ORDINANCE NO. 85-11
AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF
GRAPEVINE, TEXAS, BY AMENDING CHAPTER 21, ARTICLE II,
RELATING TO HOTEL OCCUPANCY TAX BY AMENDING
SECTION 21-21; DIRECTING THE CITY SECRETARY TO NOTIFY
�"� ALL HOTELS WITHIN THE CITY OF THE AMENDMENT; PRO-
VIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT
TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00)

UPON EACH DAY DURING OR ON WHICH A VIOLATION
OCCURS; PROVIDING AN EFFECTNE DATE AND DECLARING
AN EMERGENCY
NOW, THEREFORE, BE IT URDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1. That Chapter 21, Article II of the City Code of the City of
Grapevine, Texas, relating to Hotel Occupancy Tax is hereby amended only in
the particulars stated in this ordinance and that all other existing sections,
subsections, paragraphs, sentences, definitions, phrases and words of said City
Code are not amended, but shall remain intact and are hereby ratified, verified
and affirmed.
Section 2. That Section 21-21 is amended to read as follows:
"There is hereby levied a tax upon the cost of occupancy of
any room or space furnished by any hotel where such cost of
occup�ncy is at the rate of two dollars ($2.00) or more per day,
such tax to be equal to six (G) per cent of the consideration paid
�, _ by the occupant of such room, space or facility to such hotel,
exclusive of other occupancy taxes imposed by other governmental
agencies."

Section 3. The increase in the tax upon the cost of occupancy of any
room or space as provided by this Ordinance shall be effective commencing April
1, 1985, and the City Secretary is hereby directed to notify all hotels within the
City of Grapevine, Texas, of the increase no later than March 18, 1985, by
sending each hotel an executed copy of this Ordinance.
Section 4. If any section, article, paragraph, sentence, clause, phrase or
word in this ordinance or application thereto any person or circumstances is held
invalid or unconstitutional by a Court of competent jurisdiction such holding
shall not affect the validity of the remaining portions of the ordinance; and the
City Council hereby declares it would have passed such remaining portions of the
ordinance despite such invalidity, which remaining portions shall remain in full
force and effect.
Section 5. Any person violating any of the provisions of this Ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof shall be
fined a sum not to exceed Two Hundred Dollars ($200.00) and a separate offense
shall be cieemed committed upon each day during or on which a violation occurs
or continues.
�;.,;� Section 6. The fact that the present ordinances and regulations of the
City of Grapevine, Texas, are inadequate to properly safeguard the health,
' safety, morals, peace, and general welfare of the inhabitants of the City of
Grapevine, Texas, creates an emergency for the immediate preservation of
public business, property, health, safety, and general welfare of the public which
requires that this ordinance shall become effective from and after the date of
its passage and it is accordingly so ordained.
