ORDINANCE NO. 85-32
AN ORDINANCE AMENDING CHAPTER 4 OF THE CITY CODE
DEALING WITH ALCOHOLIC BEVERAGES BY REQUIRING CON-
DITIONAL USE APPROVAL PURSUANT TO SECTION 48 OF THE
ZONING ORDINANCE; SPECIFICALLY INCLUDING PRNATE
CLUBS; PROVIDING THAT PRNATE CLUBS GROSS SALES E-
QUAL AT LEAST FIFTY PERCENT (50%) FOR FOOD; PROVIDING
A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS ($200.00) FOR EACH OFFENSE AND A SEPARATE

SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND
PROVIDING AN EFFECTNE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPE-
VINE, TEXAS:
Section 1. That Chapter 4 of the City Code relating to alcoholic
beverages is hereby amended to read as follows:
Section 4-3 is amended to read as follows:
"The storage, possession, sale or serving of alcoholic beverages by
anyone for consumption by anyone, either on or off the premises,
shall be illegal unless on property zoned specifically for that
purpose as a conditional use in accordance with Section 48 of the
zoning ordinance."
Section 4-5 is amended to by changing the title to read as follows:
"Mixed beverage and private club permit holder" and the following
"°�'"" additional paragraph is added between the second and third
paragraphs as follows:
"All holders of private club permits shall conduct their business in
a manner that produces gross revenues on an annual basis from the
sale of food that at least equals the gross revenues produced from
the serving of alcoholic beverages. This paragraph shall not apply
to any Fraternal and Veterans Organizations legally operating as
the holder of a private club permit prior to the effective date of
this ordinance."
Section 2. This ordinance shall go into effect from and after its final
passage except that its provisions shall apply to existing private clubs 60 days
from the effective date of this ordinance.
Section 3. Any person violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof shall be
fined in a sum not to exceed Two Hundred Dollars ($200.00) for each ofiense and
a separate offense shall be deemed committed upon each day during or on which
a violation occurs or continues.
Section 4. If any section, article, paragraph, sentence, clause, phrase or
word in this ordinance or application thereto any person or circumstance is held
invalid or unconstitutional by a Court of competent jurisdiction such holding
"� � shall not affect the validity of the remaining portions of this ordinance; and the
City Council hereby declares it would have passed such remaining portions of
this ordinance despite such invalidity, which remaining portions shall remain in
� full force and effect.
Section 5. The fact that the present ordinances and regulations of the
City of Grapevine, Texas, are inadequate to properly safeguard the health,
safety, morals, peace, and general welfare of the inhabitants of the City of
Grapevine, Texas, creates an emergency for the immediate preservation of
public business, property, health, safety, and general welfare of the public which
requires that this ordinance become effective from and after the date of its
passage and it is accordingly so ordained.
