ORDINANCE NO. 86-12
AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF
GRAPEVINE, TEXAS BY AMENDING CHAPTER 11, ARTICLE III
RELATING TO FIRE PROTECTION AND PREVENTION BY A-
MENDING SECTION 11-46(c)(1); P1�,OVIDING A PENALTY NO�' TO
EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) AND
A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON
EACH DAY DURING OR ON WHICH A VIOLATION OCCURS;

�:.. BE IT ORDAINED BY 'i'HE CITY COUNCIL OF THE CITY OF GRAPE-
VINE, TEXAS:
Section 1. '�hat Chapter 11, Article III of the City Code of the City of
Grapevine, Texas, relating to Fire Protection and Prevention is hereby amended
in the following particulars and all other existing sections, subsections,
paragraphs, sentences, definitions, phrases and words of said City Code are not
amended, but shall remain intact and are hereby ratified, verified and affirrned:
"(1) Any person, firm or corporation desiring to erect a retail
service station within the corporate limits of the City of
Grapevine, Texas, shall file a written application with the city
secretary requesting the issuance of such permit, except that no
permit shall be required under this Section 11-46 where an
application for a conditional use permit has been approved in
accordance with Section 48 of Ordinance No. 82-73, as amended,
the Comprehensive Zoning Ordinance of the City of Grapevine,
Texas, same being also known as Appendix D of the Code of
Ordinances of the City of Grapevine, Texas."
Section 2. If any section, article, paragraph, sentence, clause, phrase or
�,, word in this ordinance, or application thereto any person or circumstance is held
invalid or unconstitutional by a Court of competent jurisdiction such holding
, shall not affect the validity of the remaining portions of the ordinance; and the
� - City Council hereby declares it would have passed such remaining portions of the
ordinance despite such invalidity, which remaining portions shall remain in full �
force and effect.
Section 3. Any person violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof shall be
� fined in a sum not to exceed Two Hundred Dollars ($200.00) and a separate
offense shall be deemed committed upon each day during or on which a violation
occurs or continues.
Section 4. The fact that the present ordinances and regulations of the �
City of Grapevine, Texas, are inadequate to properly safeguard the health,
safety, morals, peace, and general welfare of the inhabitants of the City of
Grapevine, Texas, creates an emergency for the immediate preservation of
public business, property, health, safety, and aeneral welfare of the public which
re�,uires that this ordinance shall becocne effective from and after the date of
its passage and it is accordingly so ordained.
