, Section 7-2 relating to Vehicle Equipment by the
addition of a new subsection 7-2 (f) which shall read as follows:
" (f) A holder, owner, or driver operating a scheduled
limousine service is not required to comply with
vehicle requirements described in Subsections (b) (2) ,
(3) , (4) and (9) when using a shared ride/shuttle
vehicle. "
Section 6 . That the City Code of the City of Grapevine,
Texas, is hereby amended by amending Chapter 22, Section 22-1 .5
` relating to Definitions by the inclusion of definitions for
"limousine" and "shared ride/shuttle vehicle" which shall read as
� follows:
"Limousine means a vehicle that has a manufacturer ' s rated
seating capacity of not more than fifteen (15) passengers
and that is used for the transportation of persons.
Shared ride/shuttle vehicle means a limousine that has a
manufacturer' s rated seating capacity of not more than eight
(8) passengers. "
Section 7 . If any section, article, paragraph, sentence,
clause, phrase or word in this Ordinance, or application thereto
any person or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not
affect the validity of the remaining portions of this Ordinance;
and the City Council hereby declares it would have passed such
remaining portions of this Ordinance despite such invalidity,
which remaining portions shall remain in full force and effect.
Section 8 . This shall be cumulative of all codes and
ordinances of the City of Grapevine and shall not repeal any of
�,� the provisions of those codes or ordinances unless there is a
direct conflict with the terms and provisions of this ordinance.
Section 9. Any person violating any of the provisions of
`�' this Ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be subject to a fine in a sum not
to exceed Two Hundred Dollars ($200. 00) for each offense and a
separate offense shall be deemed committed upon each day during
or on which a violation occurs.
Section 10 . The fact that the present ordinances and
regulations of the City of Grapevine, Texas, are inadequate to
properly safeguard the health, safety, morals, peace and general
welfare of the inhabitants of the City of Grapevine, Texas,
creates an emergency for the immediate preservation of the public
business , property, health, safety, and general welfare of the
public which requires that this Ordinance become effective from
and after the date of its passage and it is accordingly so
ordained.
